RESOLUTION 1390 - 5/12/83 (Rescinds Reso. 13712 - 4/14/83) 1JCR/mck BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Order granting a rate increase to South Plains Electric Cooperative, Inc. attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Ross, Jr., City At rney IJCR: cl ORDER RESOLUTION 1390- 5/12/83 Rescinds Temporary Order -- Reso. 1372 -4% AN ORDER OF THE CITY COUNCIL OF THE CITY OF LUBBOCK, SITTING AS A REGU- LATORY AUTHORITY UNDER VERNON'S ANN.CIV.STAT., ART. 1446c GRANTING A RATE INCREASE TO SOUTH PLAINS ELECTRIC COOPERATIVE, INC.. AND REQUIRING REVISED TARIFFS TO BE FILED WITH THE CITY SECRETARY. WHEREAS, South Plains Electric Cooperative, Inc. did file with the City of Lubbock a statement of intent and application for a rate increase on November 11, 1982, and WHEREAS, the City has received no complaint from any customer or other affected person within forty-five (45) days after the notice of intent to increase rates by South Plains Electric Cooperative, Inc., and WHEREAS, the City Staff and consultants have examined the statement of intent and application filed by South Plains Electric Cooperative, Inc., and have found a_ -limited cost differential between City of Lubbock customers and rural customers, such cost differential is determined to be insignificant, if South Plains Electric Cooperative, Inc., will begin paying an appropriate gross receipts tax and will render its property located within the City of Lubbock in accordance with its true value; and WHEREAS, representatives of South Plains Electric Cooperative, Inc. ap- peared before the City Council sitting as a Regulatory Authority and gave evidence of the just and reasonable effect of the rates requested, and WHEREAS, the Regulatory Authority, after considering all of the evidence before it finds that the rates requested by South Plains Electric Cooperative, Inc. are just and reasonable, and. WHEREAS, the Public Utility Commission of the State of Texas in Docket No. 4822 has granted a similar request of South Plains Electric Cooperative, Inc. allowing rates to be increased in the service area of applicant outside of the City limits of the City of Lubbock, NOW THEREFORE: BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS: 1. That the Temporary Order heretofore entered in this matter on the 14th day of April, 1983, is hereby dissolved and of no further force or effect. 2. That South Plains Electric Cooperative, Inc. be and is hereby authorized to place into effect new rates for service within the City of Lubbock, Texas. 3. The new rates hereby authorized shall be identical to those rates au- thorized by the Public Utility Commission of Texas in its Order in Docket No. 4822. 4. That South Plains Electric Cooperative, Inc. shall file a revised tariff with the City Secretary to implement the rates authorized by this Order and the City Secretary shall endorse upon the face of such revised tariff the word approved and reference this Order. 5. These rules will not relieve in any way a continuity of any of its duties under the laws of this state or the United States. If any provisions of these rules are held invalid. such invalidity shall not affect other provisions or applications of these rules which can be given effect without the Invalid provision,or application, and to this end the provisions of these rules are declared to be severable. These rules shall not be construed so as to enlarge, diminish, modify, or alter the jurisdiction, powers or authority of South Plains Electric Cooperative, Inc.. regulatory bodies, or the substantive rights of sny person. General Sources of Authority The rules, regulations and minimum standards governing and regulating the operation of electric service utilities adopted by the Commission, the Articles of Incorporation, the bylaws of the Cooperative as approved and amended from time to time, the politica adopted by the Cooperative's Board of Directorse tl%e rules, regulations and mortgage requirements of the Rural Electrilicatioa Administration (REA) and the'National Rural Utilities Cooperative Finance Corporation (CFC). and the rules, regulaticna and requirements of any other governing body. Amarillo Rood Lubbock.Texas DESCRIPTION OF THE COOPERATIVE'S OPERATIONS I The Cooperative is a non-profit electric cooperative corporation organized under the Texas Electric Cooperative Corporation Act. The Cooperative's offices and warehouse are located at 110 North Amarillo Road in Lubbock. Texas. All business and operational activities are conducted. or supervised from this. location. The Cooperative's business affairs are managed under the direction of and policies set by a Board of Directors con- sisting of seven member -consumers elected by the membership of the Cooperative at membership meetings held annually. in accordance with the Bylaws. The Cooperative's operations are primarily in rural areas of the South Plains of Texas. The greater portion. of its facilities and consumers are located within a 30 -mile radius of Lubbock. Texas. Types of load being served are varied, ranging from rural residential to large industrial. However, the dominant load influence is agricultrual and agribusiness. The load density of. the Cooperative's service area is relatively high in comparison with typical rural areas. There is intensive irrigation development throughout the service area plus non-agri-related residential and commercial develop- ment infiuemxd by proximity to the.City of Lubbock. Construction of electric plant facilities has been principally financed over the years by long-term loans from the Rural Electrification Administration (REA) and in more recent years.. by supplemental long-term loans from the Rational Rural Utilities Cooperative Finance Corporation (CFC). Additionally. retained margins from operations assigned to the Capital Account of members ('Capital Credits") bas provided a substantial portion of the investment capital for electric plant investment. The Cooperative provides service to slightly over 10.000 member -consumers through 22,000 separately metered points of delivery, served by 3.900 miles of overhead and underground distribution line. 101 miles of 69 KV transmission line and 24 substations.. The total power requirements are supplied at wholesale from Southwestern Public Service CompaiW of Amarillo. Texas. All substations of the Cooperative have tie -line interconnection facilities to other substations but are operated open except for emergency operations. The standard distribution voltage is 7200/12470 volt wye. The present total sub- station capacity is 146.250 KVA. The serving of all field and irrigation development throughout the Operative's service area has brought three-phase service reasonably available to all areas and has resulted in Improved service to all consumers. The terrain of the service area is typical of the South Plains with rock seldom being encountered in the construction of facilities. The exception of terrain is found in the.Yellowhouse Canyon along the Double Mountain Fork of the Brazos River and off the Caprock in rolling plains. Service is primarily provided by the Cooperatve's personnel with construction contractors being used to augment the i .Cooperative's capabilities during periods of bnormal.demand. for service. The Cooperative has an authorized compli- ment of 107 employees with the normal work fora averaging approximately 100. Operational and construction capabilities include six service crews, three heavy construction crews, three underground crews. one substation and one apparatus crew, one mobile meter test unit and an apparatus shop and meter laboratory. The Engineering Department is directed by a registered professional engineer. The Cooperative has on premise a•Digital 1.1/;4 computer system and substantially all records and reports are so processed and maintained. The current long-range system plan was prepared in 1971 but there has been updating and revision at scheduled intervals since initial preparation. Power requirements studies and financial forecasts are prepared and/or updated at regular intervals and are utilized in the financial and operational management of the Cooperative. Although the Cooperative performs the majority of its own work, consultants are utilized for assistance in preparation of long-range system plans, financial forecasts and other overview type professional service as becomes necessary for direction and audit of the Cooperative's operations. Technical assistance.is readily available from specialists of the Rural Electrifi- cation Administration and the National Rural Utilities Cooperative Finance Corporation. Under a statewide disaster plan coordinated by Texas Electric Cooperatives, inc. of Austin. Texas. construction capabilities are available from other cooperatives for repairs of extreme damage to the electric system caused by ice. storms, tornados, hurricanes .and other major disasters. Texas GENERAL RULES I DEFINITIONS J As used in these rules, unless the context requires otherwise. the following words shall have the indicated meaning: (1) All words defined in the Substantive Rules of the public Utility Commission of Texas shall have the same meaning as indicated therein. (2) Construction Agreement: A special written agreement between consumer and the Cooperative required as a pre- requisite to construction to certain classes of service. (3) Construction Charge: As used in these rules, meaning and application synonymous with •Contribution in Aid of Construction.' (4) Contribution in Aid of Construction: Money paid by a consumer to the Cooperative for construction of electric facilities and is non-refundable.. (5) Consumer: Any person. firm, partnership, corporation, municipality, cooperative organization, governmental agency. etc. provided.with electric service by the Cooperative. This term used in these rules is synonymous with •Customer• in the substantive rules of the Public Utility Commission of Texas. (6) Consumer Classes: a. Basic Consumer Class - Consumers having permanent electric service need that can usually be satisfied with single-phase service. Includes residential single family dwelling units. separately metered apartments. duplexes. and condominium; also includes electric service required.to support a residence such as a separate water well. b. General Service Consumer Class � All consumers using electric service except for those consumers in the Basic. Parer, and Large Consumer groups. Includes electric service for retail stores, schools and public buildings, public or private -shops. apartment buildings. general farmstead use or small commercial, in- dustriai. and manufacturing plants requiring less than 50 KVA of capacity. e. Power Consumer Class - Principal electric use being for the serving of motors. Limited -to use for irrigation..cotton ginning and oil field pumping. d. Large Power Class.