RESOLUTION 1484 - 9/22/83
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located
in Lubbock County, Texas, has determined and does hereby determine that the
public needs, safety and welfare demand and create a public necessity for
the acquisition of additional land for municipal public uses and purposes,
to -wit: for public park purposes, and this City Council of said City finds
it in the public interest and for public purposes and municipal purposes to
proceed with the acquisition of lands as needed for such purposes as
aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described tract
of land located in Lubbock County, Texas, be acquired for public purposes
and municipal purposes as set forth in the preamble hereof, to -wit:
A tract of land located in Section 36, Block A -K, Lubbock County,
Texas, containing 51.796 acres, more or less, being that tract
conveyed to Homer R. Thomason and recorded in Volume 1678, Page 721,
and Volume 1518, Page 494 of the Deed Records of Lubbock County,
Texas, and being further described as follows:
BEGINNING at a 3/8" iron rod found at the Southwest corner of a tract
conveyed to L. W. Chance, Jr. in Volume 424, Page 61, and in the North
line of a tract conveyed to Dan Manning in Volume 1734, Page 412, said
rod bears N. 00°06'28" E., 2304.25 feet and N. 89°52126" W., 2346.72
feet from the Southeast corner of Section 36, Block A -K, Lubbock
County, Texas, for the Southeast corner of this tract;
THENCE N. 89052126" W., along the North line of said Manning tract, a
distance of 1192.80 feet to a 3/811 iron rod found at the Northwest
corner of said Manning tract and being in the East line of a tract
conveyed to Ruth C. Lowrey in Volume 174, Page 584, for the Southwest
corner of this tract;
THENCE N. 00°06157" E., along the East line of said Lowrey tract, at
1974.11 feet pass a 1/211 iron rod set at the Northeast corner of said
Lowrey tract, continuing for a total distance of 1986.52 feet to a
1/211 square metal tube found in the Southeast right-of-way line of U.
S. Highway No. 62-82, for the Northwest corner of this tract;
THENCE N. 5305914011 E., along the Southeast right-of-way line of U. S.
Highway No. 62-82, a distance of 306.24 feet to a 1/2t1 iron rod found
in the West line of a tract conveyed to Marvin Mast in Volume 1673,
Page 547, for a North corner of this tract;
THENCE South, along the West line of said Mast tract, a distance of
321.06 feet to a 3/4f1 iron pipe found at the Southwest corner of said
Mast tract for an II1_11 corner of this tract;
THENCE N. 89059130" E., along the South line of said Mast tract, at
481.50 feet pass a 3/8/° iron rod found at the said Mast tract and at
the Southwest corner of a tract conveyed to A. E. Cannon in Volume
963, Page 188, continuing along the South line of said Cannon tract,
for a total distance of 940.99 feet to a 3/4" iron pipe found at the
Southeast corner of said Cannon tract and in the West line of said
Chance tract, for the Northeast corner of this tract;
THENCE South, along the West line of said Chance tract, a distance of
1848.06 feet to the POINT OF BEGINNING.
SECTION 2. THAT the owners of said tract, including Homer R. Thomason
et ux, Gerry Thomason, BE offered through the Right -of -Way Department of
the City of Lubbock the amount of $154,000, which is the amount appraised
as the value and total damages for the fee simple title and acquisition of
said real estate hereinabove described, for the use and benefit of the City
of Lubbock, Texas, for the purposes herein stated, and unless accepted
forthwith, the City Attorney of said City of Lubbock is hereby authorized
and instructed to institute condemnation (eminent domain) proceedings to
acquire the fee simple title to said land as hereinabove described for
public purposes and municipal purposes.
