RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock a Contract with
Bill Hughes Fence Company to install 4,000 linear feet of chain link fence at
Burl Huffman Athletic Complex, attached herewith which shall be spread upon
the minutes of the Council and as spread upon the minutes of this Council
shall constitute and be a part of this Resolution as if fully copied herein in
detail.
Passed by the City Council this 12th day of March ,1981.

RESOLUTION #746 - 3/12/81

THIS AGREEMENT, made this 19th day of February, 1981, by and between the
City of Lubbock, herein called "Owner" acting herein through its Mayor, and an
eindividual doing business as Bill Hughes Fence Company of Lubbock, County of
Lubbock, and State of Texas hereinafter called "Contractor".
WITNESSETH: That for and in consideration of the payments and agreements
hereinafter mentioned, to be made and performed by the OWNER, the CONTRACTOR
hereby agrees with the OWNER to commence and complete the construction described
as follows:
Install 4,000 linear feet of chain link fence at Burl Huffman Athletic
Complex.
hereinafter called the project, for the sum of Six Thousand Four Hundred and
No/100 ($6,400.00) Dollars and all extra work in connection therewith, under
the terms as stated in the General and Special Conditions of the Contract; and
at his own proper costs and expense to furnish all the materials, supplies,
machinery, equipment, tools, superintendence, labor, insurance, and other
accessories and services necessary to complete the said project in accordance
with the conditions and prices stated in the Proposal, the General Conditions,
Supplemental General Conditions and Specifications of the Contract, the plans,
which include all maps, plats, blue prints, and other drawings and printed or
written explanatory matter thereof, the specifications and contract documents
thereof as prepared by Parks and Recreation Department, herein entitled the
Architect/Engineer, and as enumerated in the Supplemental General Conditions,
all of which are made a part hereof and collectively evidence and constitute
the contract.
The CONTRACTOR hereby agrees to commence work under this contract on or
before a date to be specified in a written "Notice to Proceed" of the OWNER
and to fully complete the project within sixty (60) consecutive calendar days
thereafter. The Contractor further agrees to pay, as liquidated damages, the
sum of One Hundred and No/100 ($100.00) Dollars for each consecutive calendar
day thereafter as hereinafter provided in the General Conditions.
The OWNER agrees to pay the CONTRACTOR in current funds for the performance
of the contract, subject to addition and deductions, as provided in the General
Conditions of the Contract, and to make payments on account thereof as provided
in the .Paragraph entitled "Payments to Contractor", of the General Conditions.
IN WITNESS WHEREOF, the parties to these presents have executed this
contract in six (6) counterparts, each of which shall be deemed an original,
in the year and day first above mentioned.

FENCE INSTALLATION
INVITATION TO BID
I. Sealed proposals addressed to Floyd Nesbitt, Purchasing Department,
P.O. Box 2000, Lubbock, TX 79457 for installation of 4,688 feet more
or less of 6' chain link fence. Installation shall include concrete
footing and all labor necessary to install owners materials.
2• The Owner reserves the right to accept or reject any or all proposals.
No bidder may withdraw his bid within 30 days after the actual date of
the opening thereof.
3. Payment for work will be- made in partial payments as the work is com-
pleted in an entire area.
4. Copies of approved Workmen's Compensation Insurance and Liability
•Insurance within minimum limits of $100,000/300,000 shall be placed
on file with the Directors of Purchasing by the successful bidder.
5. All bidders shall make an examination of the site in -order to familiarize
himself with the conditions to be encountered. No extra compensation
will be allowed for work made necessary due to unsual conditions and/or
obstacles encountered during the progress of the work.'
GENERAL CONDITIONS
All work involved with the Burl Huffman Fence Installation will be supervised,
inspected, and coordinated by the Parks and•Recreation Department. :.

MATERIALS
1. Concrete for footings shall meet all specification as�per-provided
on plans.
2. All fence fabric including poles, hardware, fabric shall be furnished
by owner.
SCOPE OF WORK
1. Every precaution shall be taken that there shall be alignment both
verticle and horizontal, which would justify rejection of work.
2. Work of other trades shall.be protected at all times.
3. Premises shall be kept clean from all unused materials and returned
to owner.
4. All work will be inspected on a regular basis by contractor and owner.
