RESOLUTION 990 - 12/10/81
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock a Membership
Contract for Consumer Reports between the City of Lubbock and Industrial
Foundation of America, attached herewith which shall be spread upon the
minutes of the Council and as spread upon the minutes of this Council
shall constitute and be a part of this Resolution as if fully copied
herein in detail.
Passed by the City Council this 10th day of December ,1981.

Membership contract entered into the 28th day of October 19 81 by and between
INDUSTRIAL FOUNDATION OF AMERICA (hereinafter sometimes referred to as "Foundation"), and
CITY OF LUBBOCK
member or prospective member (hereinafter called "user", under the following terms and conditions:

User agrees to abide by the provisions of the Fair Credit Reporting Act and user takes cognizance of the fact
that the information which will be received as a "consumer report from a consumer reporting agency" within the
meaning of said Act and that Section 615(a) of said Act requires that
"whenever credit or insurance for personal, family, or household purposes, or employment involv-
ing a consumer is denied or the charge for such credit or insurance is increased either wholly or
partly because of information contained in a consumer report from a consumer reporting agency,
the user of the consumer report shall so advise the consumer against whom such adverse action
has been taken and supply the name and address of the consumer reporting agency."
User further agrees that information will be requested only for the user's exclusive use, and that inquiries will
be made only for one or more of the following permissible purposes and no other:
(a) In connection with a credit transaction involving the consumer on whom the information is to be furnished
and involving the extension of credit to, or review or collection of an account of, the consumer or
(b) In connection with employment purposes; or
(c) In connection with the underwriting of insurance involving the consumer, or
(d) In connection with a determination of the consumer's eligibility for a license or other benefit granted by
a governmental instrumentality required by law to consider an applicant's financial responsibility or sta-
tus; or
(e) In connection with a legitimate business need for the information in connection with a business transaction
involving the consumer.
Reports will be requested only by the user's designated representatives. Employees will be forbidden to attempt
to obtain reports on themselves, associates or any other person except in the exercise of their official duties.
It is understood that the Fair Credit Reporting Act, Public Law 91-508, Section 619 states
"Any person who knowingly and willfully obtains information on a consumer from a consumer
reporting agency under false pretenses shall be fined not more than $5,000 or imprisoned not
more than one year, or both."

Foundation will cease furnishing consumer reports to User if the Foundation knows, or has reason to believe,
User is violating any provision of the Fair Credit Reporting Act.
