HomeMy WebLinkAboutResolution - 964 - Addendum To Appraisal Agreement - LCAD - Property Rights - 11/12/1981RESOLUTION 964 - 11/12/81 Amends Reso. 45.7 - 3/27/ 80 RESOLUTION WHEREAS, the Lubbock County Appraisal District is required by the Property Tax Code, V.A.T.C., to establish an appraisal office; and WHEREAS, the City of Lubbock is a taxing unit located within the District; and I WHEREAS, the District is desirous of contracting with the City to 1perform appraisal services for the District in order to promote govern- mental efficiency and eliminate the costs of establishing a new appraisal ,office for the District; and WHEREAS, the City and the District have previously contracted to provide the appraisal services; and i WHEREAS, the parties desire to clarify and correct the provisions of ;the Appraisal Agreement relative to ownership of personal property; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Addendum to the Appraisal Agreement between the City of Lubbock and the Lubbock County Appraisal District, attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in .detail. 'VJRraS 12=R ADDENDUM TO THE APPRAISAL AGREEMENT BETWEEN THE CITY OF LUBBOCK AND THE LUBBOCK COUNTY APPRAISAL DISTRICT THE STATE OF TEXAS § KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LUBBOCK § This Addendum to the Appraisal Agreement entered into this 1?*� day of November , 1981, by and between the City of Lubbock, Texas ("City") and the Lubbock County Appraisal District ("District"), WITNESSETH: WHEREAS, the Lubbock County Appraisal District is required by the Property Tax Code, V.A.T.C., to establish an appraisal office; and WHEREAS, the City of Lubbock is a taxing unit located within the District; and WHEREAS, the District is desirous of contracting with the City to perform appraisal services for the District in order to promote governmental efficiency and eliminate the costs of establishing a new appraisal office for the District; and WHEREAS, the City and the District have previously contracted to provide the appraisal services; and WHEREAS, the parties desire to clarify and correct the provisions of the Appraisal Agreement relative to ownership of personal property; NOW THEREFORE, the City and the District do mutually agree to amend the Appraisal Agreement between the City of Lubbock and the Lubbock County Appraisal District of March 27, 1980, as follows: I. The Appraisal Agreement between the City of Lubbock and the Lubbock County Appraisal District of March 27, 1980 is by reference incorporated herein for all purposes except as amended hereinafter. II. Paragraph II of the Appraisal Agreement between the City of Lubbock and the Lubbock County Appraisal District is hereby amended by the addition of Subparagraph No. 6, which Subparagraph shall read as follows: • It is agreed that all personal property acquired by the City in the performance of Phase One of this contract shall be the property of the District, and the District shall be entitled to possession of said property upon termination of this Agreement. It is the intention of the parties that this provision supersede any other provision of this contract which directly or indirectly conflicts herewith-.' III. Paragraph III of the Appraisal Agreement between the City of Lubbock and the Lubbock County Appraisal District is hereby amended by adding thereto Subparagraph No. 5, which Subparagraph shall read as follows: It is agreed that all personal property acquired by the City in the performance of Phase Two of this contract shall be the property of the District, and the District shall be entitled to possesion of said property upon termination of this agreement. It is the intention of the parties that this provision supersede any other provision of this contract which directly or indirectly conflicts herewith. IN WITNESS WHEREOF, the City and the District have executed this Agreement as of the first day above written.