- Unclassified use requiring 50 KVA transformer capacity or greater. (7) Cooperative: South Plains Electric Cooperative, Inc. (8) Cooperative's Electric System: All of the Cooperative's electric plant facilities. (9) Cooperative's Office: The Operative's headquarters at 110 North Amarillo Road. Lubbock. Texas. from which location all office. warehousing, business and.operational transactions are conducted and/or supervised. (10) Electric Teras: a. Ampere - The practical unit of electric. current flow or speed measurement (measured by use of ammeter). b. Volt - The practical unit of Electromotive Force (e.m.f.) measurement which drives or impels the flow of electric current (measured by use of volt -meter). . e. Watt - The practical unit of apparent electric -power of demand measurement (one volt-ampere). d. Kilowatt - One thousand (1.000) watts of electric power or demand. e. Kilowatt Hour - The practical unit of electric work measurement. (One kilowatt for one hour). f. Kilovolt -Ampere (KYA) - The instantaneous quantity of electric capacity delivered, and•is equal to 1,000 volt-amperes. The unit -of this •apparent* electric power is the Kilovolt -Ampere. g. Reactive Kilovolt -Ampere - The inactive component of apparent electric parer, the kilowatt is the active component. Termed Kilovar (KYAR). h. Horsepower - One horsepower is the equivalent of 746 watts. (11) Consumer's System: The total of the consumer's electric wiring system. (12) Neter loop: That segment of the consumer's wiring system provided for the convenience of installation of the Cooperative's metering equipment. (13) Point of Attachment: The location on &.building. or upon the consumer's premises to which the•Cooperative shall attach the secondary service conductor. (14) Point of Delivery: The point on the Cooperative's electric system where delivery of electric service is made to the consumer's system. (15) Meter Base: The apparatus required to receive the Cooperative's meter. (16) Primary Service: Electric service delivered to the consumer's system at the primary distribution voltage of the Cooperative. (17) Secondary Service: Electric service delivered to the consumer's system at voltages of the consumer's application and use. (18) Service Conductor: The secondary conductor extending from the transformer or secondary voltage system of_ the Cooperative to a point of attachment on the consumer's premises. (19) Service Entrance: The electrical equipment and apparatus furnished by the consumer to provide for the connection of electric service and to distribute power into the consumer's electrical circuits. (20) Service Leads: The conductor from the consumer's service entrance apparatus to be connected to the Coopera- tive's service conductor. (21) Holidays: Special days observed by the closing of the Cooperative's office as designated by Board of Directors Policy. (22) Member: Any consumer receiving electric service from the Cooperative who has applied for and has been accepted into membership in accordance with the Bylaws of the Cooperative. This term under these rules is synonymous with 'consumer.'. (23) office Hours: Time during which the Cooperative's office is open for business with the consumers and the general public. (24) Premises or Consumer Premises: A tract of land or real estate, including.bulldings and other appurtenances thereon. (25) Type of Service: Service classified.in accordance with the period the Cooperative can reasonably anticipate that the service will be required by the consumer. a. Permanent Service - The consumer indicates, and the Cooperative can reasonably expect that there will be continued use of the service over an extended period of time. b. Temporary Service - Service for limited periods of use typified by service to fence chargers. for construction power. fireworks stands. oil well drilling. etc. (26) REA: Rural Electrification Administration. United States Department of Agriculture, Washington. D.C. (27) CFC: National Rural Utilities Cooperative Finance Corporation. Washington. D.C. (28) load Management: Voluntary participation'by consumer to allow Cooperative to shift. shed. or shave N electric service consumption to order to shape Cooperative load curve to the most efficient configuration. (29) Prepayment: An amount paid. to the Cooperative by the consumer for future payment of electric service to a N point of delivery at which no valid need now exists for.electric service, or electric service is requested far in advance of need for such service; the amount shall be equal to Cooperative construction costs. plus cost of removal, and materials used for construction but not salvageable. The amount shall be used to defray applicable rate billing for 48 months (does not include adjustments included in Section 20.01). Any amount remaining after 48 months shall then become a contribution in aid of construction. TARIFF CLERK CONTRACT Between the CANADIAN RIVER MUNICIPAL WATER AUTHORITY and SOUTH PIAINS ELECTRIC COOPERATIVE for 'Electric Power and Energy to Serve the Canadian River Project, Texas • THIS CONTRACT, made this 30th day of September.- , 196 4 , between the CANADIAN'RIVER MUNICIPAL WATER AUTHORITY, represented by the officer executing this contract, and the South Plains Electric Cooperative, Inc., its successors and assigns. WITNESSETH: _ .... . WHEREAS, the Act of Congress, effective,December 29, 1950 (64 Stat.'1124), authorized the construction, operation, and maintenance of the Canadian River Project, Texas, and by contract dated November 28, .1960, the Authority has contracted with the United States for payment of the reimbursable costs of the project as required by the authorizing, legislation, and for assumption of the care, operation, and maintenance of ^=-Ject-works-upon--projectcnmpietion, and, WHEREAS, the Authority desires to contract with the Cooperative for electric service as required to properly operate the project commencing on the date the Authority assumes responsibility for the care, operation, and maintenance of the project. NOW THEREFORE, in consideration of the mutual covenants herein ' set forth, the parties hereto agree as follows: ' GENERAL DEFINITIONS' 1. -Where used in this contract: a. Authority - shall mean the Canadian River Municipal Water Authority, an authority duly created and. existing under the laws of the State of'Texas, acting through its representatives duly authorized by its Board of Directors. b. Cooperative - shall mean the South Plains Electric' Cooperative, Inc.-, a cooperative duly organized, created, and existing under and by virtue of the laws of the State .of Texas, and authorized to do business in. the. Repayment Contract - shall mean Contract No. 14-06-500-485, dated November 28, 1960, between the United States Department.of the Interior, Bureau of Reclamation, and the Canadian River. It is agreed that -the -Authority shall, -become a member of the Cooperative; provided, .however, it is understood .and agreed that the Authority assumes no duty or liability by virtue. of such membership, and such membership shall in nowise affect or alter the terms of `this agreement -regardless of the present or future provisions of the charter, bylaws, or any action of the Cooperative. The Cooperative, undo -r the terms and.conditions stipu- lated herein, will furnish electric service to the Authority, from and after the date of initial service as defined in Section (b),of Article 13, at the following points, hereinatte+r referred to as points of delivery: (1) Pumping Flamt No. 6 located near'Lubbock at the beginning of thc- Southwest Aqueduct. (2) Pumping Plant No. 9 located approximately 3 miles west of Lubbock, Texas, and vicinity of Southwest Aqueduct Station 599+00. (3) Pumping Plant No. 10 located approximately it miles west of Lubbock,•Texas, and vicinity of Southwest Aqueduct Station 1098+00. b. Electric power and energy furnished hereunder will be delivered to the /kuthority as three-phase alternating current, at a nominal frequency of sixty (60) cycles per second and at a`nominal delivery voltage of 480 volts and will be measured at the points of delivery established in Section a hereof. The Cooperative will furnish all transmission, trans- , formation, and delivery facilities necessary to effect dr-livery of electric power and energy, as provided hereunder, to the point at which the 480-volt circuit of the Authority attaches to the 480-volt circuit of the Cooperative at each of the points of delivery established in Section (a) of this article. 