HomeMy WebLinkAboutResolution - 1031 - CO#1 To Contract - Carrothers Co - Renovations, SE Water Reclamation Plant - 02/11/1982��$ 111gg2 JWF:da RF.g0T.TTTTLIN RESOLUTION 1031 — 2/11/82 (Amends Reso. 992, 12/10/81) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock Change Order No. 1 to a contract previously entered into by and between said City and Carrothers Construction Co., Inc. for renovations to the Southeast Water Reclamation Plant, Lubbock, Texas, attached herewith which shall be spread upon theminutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail Passed by the City Council ATTEST: this 11th day of February ,1982. Original Amount of Contract . . . . . . . $567,000.00 Change Order Number One . . . . . . -0- Adjusted Contract Amount . . . . . . $567,000.00 Adjustment in Construction Time None WHEREAS, it is desirable to modify the retainage provisions of the construction contract for this project in order to comply with recently enacted state legislation. THIS AGREEMENT WITNESSETH: In consideration of the mutual advantage gained, the Owner and the Contractor agree to the modifications of Paragraph GC -46, page GC -15 of the General Conditions of the contract documents for the project as follows, and further agree that there shall be no change in the contract price or the completion date for the project. Retainage shall be equal to 5% of the total amount of the Engineer's statement for the project instead of 10% as stated in the contract documents. Other provisions of Paragraph GC -46 shall remain unchanged. IN WITNESS WHEREOF, the Owner and the Contractor have hereto set their hands this the iltb day of , 1982.
