RESOLUTION 1445 - 8/11/83
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock an agreement for
"Abandonment of Existing Easement and Grant of Underground Utility Easement"
so as to relocate such easement in Lot 7, Block 9 in the Guadalupe Addition:
to the City of Lubbock, Lubbock County, Texas, to be entered into by and
between said City and the Urban Renewal Agency of the City of Lubbock, attached
herewith which shall be spread upon the minutes of the Council and as
spread upon the minutes of this Council shall constitute and be a part of this
Resolution as if fully copied herein in detail.
Passed by the City Council this 11th day of August 1983.

ABANDONMENT OF EXISTING EASEMENT AND
GRANT OF UNDERGROUND UTILITY EASEMENT
WHEREAS, there exists an underground utility easement for the
North two (2) feet of Lot Seven (7), Block Nine (9) Guadalupe
Addition to the City of Lubbock, Lubbock County, Texas, pursuant
to easement granted the City of Lubbock, Texas by instrument dated
the 6th day of August , 1'9 74 , and being recorded in Vol. 1408
Page 677.: of the Deed Records of Lubbock County, Texas; and
WHEREAS, due to improvements to be added on Lots Six (6) and
Seven (7), Block Nine (9), Guadalupe Addition to the City of Lubbock
Texas, there exists a need to relocate the above-described under-
ground utility easement from the North two (2) feet of said Lot
Seven (7), to the South two (2) feet of said Lot Seven (7); and
WHEREAS, the fee owners of said Lot Seven ('7) and the City of
Lubbock, Texas, the owners of such underground utility easement,
desire that the easement be relocated from the North two (2) feet
of said Lot Seven (7) to the South two (2) feet of said Lot Seven
(7) and the parties to this instrument agree that the easement as
to the North two (2) feet of said Lot Seven (7). shall be

of said Lot Seven (7) to the South two (2) feet of said Lot Seven
(7) and the parties to this instrument agree that the easement as
to the North two (2) feet of said Lot Seven (7). shall be
granted, including, but not limited to, the free right of
ingress or egress over and across said lands to and from said easement.
TO HAVE AND TO HOLD the same perpetually to the City of Lubbock,
Texas, and its successors, together with the right and privilege
at any and all times to enter said premises, or any part thereof,
for the purpose of constructing, reconstructing and maintaining said
underground utilities, and for making connections therewith; all
upon the condition that the City of Lubbock, Texas will at all times,
after doing any work in connection with the construction, reconstruc-
tion or repair of said underground utilities, or any lateral thereof,
restore said premises to the condition in which same were found before
such work was undertaken, and that in the use of said rights and
privileges herein granted to the City of Lubbock, Texas, will not
create a nuisance or do any act that will be detrimental to said
premises.