'SCHEDULE OF BATES 4. a. The Authority shall pay for electric service furnished by the Cooperative hereunder in accordance with the charges and conditions set out in South Plains Electric Cooperative's Schedule IC-CRA, attached hereto and made a part hereof. b. The Authority agrees that if, at any time, the rate under which the Cooperative purchases electric energy at wholesale is modified, the Cooperative may make a corresponding modification .in the rate for service hereunder. The Authority shall operate and maintain the Project facilities in a manner which will not interfere with the. Cooperative's ability to meet its obligations under this contract or its ability to provide electric service to other Cooperative customers; Provided, That upon notice given as far in advance as possible, the Authority shall have the right to shut down any or all of the Project facilities for routine or emergency maintenance as required. LICENSE TO THE COOPERATIVE S. The Authority hereby grants the Cooperative a license to operate, maintain, repair, and replace all of its constructed facilities located within the plant site for each of Pumping Plants Nos. 8, 9, and 10, including necessary rights of ingress and "gress for exercising said license. Said license and rights of irgrf•s� and egress shall remain in effect during the term of this contract and any i-ontinuation . thereof, and shall expire coincidentally with the expiration. of said -contract. All Cooperative • facilities shall be and rr:main the property of the Cooperative notwith- standing that the.sam« may have been affixed -to the premise�s,'and the Cooperative shall have a reasonable time after the expiration of said license within which to remo;rn said facilities. CONTINUITY OF ELEC—IRIC SERVICE TO BE FURNISHED 9.- The electric service, :except as otherwise specified herein, will by furnished continuousiy.except (1) for interruptions or reductions due to uncontrollable forces, as defined herein, (2) for interruptions or reductions due to operation o: devices installed for power system protection; and (3) for temporary interruptions or reductions, which, in the opinion of the Cooperative, .are necessary "or desirable for the purposes of maintenance., repairs, replacements, installation of equipment, or in7estigations and inspection.. The Cooperative. except in case e,f emergency as determined by the Cooperative, will give the Authority'r-asonable advance notice of such temporary interruptions or reductions and will remove the cause thereof with diligence. Whenever an emergency occurs, the Cooperative will promptly thereafter notify the Authority of its nature with an estimate of the duration of the resulting interruption or reduction in service. UNCONTROLLABLE FORCES 10. Neither party shall be. considered to be in default in respect to any obligation hereunder, if prevented from fulfilling such obligation by reason of uncontrollable forces, the term uncontrollable forces being deemed for the purpose of this contract to mean any cause.beyond the control of the party affected,•including, but not limited to fallure. of facilities, flood, earthquake, storm, lightning, fire, -epidemic, war., riot, civil disturbance,' - -4 -,, Pusuc unu m OF texas pm 22 M • .482$ �....... ..... _.... air _...............,. . '(AMFF cLEIRK -labor disturbance including strikes, sabotage, and restraint by court or public authority, which by exercise of due diligence and foresight, such party could not reasonably have been expected to avoid. Either party rendered unable to fulfill any obligation by reason of uncontrollable forces shall exercise due diligence to remove such inability with all reasonable dispatch. METERING The total electric power and energy delivered to the Authority will be measured by metering equipment to be furnished and main- tained by the Cooperative. Meters shall be sealed and the seals shall be broken only upon occasions when the meters are to be inspected, tested, or adjusted, and representatives of the Authority shall be afforded -reasonable opportunity to be present upon such occasions. Metering equipment shall be _inspected and/or tested at least once each year by the Cooperative -and at any reasonable time upon request therefor by either party. Any metering equipment found to be defective or inaccurate shall be repaired or readjusted or replaced. Should any meter fail to register, the electric power and energy actually delivered to Authority. during such period of failure to register shall, for billing purposes, be estimated by the Cooperative from the best information available, with Authority prior to billing, afforded reasonable notice and opportunity to seek adjustments where such may appear justified by it. b. If any of the inspections and/or tests provided .for herein disclose an error exceeding 'two percent (2%), correction based upon the inaccuracy found shall be made of the records of electric 'service furnished since the beginning of the monthly billing period immediately preceding the billing period during which the test was made; Provided. That, no correction shall be made for .a longer period than such inaccuracy may be determined by the parties to have existed. Any correction in billing resulting from such correction in meter records shall be made in the next monthly bill rendered by the Cooperative to the Authority, and such correc- tion vhen•made shall constitute full adjustment of any claim between the parties hereto arising out'of such inaccuracy of metering equipment. PRIOR APPROVAL 12. a. This contract or any agreements or understandings affecting this contract or the Project facilities shall not be binding upon the Authority until approved by the United States. b. This agreement shall not be binding upon the parties until -approved by the Administrator of the Rural Electrification Administration. PUBLIC UTILITY COMMISSION OF TEXAS `. This contract shall become eftective upon its execution and approval by the United States and shall remain in effect to January 1, 1985, and thereafter, until terminated by written notice of termination given -by either party to the other at least one year in advance of the effective date thereof. b. The date of initial service hereunder is defined -as the date upon Which the Authority assumes responsibility under the terms of the repayment contract for the care, operation, and maintenance of the Project; Provided, That, the Authority shall have given written notice to the Cooperative thirty (30) days in advance of the date on which the Authority will be ready to receive said electric service.. NONDISCRIMINATION IN EMPIAyNXNT 14. In connection with the performance of work under this contract, the parties agree not to discriminate against any employee or applicant.for employment because of race, religion, color, or national origin. The aforesaid provision shall include, but not be limited to, the following: employmcnt, upgrading, demotion or transfer; recruitment or recruitment advertising, * layoff or termination; rates of -pay or other forms of compensation; and selection for training, including apprentice- ship. Power Factor Adjustment The consumer agrees to maintain unity power factor as nearly as practicable. Demand charges will be adjusted to correct for average power factors lower than eighty-five percent (85%). if and when the Cooperative deems necessary. Such adjust- ments will be made by increasing the measured demand one percent (i%) for each one percent (1%) by which the average power factor is less than eighty-five percent (85%) lagging. Minimum Annual Charge The minimum annual charge shall be $3,500 or $12.00 per kilowatt of maximum monthly billing demand incurred within a calendar year. whichever is less, but not including any applicable billing adjustments provided for under Tariff Section 20.01. KWH Use For the purpose of adjustments as provided for herein, the estimated energy use per month per lighting unit shall be com- puted at 77 KWH for 6,000 lumens and at 103 KWH for 12.000 lumens. Conditions of Service 1. The Cooperative shall furnish, install. operate, and maintain the outdoor lighting equipment including lamp, luminaire. bracket attachment and control device on an existing wooden pole of the Cooperative, when one is readily available. electrically connected so that the power for operation of light does not pass through the meter for the consumer's other usage, at a location mutually agreeable to both the Cooperative and the consumer. The Cooperative shall furnish and install a wooden pole if required for the outdoor light. within 150 feet of existing secondary circuits. 2. The Cooperative shall maintain the lighting equipment. including lamp replacement. at no additional cost to the con- sumer within 72 hours after the consumer notifies the Cooperative of the need for maintenance of the lighting equipment. 3. The lighting equipment shall remain the property of the Cooperative. The consumer shall protect the lighting equipment from deliberate damage 4. The consumer shall allow authorized representatives of the Cooperative to enter upon the consumer's premises and to trim trees and shrubs as necessary for maintenance of the lighting equipment and for removal of the lighting equip- . ment upon termination of service under this schedule. 5. The Cooperative and the consumer may execute an agreement for service under this schedule for a period of not less than one (1) year. 6. Should a citytom, or village designate use of metal standards, then the added average cost in place of such units above the average installed cost of a thirty-foot (30') wooden pole will be paid by the consumer. Total control - the Cooperative may control the operation of the irrigation pump(s) at any time. but not to exceed: a. 12 hours in any daily 24-hour period; b. 42 hours in any consecutive seven-day period; c. 120 hours in any consecutive 30 -day period. 