RESOLUTION
RESOLUTION 1510 - 10/27/83
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock an Interlocal
Cooperation Contract between the City of Lubbock, Texas and the Department
of Public Safety (DPS) for the purchase of certain forms, manuals and
supplies to be used in the Breath Testing Program by the City of Lubbock
Police Department, attached herewith, which shall be spread upon the
minutes of the Council and as spread upon the minutes of the Council shall
constitute and be a part of the Resolution as if fully copied herein in
detail.
Passed by the City Council this 27th day of October , 1983.

INTERLOCAL COOPERATION CONTRACT
THE STATE OF TEXAS 08py
COUNTY OF TRAVIS
THIS CONTRACT AND AGREEMENT is entered into by and between the
Texas Department of Public Safety and the local governmental
agency shown below as Contract Parties, pursuant to the authority
granted and in compliance with the provisions of "The Interlocal
Cooperation Act", Article 4413(32c), V.T.C.S., and in furtherance
of the responsibilities of the Texas Department of Public Safety
as provided in Article 67011-5, V.T.C.S.
I. CONTACTING PARTIES:
The Receiving Agency: City of Lubbock
The Performing Agency: Texas Department of Public Safety

II. STATEMENT OF FUNCTION TO BE PERFORMED:
The Texas Department of Public Safety will provide in
accordance with the procedures set forth in the rules of the
Department, certain forms, manuals, and supplies for the
receiving agency to be used in the Breath Testing Program.
The purpose and objective of this Contract is to control and
make uniform the procedures, paperwork and supplies used in
the above-mentioned program.
III. BASES FOR CALCULATING COSTS:
As per current price sheet contained in the Texas Department
of Public Safety Instruction Manual for Purchasing Breath
Testing Supplies for Non-D.P.S. Agencies.
IV. PAYMENT FOR SUPPLIES:
Receiving Agency shall submit full payment to the Department
of Public Safety at the time each order for supplies is
submitted. Payment shall be made from the Receiving
Agency's current revenues. In no event shall the Receiving
Agency expend more than One Thousand Five Hundred Dollars
($1,500.00) in any one fiscal year as described hereinbelow
under the terms of this Contract.
V. TERM OF CONTRACT:
This Contract shall become effective upon signing by both
parties, but in no event shall it become effective prior to
October 1, 1983. This Contract shall terminate on the last
day of the fiscal year of the State of Texas during which
the Contract was in effect.
THE UNDERSIGNED CONTRACTING PARTIES bind themselves,to the
faithful performance of this Contract. It is mutually understood
that this Contract shall be effective if signed by a person
authorized to do so according to the normal operating procedure
of said party. If the governing party is required to approve
this Contract, it shall not become effective until approved by
the governing body of that party. In that event, this agreement
shall be executed by the duly authorized afficial(s) of the party
as expressed in the approving resolution or order of the govern-
ing body of said party, a copy of which shall be attached to this
Contract.
