j WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in
Lubbock County, Texas, has determined and does hereby determine that the public
needs, safety and welfare demand and create a public necessity for the acqui-
sition of additional land for municipal public uses and purposes, to -wit: for
Ian underground utility easement, and this City Council of said City finds it in
the public interest and for public purposes and municipal purposes to proceed
with the acquisition of lands as needed for such purposes as aforesaid; NOW
(THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described tracts
lof land, each of which is located in Lubbock County, Texas, be acquired for
Ipublic purposes and municipal purposes as set forth in the preamble hereof, to -
!wit:
TRACT ONE
A ten foot (10') strip of land out of Section 4, Block S, Lubbock County,
Texas, containing 0.1075 acre of land, more or less, and more particularly
described as follows:
BEGINNING at a point in the North line of Section 4 and 2066.14 feet South
89°18' West of the Northeast corner of Section 4.
THENCE South 0°40' East 20.00 feet to a point;
THENCE South 89°18' West 454.40 feet to the East line of the Panhandle and
Santa Fe Railroad Right-of-way;
THENCE North 39049' West 12.89 feet along the East line of Panhandle and
Santa Fe Railroad Right-of-way to a point;
THENCE North 89018' East 452.30 feet to a point;
THENCE North 0°40' West 10.00 feet to a point in the North line of Section
4. Said point being 2076.14 feet South 89°18' West in the Northeast
corner of Section 4.
THENCE North 89°18' East 10.00 feet along the North line of Section 4 to
the POINT OF BEGINNING.
TRACT TWO
A ten foot (10') strip of land out of Section 1, Block S, Lubbock County,
Texas, containing 0.09947 acre of land, more or less, and more particular
described as follows:
BEGINNING at a point in the South line of Section 1 and 2076.14 feet South
89°18' West of the Southeast corner of Section 1.
THENCE North 0040' West 433.33 feet to a point;
THENCE North 89°18' East 10.00 feet to a point;
THENCE 0°40' East 433.33 feet to a point in the South line of Section 1
and 2066.14 feet South 89°18' West of the Southeast corner of Section 1;
THENCE South 89018' West 10.00 feet to the POINT OF BEGINNING.
SECTION 2. THAT the owners of said tracts, including Standifer & Gray,
Inc., BE offered through the Right-of-way Department of the City of. Lubbock the
amount of $103.00, which is the amount appraised as the value and total damages
for the fee simple title and acquisition of said real estate hereinabove de-.
cribed, for the use and benefit of the City of Lubbock, Texas, for the purposes
herein stated, and unless accepted forthwith the City Attorney of said City of
Lubbock is hereby authorized and instructed to institute condemnation (eminent
domain) proceedings to acquire the fee simple title to said land as hereinabove
described for public purposes and municipal purposes.