2. Limited days per week control - the consumer shall choose the number of days of control. up to three. and the Coopera- tive may interrupt the operation of the irrigation pump(s) as predetermined and scheduled by the Cooperative for the growing season, but not to exceed 12 hours in any daily 24-hour period. The Cooperative reserves the right to make periodic reassignment of the day(s) of control. Any notice of reassignment of control day(s) shall be made in writing. Control Equipment on Members' Premises For the control equipment required at the irrigation pump meter. the member will pay to the Cooperative a non-refundable fee to defray the control equipment cost. The power supply for the control equipment will be obtained from the member's metered power serving the pump motor. Any interference by the member to the control equipment shallresult in the demand charge being billed as though no control was being implemented. Determination of Horsepower The horsepower for billing purposes shall be the motor manufacturer's nameplate rating of horsepower output, except that. if the Cooperative so elects, it shall be determined by actual measurements of power input during a period of maximum nor=mal use. less an allowance of ten percent (i0%) of input for motor losses. Annual Minimum Charge The annual minimum; charge under the above rate shall be $10 per horsepower of connected load but not less than $100. Terms of Payment Should the total of all monthly* billings in a calendar year be less than the annual minimum charge, the consumer, will, at the end of the year. pay the difference between the total billings exclusive of billing adjustments under Tariff Section 20.01. and the annual minimum charge specified herein. The Cooperative shall maintain a current set of maps showing the physical locations of its facilities. All facilities shall be labeled to indicate the size, nominal eapacity and valtage. or any pert inent'information which will accurately describe the Cooperative's facilities. These maps, or such other maps as may be required by the Commission shall be kept in the Cooperative's office and will be available for the Commission inspection during normal working hours. The Cooperative shall have available at its office, maps, plans, or records of its immediate area, with such other information as may be necessary to enable the Cooperative to advise applicants, and others entitled to the information, as to the facilities available for serving that locality; 2. The Cooperative shall assist the consumer or applicant in selecting the most economical rate schedule; 3. In compliance with the Commission's Rules of Practice and Procedure, the Cooperative shall notify consumers affected by a change in rates or schedule of classification; 4. The Cooperative shall post a notice in a conspicuous place in its business office where appli- cations'for service are received, informing the public that copies of its rate schedules and rules relating to the service of the Cooperative, as filed with the Commission, are available for inspection,, 5. The Cooperative shall, upon request, inform its consumers as to the methods of reading meters. B. Consumer complaints 1. Upon complaint to the. It shall keep a record of all complaints which shall show the name and �. address of the complainants- the date and nature of the complaint and the adjustment or dispcsi- tion thereof for a period of two years subsequesnt to the final settlement of the complaint. Complaints with reference to rates or chargis which require no further action by the Coopera- tive will not be recorded. 2. In the event the consumer is dissatisfied with the Cooperative's report. the Cooperative will advise such consumer of the Public Utility Commission complaint process. C. Cooperative's Response Upon receipt of a complaint, either by letter or by telephone, from the -Commission on behalf of a consumer, the Cooperative shall make a suitable- investigation and advise the Commission of the results thereof. Initial response to the Commission rill be made within thirty (30) days. D. Deferred Payment Plans The Cooperative may make available to its consumers a deferred payment plan when failure to pay Is due to an emergency or other reasonable inability to pay and a short extension of time to pay will prevent disconnect of service and further, when deposits are required under these rules, either upon application for service or because of unsatisfactory payment history. Oral Deferred Payment ARreemetit' ; Deferral of payment of up to seven (T) calendar days may be made by oral agreement by tele- phone or personal contact but will be reduced to written memorandum form for the Cooperative's records giving date made, agreed amount of the delinquent bill, end date for payment and name of employee making the agreement with the consumer. Written Deferred Payment Agreement Deferral of payment of up to thirty (30) calendar days for the delinquent amount of electric bills or up to sixty (60) calendar days for the payment of deposits as required under these rules may be made by written agreement between the Cooperative and the consumer. Such written agreement will include the following provisions: a. Immediately preceding the space provided for the consumer's signature will be printed in bold -face print at least two sizes larger than any other thereon, "If you are not satis- fied with this agreement, do not sign. If you sign this agreement, you give up your right to dispute the amount due under the agreement except for the Cooperative's failure or refusal to comply with the terms of this agreement". b. A five percent (5f) interest charge•on the amount covered by the agreement. 3. Violation of Agreement If a consumer has not fulfilled terms of a deferred payment agreement, written or oral, the Cooperative shall have the right to disconnect service pursuant to disconnection rules hirein and under such circumstances, it shall not be required to offer subsequent negotiations of -. a deferred payment agreement prior to disconnection of service. • In the event that a payment is made under a deferred payment agreement by an invalid check from the consumer that a depository refuses to honor for payment,- then the agreement will be considered broken by the consumer and the Cooperative may disconnect service without further notice to the'consumer. 4. Disconnection of Service 1. A consumer's electric service may be disconnected if.the invoice for electric service has not been paid or a deferred payment agreement entered into within twenty-five (25) days from the date of issuance and if proper notice has been given. Proper notice shall consist of a separate mailingor hand delivery at seven (7) days prior to a stated date of disconnection. The cutoff date may not fall on a holiday or weekend. 2. Electric service may be disconnected.for any of the following reasons: a. Failure to pay a delinquent account or failure to comply with the terms of a deferred payment agreement; b. Violation of the Cooperative's rules pertaining to the use of service in a manner which interferes with the service of others or the operation of nonstandard equipment. -if a reasonable attempt has been made to notify the consumer and the consumer is provided with a reasonable opportunity to remedy the situation; c. Failure to comply with deposit or guarantee arrangements where required by Section 30.04 of these rules; d. Without notice where a known dangerous condition exists for as long as the condition exists; and e. Tampering with the Cooperative's meter or equipment or bypassing the same. 3. Electric service may not be disconnected for any of the following reasons: a. Delinquency in payment for service by a previous occupant of the premises; b. Failure to pay. for merchandise, or charges for non -electric service provided by the Cooperative; e. Failure to pay fora different type or class of utility service unless fee for such service is included on the same invoice; d. Failure to pay the account of another consumer as guarantor thereof, unless the Cooperative has in writing the guarantee as a condition precedent to service; e. Failure to pay charges arising from an underbilling occurring due*to arty alisappiication of rates more than six months prior to the -current billing;: f. Failure to pay charges arising from an underbilling due to.any faulty metering, unless the meter has been tampered with or unless such underbilling charges. are due under Section 50.01-E of these rules. g. Failure to pay an estimated bill other than a bial rendered pursuant to the Cooperative's meter reading plan, unless the Cooperative is unable to read the meter due to circumstances beyond its control. 4. Unless a dangerous condition exists, or unless the consumer. requests disconnection, service shall not be dis- connected on a day, or on a day immediately preceding a day, when personnel of the Cooperative are not available to the public for the purpose of making collections and reconnecting service. 