RESOLUTION 1151 - 7/22/82
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in
Lubbock County, Texas, has determined and does hereby determine that the
public needs, safety, and welfare demand and create a public necessity for the
construction, maintenance and ope *tion of a sanitary landfill for the dis-
posal of garbage, rubbish and.trash for the betterment of public health condi-
tions in the City of Lubbock, which is determined to be a public municipal
purpose deemed advisable for said City by its City Council pursuant to Article
1175(15), V.A.C.S., and this City Council of said City finds it in the best
public interest and for public purposes and municipal purposes to proceed with
the acquisition of lands as needed for such purposes as aforesaid; NOW THERE-
FORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described real
estate located in Lubbock County, Texas, be acquired for public purposes and
municipal purposes as set forth in the preamble hereof, to -wit:
A parcel of land containing 69.68 acres of land, more or less, and more
particularly described by metes and bounds as follows:
BEGINNING at a 31" iron rod set in the North line of Section 33, Block A,
for the Northwest and beginning corner of this tract, whence a found
railroad spike the Northwest corner of Section 33, Block A bears South
89°59106" West 639.71 feet;
THENCE North. 89059106" East along the North line of Section 33, Block A,
1980.0 feet to a Y' iron rod set for the Northeast corner of this tract,
whence a found 3/4" iron pipe, the Northeast corner of Section 33, Block
A bears North 89°59106" East 2620.0 feet;
THENCE South 0023'54" East at 25.0 feet pass a Y" iron rod, continuing
for a total distance of 2200.0 feet to a '" iron rod, set for the South-
east corner of this tract;
THENCE North 56040'38" West, 2381.79 feet to a" iron rod, set for the
Southwest corner of this tract;
THENCE North 0°19120" West at 866.0 feet pass a 'Y" iron rod, continuing
for a total distance of 891.0 feet to the PLACE OF BEGINNING.
SECTION 2. THAT the owners of said land including J. R. CONE and JAMES
RAYMOND CONE, as Trustees of the Cone Sisters Trust, BE offered through the
Right -of -Way Department of the City of Lubbock the amount of $38,100, which is
the amount appraised as the value and total damages for the fee simple title
and acquisition of said real estate hereinabove described for the purposes
herein stated, for the use and benefit of the City of Lubbock, located in
Lubbock County, Texas, and unless accepted forthwith the City Attorney of said
City of Lubbock is hereby authorized and instructed to institute condemnation
(eminent domain) proceedings to acquire the fee simple title to said land as
hereinabove described for public purposes and municipal purposes.
