Rush Addition - 07/14/1983RESOLUTION 1423 - 7/14/83 HW/mck RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Quit Claim Deed in favor of American State Bank of Lubbock, Texas, attached herewith, which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Tom Nivens, Right -of -Way Agent APPROVED AS TO FORM: Harold Willard, Assistant City Attorney RESOLUTION 1423 - 7/14/83 4 1983 QUITCLAIM DEED THE STATE OF TEXAS § KNOW ALL MEN BY THESE PRESENTS COUNTY OF LUBBOCK § THAT the CITY OF LUBBOCK, a Home Rule Municipality in the County of Lubbock, State of Texas, for and in consideration of the sum of TEN AND N0/100 ($10.00) DOLLARS and other good and valuable consideration to it in hand paid by American State Bank of Lubbock, Texas, hereinafter called "GRANTEE", the receipt of which is hereby acknowledged, does hereby by these presents ABANDON, DISCLAIM, RELEASE AND FOREVER QUITCLAIM unto the said GRANTEE, all its rights, title and interest in and to those certain tracts or parcels of land lying and being situated in the County of Lubbock, State of Texas, described as follows, to - wit: TRACT ONE BEGINNING at an "x" marked on concrete sidewalk, the Southeast corner of Lot 1, Block 3, G. A. Rush Addition; THENCE North, 115.0 feet to the Northeast corner of said Lot 1, Block 3, for a corner of this tract; THENCE West, 135.0 feet to the Northwest corner of Lot 3, Block 3, for the South -Northwest corner of this tract; THENCE North, 14.5 feet to a concrete nail, set in pavement, for the Northwest corner of this tract; THENCE East, 57.87 feet to a concrete nail, for a corner of this tract; THENCE North, 5.0 feet to a concrete nail, for a corner of this tract; THENCE East, 129.88 feet to an "x" in concrete walk in the West line of Lot B, G. A. Rush Addition; THENCE Southwesterly around the arc of a curve of a radius of 61.0 feet, 31.37 feet to an "x" marked on concrete curb, said curve has a central angle of 29°27'59", a tangent of 16.04 feet, and a chord that bears South 14°35'40" East, 31.03 feet; THENCE South 0001149" East, 106.21 feet to an "x" in concrete walk, the Southwest corner of Lot B, G. A. Rush Addition; THENCE North 88021'36" West, 60.65 feet, along the North line of 15th Street, to the PLACE OF BEGINNING. TRACT TWO A drainage easement twenty (20') feet in width and described as the East twenty (20') feet of Lot D of the G. A. Rush Addition to the City of Lubbock, Lubbock County, Texas, said easement being conveyed to the City of Lubbock as evidenced by an instrument of conveyance recorded in Volume 1249, Page 172 of the Deed Records of Lubbock County, Texas, said instru- ment of conveyance being incorporated herein by reference as if fully copied herein in detail in this place. _ TO HAVE AND TO HOLD the same premises together with all and singular the rights, privileges and appurtenances thereto in any manner belonging unto the said GRANTEE, its successors and assigns forever, so that neither the GRANTOR, VOL, 185-p.88� CITY OF LUBBOCK, its successors or assigns, nor any persons claiming under it shall at any time hereinafter, have, claim or demand any right to the title to the aforesaid premises or appurtenances or any part thereof.