5. The Cooperative will not abandon a consumer ora certified service area without written notice to its con- sumers therein and all similar neighboring electric utilities, and approval from the Commission. D. Disconnection for Payment by Invalid Check Electric service may be disconnected in the event a consumer tenders a check to the Cooperative in paymentof a C bill for.service and the Bank refuses payment for any reason and such check is not otherwise redeemed by the consumer by the.date for disconnection as provided in these rules. or subject to'seven (7) days written notice. whichever date being the later, provided however. that in event the consumer tenders to the Cooperative an invalid check on, or after the disconnect date to evade disconnection of:service, service may be disconnected without further notice of any kind. Application for Service - New Consumers The following rules will be applied upon receiving applications for service from persons not presently a consumer T receiving service from the Cooperative: 1. Establishment of Credit for Pirmanent Residential Applicants a. The Cooperative rill require a residential applicant for service to satisfactorily establish credit. but such establishment. of credit shall not relieve the consumer from complying with roles for prompt payment of bills. Credit history shall be applied for a reasonable period of time to a spouse or former spouse who shared the service. Credit history maintained by one must be applied equally to the other without modification and without additional qualifications not required of the other. Subject to these rules, a residential applicant shall not be required to pry a deposit: 1. If the residential applicant has been a consumer of any electric utility within the last two rears and is not delinquent in payment of any such utility service account and during the last twelve (12) consecutive months of service did.not have more than one occasion in which a bill for such utility service was paid after becoming delinquent and never had service disconnected for nonpayment; or 2. If the residential applicant furnishes in writing a satisfactory guarantee to secure payment of bills for the service required; or 3. If the residential applicant demonstrates a satisfactory credit rating by appropriate means including, but not limited to, the production of generally acceptable credit cards, letters of credit reference. the names of credit references which may be quickly and inexpensively contacted by the Cooperative. or ownership of substantial equity. 2. Reestablishment of Credit ; Every applicant who previously has been a consumer of. the Cooperative and whose service has been discontinued for nonpayment of bills shall be required before service is- rendered to pay all amounts due the Cooperative or execute a deferred payment agreement, if offered, and reestablish credit as provided in subparagraph la above. 3. Commercial and Industrial Service In the case of commercial, or industrial service, if the credit of an applicant for service has not been established- satisfactorily to the Cooperative. the applicant will be required to make a deposit under the same requirements as for permanent residential applicants for service. 4. Amount of Deposit and Interest for Permanent. Residential. General Service. Comnercial and Industrial Service C and Exemption from Deposit a. The required deposit shall not exceed an amount equivalent to one-sixth (1/6) of the estimated annual billings. If actual use is at least.twice the amount of the estimated billings. a new deposit require- ment may be ealciulated and an additional deposit may be required to be made within ten days, subject to written notice from the Cooperative. If such additional deposit is not made, the Cooperative may dis- connect service under the standard -disconnection procedure. b. All applicants for permanent residential service who are sixty-five (65) years of age or older will be considered as having established credit if such applicant does not have an outstanding account balance with the Cooperative or another electric utility which accrued within the last two years. No cash deposit shall be required of such applicant under these conditions. Rendering and For' of Bills Bills for electric service shall be rendered monthly unless service is rendered for a period less than a month. Bilis shail be rendered as promptly as possible following the reading of meters. An invoice -type bill trill be used and rendered to each consumer detailing thereon individual amounts of electric use and charges for service to all separately metered points of delivery to the consumer. plus unmetered points of delivery as provided for under the rate schedules. and combining for all services to a total amount due the Cooperative. ,In event a partial payment is made, it will be credited to the total amount due and not to each separate account. Any amount left owing will be deemed to be due against.all separate accounts. When reference is made in the Cooperative's Tariff to 'bill' or *invoice," they rill have the same meaning. B. Information on Bill The consumer's invoice will show at least ail information as required by the Commission. C. Estimated Meter Readings As a standard practice. the Cooperative will provide adequate personnel and transportation equipment to read all meters monthly. Recognizing that there may be occasions when some meters..principally for irrigation service. cannot be read because of inclement weather and adverse rural road and accessway conditions, readings may be estimated for billing purposes.- In such event, special. effort will be given to read each such meter in the following cycle in regular order, or by special reading order. In.no event will readings be estimated for any given meter more than three (3) consecutive months. When estimated readings are used for billing purposes. the bill will be plainly marked to show that the meter reading was estimated. _ D. Disputed Bills In the event of a dispute between the consumer and the Cooperative regarding any bill, the Cooperative shall forthwith make such investigation as shalt be required by the particular case and report the results thereof to ." the consumer. and in the event the dispute is not resolved. shall inform the consumer of the•:cciaplaint procures of the Commission. E. Reconnect and Collection Fees It is intended that written notice to the consumer of delinquent bills and returned invalid checks giving date . after which service will be disconnected for nonpayment, constitute all appropriate and necessary notification needed to be given by the Cooperative.. It is further intended that no personal contact by way of a collection call or telephone solicitation will be required prerequisite to disconnection of service for nonpayment. If. however. the consumer or. his representative is found at.the premises of the service, or services, to be dis- connected when the Cooperative's representative arrives to disconnect service. and if the consumer or his representative will pay the amount delinquent plus a SIS service charge. plus the amount of deposit as required C under Section 30.04-A of this tariff. then service will be left connected. An oral deferred payment agreement as provided for -under Section 30.01-D-1 of this. tariff may be extended for the required deposit but not beyond seven (7) days. Extensions beyond seven (7) days will not -be given -except by written agreement between the Cooperative and the consumer. If service is disconnected for nonpayment, a charge of twenty-five dollars (;25) per meter disconnected plus C the delinquent amount plus a deposit as may be required under Section 30.04-A of this tariff will be collected before service is reconnected during regular hours. .Reconnection of service after normal business hours shall C require the above said delinquent amounts and deposit plus a fee of $25 per meter for reconnection. Payment of the deposit, if required, may be deferred when circumstances will justify by the consumer executing a written deferred payment agreement as provided for under Section 3D.01 -D-2 of this tariff. F. Fradulent Use of Electric Service 1. No person, except an employee of the Cooperative. shall remove, alter, or make any connection to the Cooperative's meter or service equipment. No meter seal may be broken by anyone other than a Cooperative employee, provided. however, the Cooperative may give prior consent to an approved electrician employed by a member to remove seal when deemed necessary by the Cooperative. 2. In case of tampering with the Cooperative's meter or equipment or bypassing the same or interfering with the proper working thereof. or any other theft of electric service by any person. or evidence of aqy such tampering. interfering. including reporting incorrect meter readings with intent to defraud, the service shall be immediately disconnected after proper notification. Membership and Electric Service Agreement The undersigned (hereinafter called the "Applicant') hereby applies for membership in, and agrees to purchase electric energy from SOUTH l PLAINS ELECTRIC COOPERATIVE, INC. (hereinafter called the "CooperatiVe") upon the following terms and conditions: 1. The Applicant will pay to the Cooperative the sum of Five (5.00) Dollars, which if this application is accepted by the Cooperative, will constitute the Applicant's membership fee. 2. The location of each point of delivery. together with the description of use of electric service to be made hereunder by the Appli- cant at each such point of delivery. is shown on EXHIBIT A of this application. Additional points of delivery or changes in character of service. or use, may be mutually agreed to from time to time under the terms and conditions of this agreement. 3. If the Cooperative can furnish electric service to the Applicant at -none of the points of delivery contemplated by this Application and shown to EXHIBIT A hereof. and if there be no other points of delivery contemplated to be served under this agreement or if this Application for Membership is not accepted by the Board of Directors of the Cooperative. the $5.00 membership fee will be re- turned to the Applicant. 4, The Applicant will. when electric energy becomes available and the meter or meters installed. purchase from the Cooperative all electric energy used at each point of delivery specified in EXHIBIT A hereof, and will pay therefor monthly at rates which will be fixed by the Board of Directors of the Cooperative. Further, with respect to each such point of delivery, and from the date electric energy becomes available thereto, the Applicant will pay a minimum amount as specified in EXHIBIT A. or in lieu thereof, the minimum amount fixed by the rate schedule applicable to the classification of service at each such point of delivery should the rate schedule designated minimum be larger than that shown in EXHIBIT A hereof. The Applicant will cause his premises at each point of delivery designated in EXHIBIT A hereof to be wired in accordance with wiring specifications as established by the National Electric Safety Code and as accepted by the Cooperative. 