RESOLUTION 1433 - 7/28/83 DGV:da BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and idirected to execute for and on behalf of the City of Lubbock a Street Use ',License between the City of Lubbock and Fiestas Mexicanas attached herewith ;which shall be spread upon the minutes of the Council and as spread upon the ,minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Vandiver, Assistant City At STREET USE LICENSE THE STATE OF TEXAS THE CITY OF LUBBOCK RESOLUTION 1433 - 7/28/83 !TY SECRETARY -TREASURER This agreement made this 28th day of July , 1983, between the City of Lubbock, Texas, and Fiestas Mexicanas, a coalition of citizens of the City of Lubbock, hereinafter called "Licensee." WITNESSETH: Subject to the terms, conditions and provisions herein, the City of Lubbock hereby grants to the Licensee the right, privilege and license to use portions of dedicated streets to conduct its annual "Fiestas Mexicanas" cele- bration September 15, 16 and 17. The streets to be used and the hours of encroachment shall be as is set out hereafter: 1. 11 a.m. to 7 p.m.: The inside lanes of Broadway between Avenue J and Avenue K will be blocked leaving the middle lanes open. The entire width of Avenue J between Main Street and Broadway will be blocked. 2. 7 p.m. to 12:00 midnight: The entire width of Broadway between Texas Avenue and Avenue K will be blocked. The entire width of Avenue J between Main Street and Broadway will be blocked. This License shall be subject also to the following restrictions and require- ments in addition to those restrictions on location and hours of operation hereinabove set out. 1. A loudspeaker permit shall be bbtained for this event. 2. Licensee shall pay to the City of Lubbock a $150.00 non-refundable permit application fee. 3. Licensee shall pay to the City of Lubbock as compensation for the use of said public streets a sum of $201.50 cash in advance contemporaneously with the acceptance and execution hereof by Licensee. 4. Licensee shall provide the following security personnel in addition to two on -duty police officers supplied by the City of Lubbock: two off-duty officers during all hours of operation each day, joined by six additional off- duty officers between the hours of 4:00 P.M. until 12:30 A.M. (or such time thereafter as the site has been cleared). The cost for such off-duty person- nel shall be $13.00 per hour times 231 estimated manhours. The Licensee shall pay the amount of $3,003.00 cash in advance contemporaneously with the accep- tance and execution hereof by Licensee. In the event security must be in- creased by order of the City of Lubbock due to attendance in excess of Licen- see's estimate of 1,000 persons per day, the additional amount required will be billed to Licensee and must be paid within 30 days of the receipt of such bill for security services. 5. Licensee shall be required to have all electrical service installa- tions approved by the City of Lubbock Building Inspection Department. Lubbock Power & Light personnel will be made available to assist Licensee with regard to obtaining electrical service. If Lubbock Power & Light is selected by licensees to supply electric power to said event, a cash hookup fee of $500.00 shall be paid in advance contemporaneously with the acceptance and execution hereof by Licensee. Licensee will pay for actual consumption of electrical power within 30 days of receipt of a bill for such consumption from Lubbock Power & Light. 6. Licensee shall be required to totally restore the streets used for this event to the'same condition as before the event takes place, including collection of all garbage and trash from such streets. All streets subject to this agreement shall be cleaned thoroughly before 9:30 a.m. 'Friday and Saturday and before 6 p.m.-$unday. if Licensee desires to have garbage and trash collected by the City of Lubbock,;then a service fee of $120.00 cash must be paid contemporaneously with the acceptance and execution hereof by Licensee. If City of Lubbock service is selected, Licensee in addition will pay for actual collections at a rate of $1.00 per cubic yard or $30.00 per container, which amount will be billed to Licensee and must be paid within 30 days of receipt of such bill. 7. Licensee shall obtain public liability and property damage insur- ance, which policy shall name the City of Lubbock as an additional insured, in the following amounts: For damages arising out of bodily injury to or death of one person in any one accident ................ $100,000.00 For damages arising out of bodily injury to or death of two or more persons in any one accident. ...............................................$300,000.00 For damage to or destruction of property in any one accident ........... 0 ........... 0 ..................$100,000.00 Evidence of such policy shall be given the City of Lubbock contemporaneously with the acceptance and execution hereof by Licensee. 8. Licensee shall obtain and furnish the City with a performance bond in the amount of $10,000.00 to insure that any damage to City property'occur- ring during said event will be repaired. Such bond shall be delivered to the City of Lubbock contemporaneously with the acceptance and execution hereof by Licensee. Such bond shall be payable to the City of Lubbock and shall be returned to Licensee within 30 days of a finding by the City of Lubbock that no uncompensated damage exists., 9. Licensee must furnish the City of Lubbock with proof that alcohol sales have been approved by the Texas.Alcoholic Beverage Commission at the location named herein, if such sales are to be conducted. In addition, if such permit is obtained, Licensee must fence, barricade or secure by other means the area where alcohol is to be sold. The Licensee shall allow entrance to such area through a single access and security personnel shall be stationed at such access to check identification and insure that no one takes alcoholic beverages from the permitted area. That the Fiestas Mexicanas committee shall appoint a.monitoring committee that will inform the 'police of any observed consumption of alcohol outside the permittedarea. This monitoring committee will take an active role in prohibiting illegal alcohol consumption and report to the police any alcohol use violation. 10. Licensee must obtain all applicable City of Lubbock Health Depart- ment permits for temporary sales of food and beverages. 11. Licensee must provide suitable toilet facilities for public use at a ratio of not less than one unit for every one hundred persons in attendance, but not less than a total of twenty (20) units. 12. Licensee must obtain and have available emergency medical aid on the site during all hours of operation. Such aid station shall be marked so as to be readily identifiable. 13. That the Licensee shall appoint a "booth standards committee" to ensure that booths are well constructed and attractive. 14. Licensee shall provide a 10 -foot access between the curb and struc- ture erected to provide emergency access for fire department vehicles. In addition Licensee will not block any alley ways in the area covered by this License. 15. Failure of Licensee to abide by the terms of this Agreement will result in immediate revocation withoutpriornotice. 16. The cash amounts herein. set out to be paid by Licensee shall be paid in a lump sum by cashier's check no later than September 1, 1983. We realize that the streets will have to be blocked off for the days of September 15-17, 1983. We also under- stand that Broadway will be open for traffic up to 7:00 p.m. each day which will mark the time for Broad- way to be•baracaded completely for the Fiesta activi- ties. The streets will be blocked off from Texas Avenue to Avenue K. Thank You.
