RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock an agreement
for use of Boeing Computer Time Sharing Services available through the
American Public Works Association BCS Master Time Sharing Account with the
APWA at the rate set forth in Attachment A to said agreement, which
agreement is attached herewith and which shall be spread upon the minutes
of the Council and as spread upon the minutes of this Council shall
constitute and be a part of this Resolution as if fully copied herein in
detail.

Statement of Agreed Upon Terms and Conditions
for Use of
Boeing Computer Time Sharing Services
Available Through the APWA BCS Master Time Sharing Account
1. Scope of Agreement
The following constitutes an agreement between APWA and the City of Lubbock
(hereafter referred to as the User) on terms and conditions
governing the use of Boeing Computer Services (BCS) time sharing services
offered under the auspices of an APWA master BCS agreement and the use of the
APWA-COE PAVER programs and associated technical assistance. The agreement
also constitutes application for membership in the APWA-COE Users Group.
2. Term of the Agreement
This agreement becomes effective upon the date the document is accepted and
signed by APWA. APWA acceptance is contingent upon receipt of, or
arrangements made for the payment of, the annual account fee described in
Section 4 below. The agreement will continue thru Sept. 30. 1984 at which
time the agreement will be subject to renewal.
3. Assignment of Subaccount
Upon APWA acceptance of this agreement the User may access any service offered
by Boeing Computer Services Company, including the APWA-COE PAVER system, via
the IP # using the password which will be
supplied with the return of the signed copy of this agreement. If the user
chooses to change the above password, the user agrees to notify APWA in
writing of the new password.
A. Terms
The User agrees to pay an annual account fee of $ In addition, the
user agrees to pay any and all computer use and service charges incurred by
the user within 30 days of invoice. Computer services will be charged at
rates no greater than that shown in attachment A plus a service
charge.
5. Deposit
At the request of APWA, the User agrees to deposit with APWA a sum of
$ -0- . This sum will be returned to the User at the termination of this
agreement if there are no outstanding bills..
No Deposit required for 'Optimizing Pavement Investments' project members.
6. Default
If the User fails to pay for services rendered within 60 days of invoice, APWA
may, at its sole option and without notice, terminate access to"the User's
subaccount,-and the agency's PAVER data base. The latter will not be released
until the required payments and assessed late fees are paid. - If a deposit has
been made with APWA, it will be used to cover the outstanding invoice. Service
will not be reinstated until a full deposit has been reestablished.
7. Master Account Terms and Conditions
The User agrees to abide by the terms and conditions (presented in attachment B)
set forth by BCS and agreed to by APWA governing the use of the BCS ?faster
Account.
S. Use of APWA-COE PAVER Program
APWA assumes no liability for the use of APWA-COE PAVER nor conclusions drawn
from analysis using the PAVER programs.
The User is solely responsible for correct data input and the consequences of
incorrect data entry. Further, it is the User's sole responsibility to develop
adequate back-up copies of the User's PAVER data base to insure against loss due
to human or machine error. APWA will not bear financial responsibility for a
lost or damaged PAVER data base.
The User is entitled to -telephone consultation with the BCS and APWA account
staff support for technical assistance on the correct implementation and use of
the PAVER programs, and the correct and most cost effective use of the Boeing
EKS system for the duration of this agreement. However. the User understands
that questions regarding pavement management engineering judgement will not be
answered. Further. the User will be charged a separate fee for any requested
special handling of the User's data base.
9. Access to User Data Base
The User will have the sole authority to alter the User's own data base(s). Tne
User agrees to allow APWA staff "read only" access to the User PAVER data base.
Information gained for such access will be used coley for research purposes, the
1 results of which will be made available to the User. Information gleaned from
such analysis will not be published in disaggregate form without the express
written permission of the user. Beyond the APWA "read only" access, the User
will have sole access to its own data base(s).

10. APWA-COE PAVER User's Group
Acceptance of this agreement will constitute application for, and acceptance of,
membership in the APWA-CCE PAVER User's Group, the rights and privileges of _
which are spelled out in the APWA-COE PAVER User's Group By -Laws.

11. Withdrawal
If the User chooses to withdraw from this agreement of the User's own accord, -a
prorated portion of 75% of the annual account fee will be returned upon written
notification of the User's intent to withdraw.
12. Cancellation of Service
Except for payment default. APWA may not terminate this agreement without 90
days written notice at which time the User will be refunded a prorated portion
of 75I of the annual account fee and offered an alternative arrangement for
accessing PAVER programs.

(3) The hours in each time zone during which prime time rates apply are
0000 through 2400. Monday through Sunday including holidays.
(4) Low -speed access charge consists of the hourly rate as shown plus a
charge of $0.175/1000 characters.

Total Computer Charges. The total charges for a given job are equal to the CCU
charges + Remot Terminal Connect Charges + Proprietary Charges + Peripheral Device
Charges + Other Network Charges. MAINSTREAM-EKS prices s Computer Processing
Charges + Connect Charges + Storage Charges + Other Charges - Discounts.
(1) tSAINSTREAM EKS is billed based on a bundled Computer Charging Unit
(CCU). A CCU is a measure of the following resources - CPU, Central
Memory, User ECS, disk I/0, tape I/0, tape drive occupancy and
mounts, and card and print I/0. The number of CCUs charged for a
job is obtained by combining the quantities of individual resource
elements according to a proprietary algorithm containing proprietary
numerical coefficients and Including a job initiation constant. The
CCUs generated by job segments in which application programs are
used are multiplied by the appropriate surcharge factor. These
calculations apply to all CCUs. Subscriber may select any one of the
charging units CCU -A .through F. If no- selection is made, CCU -A will
apply•
(2) If no priority 13 specified, Priority 2 will be assigned. Jobs will
be billed based upon priority requested.
(3) The lowest increment of charge is .1 CCU.
(4) Prime time rates will apply from 0800-2000 Eastern Time Monday
through Sunday. Non -prime time rates will apply during all other
operational hours and BCS holidays.
(5) Priority 1 jobs may be submitted at any time and will be processed
only between 2000 and 0800 Eastern Time Monday through Friday and
during all operational hours on weekends and BCS holidays.