6. The Applicant will comply with and be bound by the provisions of the Charter. Tariff. and By -taws of this Cooperative of which he will be a member, and such rules and regulations as may. from time to time. be adopted by the Cooperative, as established by the Public Utility Commission of Texas. 7. The Cooperative shall use reasonable diligence to provide a constant and uninterrupted supply of electric power and energy here- under. If the supply of electric power and energy shall fail or be interrupted. or became defective through act of God, govern- mental authority. action of the elements, public enemy. accident. strikes. labor trouble. required maintenance work. inability to- secure osecure right-of-way, or any other cause beyond the reasonable control of the Cooperative. the Cooperative shall not be liable therefor or for damages caused thereby. y;.. 9. Standards for,Sealing Devices Toward protection of the integrity of registration.of watt-hour meters and of the total metering installation, the following sealing requirements will be followed. 1. Inside Seal Immediately after test as required under this Tariff, a compression type seal will be used connecting the meter cover to the meter frame to insure the integrity of the test, and to provide visible indication as to the possibility of meter tampering. For identification purposes this device is referred to as the •inside seal.* A separately numbered sealing tool will be issued to each technician authorized to perform meter tests.- The sealing tool will be of such design that the tool number will emboss on one side and OSP' on the opposite side of the seal. .Before a meter is installed. or replaced in service, it will be ascertained that a valid inside seal is.in place. 2. Outside Seal When any meter is installed in the meter loop, a seal or locking device will be installed in such a manner as to prevent tval of the meter. -or the meter cover, without either breaking or unlocking the sealing device. For identification purposes this device is referred to as the 'outside seal• and may be in the form of (a) prenumbered stirrup type seal that destructs upon removal; (b) a padlock; or (c) a patented T tamper-resistant. sealing mechanism. If no irregularity_. is detected. the consumer will be .given written notification of the need for the outside seal to remain in place to insure theAutegrity of the metering installation and to give warning of the dangers of the meter being removed by an unauthorized person. Should the outside seal on a consumer's metering installation be found to be missing. broken. or otherwise altered, and should no metering installation irregularity be other- T wise detected, a tamper-resistant type sealing device may be installed and the consumer billed for the cost of inspection and the cost of the device. If it is established that the metering installation has been tampered with for the purpose of fraudulent use of electric service. and that such act, or acts. have occurred during. the period of service of -the present. consumer. a tamper-resistant sealing device may be installed. Services on Outside Wiring System It is recognized that many outages result from inadequate and poorly maintained consumer systems beyond the point of delivery.* It is further recognized that a major cause of this problem is lack of qualified electricians willing to perform repair services throughout the Cooperative's service area. School Appliance Program Electric ranges may be supplied -to high schools served by the Cooperative for use in their homemaking department and toward promoting the efficient and effective use of such equipment. The following guidelines will apply: . 1. AAreem�ent - The Cooperative will enter into a five-year agreement with the Board of Trustees of each pa cipating school before the equipment is installed. 2. Equipment - Two. free-standing, electric ranges will be supplied by the Cooperative. 3. Miring - To be eligible to participate in this program. a school must install any additional wiring necessary to accamnadate the ranges. 4. Replacement - The ranges will be replaced with current models each summer provided the used ranges can be sold. S. Maintenance - The school must agree to take reasonable care of and maintain all ranges placed in the school. • B. Load Factor Improvement The Cooperative's need for annual load factor improvement is unique because of ..the extreme demand of irrigation C load during the sumer growing season which also includes air conditioning load. To improve this condition, the Cooperative may offer incentives to facilitate load management activities. installation of energy-efficient motors or air conditioning units and circulating fans, and other programs that would be suitable in improving said load factor. '9. Eliminate Conditions Preventing Interconnection In the event that it comes to the attention of the Cooperative that there are Conditions preventing safe inter- connection and proper parallel operation. it shall notify Producer and Producer shall not interconnect and/or initiate parallel operation until such conditions are corrected and Producer has provided at least ten (10) days wPttten notice to the Cooperative. The foregoing are conditions precedent to any obligation of.the Cooperative to interconnect or provide any form of electric utility service. C. Parallel Operation 1. Installation With the exception of only the Cooperative's meter(s). the Producer shall own and be solely responsible for all ex- pense. installation. maintenance and operation of the power generating installation at and beyond the point where Producer's conductors contact. Cooperative's conductors.. The Producer's generating installation shall be designed and installed in accordance with applicable codes, regulations and prudent engineering practice. 2. Self -Protected Generating Installation The Producer will "furnish, install. operate and maintain in good order and repair all equipment necessary for the safe operation of the power generating installation in parallel with the Cooperative's electric distribution system. The equipment will have the capability to both establish and maintain synchronism with the Cooperative's system and to automatically disconnect and isolate the generating installation from the Cooperative's system in the event of an outage of the Cooperative's system or a malfunction of the power generating installation. The Producer's power generating installation will also be designed, installed and maintained to be self -protected from normal and abnormal conditions in the Cooperative's electric distribution system. The conditions for which. the power generating installation shall be self -protected shall -include. but not be limited to, overvoltage. under - voltage. overcurrent. frequency deviation. and faults. The self-protection will be compatible with the Cooperative's system protection arrangements and operating policies. Specialized protective functions may be required by the Cooperative when. in the sole judgment of the Cooperative. the particular -generating installation characteristics and/or distribution system characteristics so warrant. 3. Quality of Service Producer's generating installation will generate power at the nominal voltage of the Cooperative's electric distri- bution system at the Producer's delivery point plus or minus five percent (5%) at the nominal system frequency of 60 hz plus or minus one-half (Si) bz..Producer shall generate at a power factor that is as near one hundred percent (100%) as is practicable. .In the event that the power factor. is less than ninetypercent (9O%) lagging or (10%) of or reimburse leading. the Producer will provide proper power factor correction (within ten percent unity) the Cooperative for the cost of any necessary correction. The overall quality of'the power provided by Producer including. but not limited to. the effects of harmonic dis- tortion, voltage regulation. voltage flicker. switching surges and power factor. will be such that the Cooperative's electric distribution system is not adversely affected. in any manner. In the event that adverse effects are caused in whole or in part by Producer's power generating installation, the Producer will Correct the cause of such effects or reimburse the Cooperative for the cost of any required correction. 4. Safety Disconnect The Producer, or at the Producer's option. the Cooperative. shall provide and install, at the Producer's expense. disconnect switch. The disconnect will be located so as to be readily accessible to a visible break -switch Cooperative. personnel in a location acceptable to both.the Producer and the Cooperative. It shall be the type of switch which can be secured in an open position by a Cooperative padlock. The Cooperative shall have the right to lock the switch open whenever. in the judgment of.the Cooperative: (l) it is necessary to maintain safe electrical operating or maintenance conditions; (2) the Producer's power generating installation adversely affects the Cooperative's electric distribution system; or (3) thereAs a system emergency or other abnormal operating condition which warrants disconnection. The Cooperative reserves. the right to operate the disconnect for the protection of the Cooperative's system even -if it affects Producer's power generating installation. In the event the Cooperative opens and closes the dis- connect switch it shall not be responsible for energization or restoration of parallel operation of the generating installation. The Cooperative will make reasonable efforts to notify the Producer in the event the disconnect switch has been operated. The Producer will not bypass the disconnect switch at any time for any reason. S. -Access Persons authorized by the Cooperative will have the right to enter the Producer's property for the purpose of operating or inspecting the disconnect switch or metering. Modifications of Cooperative System In the event that it is necessary at the time of initial interconnection or at some future time for the Cooperative to modify its electric distribution system in order to purchase or -continue to purchase Producer's output. the Pro- ducer will reimburse the Operative for all just and reasonable costs of modifications which are allocable to the Producer's small power generating installation. The modifications may include. but are not limited to. special intercormection equipment. protective devices, control devices or upgrading of distribution system components. 