HomeMy WebLinkAboutResolution - 1483 - Right Of Way Offer - Dan Manning - Public Park Purposes, Sec 36 Block A-K - 09/22/1983HW:da RESOLUTION RESOLUTION 1483 - 9/22/83 WHEREAS, the City of Lubbock, Texas,a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal public uses and purposes, to -wit: for public park purposes, and this City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of lands as needed for such purposes as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title to the following described tract of land located in Lubbock County, Texas, be acquired for public purposes and municipal purposes as set forth in the preamble hereof, to -wit: A tract of land located in Section 36, Block A -K, Lubbock County, Texas, containing 18.818 acres, more or less, being that tract conveyed to Dan Manning and recorded in Volume 1734, Page 412 of the Deed Records of Lubbock County, Texas, and being further described as follows: BEGINNING at a 3/8" iron rod found at the Southwest corner of a tract conveyed to Frank B. Jones, Jr. and Jerry Holton Jones in Volume 1549, Page 972, and in the North right-of-way line of Spur 327, said rod bears N. 00°06128" E., 1822.50 feet and N. 89053148" W., 1650.07 feet from the Southeast corner of Section 36, Block A -K, Lubbock County, Texas, for the Southeast corner of this tract; THENCE N. 86034127" W., along the North right-of-way line of Spur 327, a distance of 688.44 feet to a 3/8" iron rod found for a South corner of this tract; THENCE Northwesterly around a curve to the right in the North right- of-way line of Spur 327, said curve having a radius of 215.00 feet, a central angle of 86°57'58", tangent lengths of 203.91 feet, a chord bearing of N. 43007146" W., and a chord distance of 295.90 feet to a 3/8" iron rod found for a South corner of this tract; THENCE S. 89054155" W., along the North right-of-way line of Spur 327, a distance of 110.05 feet to a 3/8" iron rod found for a South corner of this tract; THENCE Southwesterly around a curve to the right in the North right- of-way line of Spur 327, said curve having a radius of 215.00 feet, a central angle of 86°42120", tangent lengths of 202.98 feet, a chord bearing of S. 43023145" W., and a chord distance of 295.15 feet to a 3/8" iron rod found for a South corner of this tract; THENCE S. 86045125" W., along the North right-of-way line of Spur 327, a distance of 688.81 feet to a 3/8" iron rod found at the Southeast corner of a tract conveyed to Ruth C. Lowrey in Volume 174, page 584, for the Southwest corner of this tract; THENCE N. 00006157" E., along the East line of said Lowrey tract, a distance of 482.42 feet to 3/8" iron rod found at the Southwest corner of a tract conveyed to Homer R. Thomason in Volume 1518, Page 494, and in Volume 1678, Page 721, for the Northwest corner of this tract; THENCE S. 89052126" E., along the South line of said Thomason tract, at 1192.80 feet pass a 3/8" iron rod found at the Southeast corner of said Thomason tract, and at the Southwest corner of a tract conveyed to L. W. Chance, Jr. in Volume 424, Page 61, continuing along the South line of said Chance tract for a total distance of 1888.86 feet to a 3/8" iron rod found in the West line of said Jones tract, for the Northeast corner of this tract; THENCE S. 00002126" W., along the West line of said Jones tract, a distance of 482.41 feet to the POINT OF BEGINNING. SECTION 2. THAT the owners of said tract, including Dan Manning, BE offered through the Right -of -Way Department of the City of Lubbock the amount of $18,500, which is the amount appraised as the value and total damages for the fee simple title and acquisition of said real estate hereinabove described, for the use and benefit of the City of Lubbock, Texas, for the purposes herein stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the fee simple title to said land as hereinabove described for public purposes and municipal purposes.