7. Liability far Injury and Damages Producer. assumes full responsibility for electric energy furnished to him at and past the point of interconnection and will indemnify the Cooperative against and hold the Cooperative harmless from all claims for both injuries to persons, including death resulting therefrom. and damages to property occurring upon the premises owned or operated by Producer arising frau electric power and energy delivered by Cooperative or in any way arising directly or in- directly from Producer's generating installation except: (1) when the negligence of .Cooperative or its agent or agents was the soleproximate cause of injuries, including death therefrom. to Producer or to employees of Producer or in the case of a residential Member/Producer, to all members of the household; and (ii) as to all other injuries and damages, to the extent that injuries or damages are proximately caused by or result in whole or in part from (a) arty negligence of Cooperative or its agent(sj independent of -and unrelated to the maintenance of Cooperative's facilities or any condition on Producer's premises or b) the breach by Operative of any provision of any con- tract regarding purchase and/or sale of electrical energy or service between Cooperative and Producer. The Cooperative shall not be.liable for either direct or consequential damages resulting from failures. inter- ruptions, or voltage and wave form fluctuations occasioned.by causes reasonable beyond the control of the Cooperative. including, but not limited to, acts of.God or public enemy. sabotage and/or vandalism, accidents, fire, explosion labor troubles. strikes. order of any court or judge granted -in any bona fide adverse legal proceeding or action, or any order of any commission, tribunal or governmental. authority. having jurisdiction. 1 For claims resulting from failures, interruptions, or voltage and ware form fluctuations occasioned in whole or in part by the negligence of the Cooperative or its agent(s), the Cooperative shall be liable only for that portion of the damages arising from personal injury. death of persons. or costs of necessary repairs to or reasonable replace- ment of electrical equipment proximately caused by.the negligent acts of the Cooperative or its agent(s). The Cooperative shall root be liable in any event for. consequential damages. 8. Metering If the output of the Producer's generating installation is to be purchased by the Cooperative. it will be measured by meters as required for the metering option chosen by the Producer. Any necessary meter(s) or meter modification in addition to one standard service meter will be installed, maintained and operated by the Cooperative at the producer's expense.. A connection will be provided for the meter(s) at the Producer's expense in a location that is acceptable to both the Cooperative and the Producer. The Cooperative may. at its ohm expense, supply. install. and maintain load research metering for the purpose of monitoring and evaluating the Producer's generating installation. The metered output of Producer's generating installation will be read by the Producer and. at the election of the Cooperative, accumulated or monthly readings may be checked at least monthly by representatives of the Cooperative. The ameter(s) will, by comparison with accurate standards, be tested and calibrated as often as necessary. The Pro- ducer or the Cooperative may reasonably request such tests. and shall be given notice of not less than five (5) working days when such tests are to be made. Uth.the Producer and the -Cooperative will have the right to be present at such tests. _If a meter is found to be inaccurate, it shall be restored to an accurate condition or replaced. If the tests disclose that no unacceptable inaccuracies exist in the meter(s), then the party requesting the tests shall bear the expense of the tests. A report of the results of any tests shall be furnished promptly by the party making such tests to the other party. Any meter(s) registering a deviation of not more than two per- cent (2Z) from normal shall be deemed accurate. The readings of any meter(s) which have been inaccurate shall be corrected according to the percentage of inaccuracy as determined by the tests for a period of no more than ninety (90) days prior to the tests. If any meter fails to register for any period. the facility output during such period shall be estimated.in the best manner possible as agreed upon by the Cooperative and the Producer. 4. Notice of Change in Installation - Producer -wilt notify the Cooperative in writing fifteen (15) days in advance of making any change affecting the characteristics. performance. or protection of the generating installation. If it comes to the Cooperative's attention that the modification will create or has -created conditions which may be unsafe or adversely affect the -Cooperative's system then At shall notify Producer and -Producer shall Immediately correct such condition. 10. Rate Application Hearing Dear Mayor McAlister: On November 11, 1983, South.Plains Electric Cooperative, Inc. (SPEC) filed its Notice of Intent to Increase Electric'Rates and rate filing package with the City Secretary. It was the intent of SPEC to increase its rates to its members only after final approval of the regulatory authorities as provided by the Public Utility Regulatory Act (Art. 1446c, Vernon's Anno- tated Texas Statues). The Public Utility Commission of Texas on March 74, 1983 entered its final order approving the rate increase for SPEC. The final order granted SPEC a system -wide revenue increase of .$5,228,136 based on the test year, of which $4,817,296 is to roll the October 19, 1982 wholesale rate increase into its base rate and grants to SPEC an overall rate of return of 8.2%. It also resulted in an overall rate increase of 34.7% to its members. We further advise that 31.96% of the total, or $4,817,296, was placed into effect at the November 30, 1982 billing as a wholesale power increase through the Cooperative's use of the Power Cost Adjustment in its current tariff. Therefore, the May 30.billing will reflect an annual system -wide revenue increase of $410,840 over and above the recent Southwestern Public Service Company wholesale power increase. We enclose herewith a copy of the final order of the Public Utility Com- mission in Docket #4822 and the revised tariff sheets setting forth the approved tariff changes. It is requested that the City Council at its next meeting approve the same rate increase for the member consumers of SPEC located within the city limits of Lubbock. This would permit system -wide billing of all of South Plains' members under the same rate schedule. (Peat Marwick) determine if there were any cost differential for customers served by the South Plains Electric Cooperative, Inc. (SPEC) inside the city limits versus those outside Lubbock's city limits. This report summarizes the work performed in achieving the study objective, our findings and conclusions, and our recommendations. WORK PERFORMED In brief, our efforts to accomplish study objectives included: o Interviews and discussions with City (including Lubbock Power and Light personnel) and SPEC officials; o Review and analysis of the rate filing documents; o Review of documents associated with attaining certificates of convenience and necessity; o Review and analysis of selected SPEC records; and o Review of applicable law and case studies. Each of these is discussed in more detail below. We conducted interviews and held discussions with the following persons: o City of Lubbock - Jim Blagg, Deputy City Manager, - Robert Massengale, Assistant City Manager, - Personnel in the City Attorney's Office, and — Personnel from Lubbock Power and Light (LPL). Roberts, General Manager, - Wayne Whitaker, Assistant General Manager, Frank Kilcrease, Chief Engineer, - Carolyn Maples, Property Accountant, and - Dale Johnson, SPEC's attorney. We reviewed and analyzed documents and records, including: o Rate application documents filed by SPEC before the Texas Public Utility Commission (PUC) in docket 4822; o Staff testimony, examiners report, and final order of the PUC in docket 4822; o City and SPEC testimony pertaining to disputes on certi- fied services areas between SPEC and LPL in dockets 308, 917, 1722, and 2616; o PUC rules and regulations and the Public Utility Regula- tory Act of 1975 relating to differential rates for electric utilities; and o SPEC records including customer billing and consumption runs, facility maps, continuing property records, ad valorem tax renditions, and sales tax reports. The purpose of our interviews, discussions, reviews, and analysis were o Become familiar with the records and operations of the SPEC; o Explore areas where potential for cost differentials exists; o Document the type and amount of cost differentials; and o List areas where cost differentials exist but cannot be documented as to amount. Cunningham May 12, 1983 3 FINDINGS AND CONCLUSIONS Based on the work performed, we believe that the cost of SPEC to serve Lubbock citizens is generally less than the cost to serve their customers beyond the city limits of Lubbock. That lower cost is primarily the result of greater density of customers on the electric distribution system inside the City than outside and the centralized mode of SPEC operations also based within the Lubbock city limits. More detailed finding and conclusions are presented below. Cunningham May 12, 1983 4 The only rate category where inside customers comprise a significant portion is the Residential TO class at 74 percent of total system customers in that class. The largest portion of the residential service class is, however, in the "rural" category which is to be anticipated for an electric utility cooperative. Findings Regarding Preliminary Assessment of Cost Differentials A review of service conditions for irrigation and the commercial class customers inside Lubbock indicates no apparent significant differences between those same types of customers located outside of Lubbock. Cost differentials, if any, would appear to be nominal for these classes. For the residential customer class, there are several conditions which have an impact on service costs for inside versus outside customers. These include: o Distances between residential customers within Lubbock are less than that for customers outside the City resulting in less plant investment per customer inside the City; o Multiple residential customers are served from a single large transformer within the City while a residential consumer outside the City tends to be served by a single small transformer; o Planned transformer loads for inside City residential T&V users is generally less per customer than outside resi- dential users because of load diversity and other demand factors (e.g., use of individual water wells and the prevalence of all electric homes in rural areas); o All service crews are physically based within the City limits resulting in greater travel distances for service calls outside the City (applies to cost related to all customer classes); Fil Mr. Larry J. Cunningham May 12, 1983 5 o All meter -reading crews are physically based. within the City limits resulting in greater travel per meter read outside the City (applies to cost related to all customer classes); and o The condition of roads in rural areas, particularly during inclement weather, adds to the time required for service crews and meter readers to perform their duties (applies to cost related to all customer classes). Findings Regarding Costs Allocated to Residential Customers Class by PUC To determine the potential impact of reallocating costs assigned to the Residential Customer Class, we isolated those costs applicable to all residential customers. Cunningham May 12, 1983 6 Our efforts from this point focused primarily on the costs associated with the distribution function based on the premise that if there were any significant service costs differentials they would be related to that function. Findings Regarding Accuracy and Reliability of Study Results We believe that the study results are indicative of an order of magnitude rather than a precise measurement. Several factors limit the precision of this study: o SPEC operating and accounting records to provide data for studies of this nature were not available or limited at best; o Estimates and ratios had to be used to estimate costs; o No previous studies by service area determining detail system costs were available; and o The ability of SPEC officials to construct relevant data within a restricted time frame was not met. Findings Regarding Cost Differences Our study indicates that for the test year ended March 31, 1982, the estimatable cost to serve Residential T&V class consumers in Lubbock is approximately $0.50 per month less (about 2 percent of the billing excluding the fuel cost adjustment) for the average customer using about 650 RWH per month. It should be noted that this differential in annual revenues to SPEC is approximately equal to the franchise taxes that SPEC would pay to the City of Lubbock if a franchise tax were levied. r i PMN IMP Mr. Larry J. Cunningham May 12, 1983 ,.. 7 The cost differential estimated in this study is subject to change over time. Particularly, an increase in the number of connections to plant already constructed inside the City limits would result in lower inside per customer costs. Less than 50 percent of available plant at March 31, 1982, was con- nected inside the City limits. Conversely, a decrease in the number of connections would correspondingly result in increased unit costs. Findings of Allowable Rate Differentials The Texas Public Utility Regulatory Act of 1975 (Section 44) allows for a rate differential of 115 percent of the inside city electric rate without Commission approval. Any differences greater than 115 percent must be approved by the Commission. Other Findings As a part of our study, we noted the following items: o Net book cost of general plant located inside the City of Lubbock was in excess of ad valorem tax renditions; and o Two communities are assessing franchise taxes on SPEC revenues at the rate of two percent. Conclusions Based upon the work performed and the findings outlined above, we con- clude that: o The cost to serve inside City residential customers is. o percent less than the cost to serve outside City resi- dential customers as of the test year ended March 31, 1982; o These estimated cost differences are not considered sufficient to support a change in the rate structure currently requested by SPEC; rEal Mr. Larry J. Cunningham May 12, 1983 8 o The cost to serve in the future for the same inside/ outside parties could be significantly different depending largely on the location and patterns of population growth and the continuation of dual certified areas; and o The operating and accounting records of SPEC are not presently conducive to the performance of such detail cost studies. RECOMMENDATIONS Based upon our findings and conclusions, we recommend that the City of Lubbock: o Approve current rate schedules as submitted by SPEC; and o Adopt new and expanded procedures for rate application requests by SPEC for rate changes inside the City limits (see Attachment A for details). In order to perform an adequate. study the following information should be maintained and/or submitted to the City of Lubbock with the rate request. o Billing records should be kept to determine: - the number of customers by detail rate class (parti- cularly within the residential customer class), and - the KWH sales and demand characteristics by detail rate class; o A field inventory should be performed to determine the quantity and type of plant investment (which agrees to the continuing property records) located in the City of Lubbock, including: - poles by type, - transformers by type (KVA), - crossarms, - miles of line by type (phase and size), and - other distribution facilities; o Continuing property records should be updated to the end of the test period for each rate filing and provide such information along with rate request to City; o SPEC should provide a method to allocate meter reading costs and trouble call expense for inside versus outside customers considering travel and time differences; o Line losses should be determined for inside versus outside customers considering the greater length of lines serving customers in rural areas; and o Other data should be maintained as necessary to determine cost differentials between consumers located within Lubbock and outside Lubbock. I APPLICATION OF SOUTH PLAINS ELECTRIC COOPERATIVE, INC. FOR AUTHORITY TO CHANGE RATES DOCKET NO. 4822 ORDER PUBLIC UTILITY COMMISSION OF TEXAS In public meeting at its offices in Austin, Texas, the Public Utilitv Commission of Texas finds that the above styled application was processed in accordance with applicable statutes by an examiner who prepared and filed a report containing findings of fact and conclusions of law, which Examiner's Report is ADOPTED and made a part of this Order. The, Commission further issues that: 1. The application of South Plains Electric Cooperative, Inc. for a rate increase is GRANTED to the extent recommended by the examiner. 2. South Plains Electric Cooperative, Inc. shall file a revised tariff in accordance with the rates and guidelines set out in the Examiner's Report sufficient to generate revenues not greater than those prescribed in the report. South Plains Electric Cooperative, Inc. shall also revise and file amendments to its service rules and regulations in that revised tariff in accordance with the specific recommendations of the examiner regarding necessary changes to those rules. The revised tariff shall be filed in four copies with the Commission filing clerk within 20 days from the date of this Order. The Commission staff shall have 20 days from the date of the filing of the revised tariff to review it for approval or rejection. The tariff shall be deemed to be approved and shall become effective upon the expiration of 20 days after filing or sooner upon notification by the Commission.- In the event of rejection, South Plains Electric Cooperative, Inc. shall be notified by the Commission, and it shall have 20 additional days to file an amended tariff with the same procedures to then be repeated. 3. The revised and approved rates shall be charqed only for service rendered in areas over which this Commission was exercising its original jurisdiction as of the adjournment of the hearing'on the merits herein, and said rates may be charged only'for service rendered after the tariff approval date. Should the tariff approval date fall within South Plains Electric Cooperative, Inc.'s billing period, the cooperative is authorized herein to prorate each customer's bill to reflect that customer's daily energy consumption at the appropriate rates. Approval of the revised tariff filed in compliance with *this Order shall be deemed to be final on the date of its effectiveness either by operation of this Order or by notification by the Commission, which ever occurs first.
