HomeMy WebLinkAboutResolution - 1699 - Contract A - Vowell Construction - 2Nd 1984 Maintenance Program - 05/24/1984RESOLUTION 1699 - 5/24/84 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE.CITY.OF LUBBOCK: THAT the Mayor of the City of Lubbock be and IS hereby authorized and directed to execute for and on behalf of the City of Lubbock, a contract between the City of Lubbock and Vowell Construction Company, for the 2nd 1984 Maintenance Program (Contract "A") in the City of Lubbock, Lubbock County, Texas, attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Ross, Jr., City Attorney CHANGE ORDER NO. 1 TO CONTRACTS "A" AND "B" 2ND 1984 MAINTENANCE PROGRAM Gentlemen: Whereas, it is necessary to make changes in the specifications, plans and the list of streets to be paved with a two-course_.surface and streets to be reconstructed with nine (9) inches of black base. The reason for this change is that the Texas Highway Department is constructing a storm sewer along the center line of East 50th Street from Avenue "A" to south- east Drive. The center three traffic lanes will be closed for this con- struction, Whereas, the City Council has approved the Maintenance improvements as listed in the specifications on May 24, 1984, Whereas, the contractor herein agrees to the following changes, 1. Contract "A" Removing East 50th Street from Cedar Avenue to Southeast Drive from list of two -course improvements. 2. Contract "B" Removing the Black Base quantities on the south side of East 50th Street from Quirt Avenue to Southeast Drive. 3. That the quantities removed in items one and two be used at other selected locations. 4. That the completion date of Contract "A" be extended five days. 5. The original amount of Contracts "A" and "B" remains the same. 6. Completion date of this change order is September 7, 1984 weather permitting. THIS AGREEMENT WITNESSETH: In consideration of the mutual advantages gained, the Owner and the Contractor agree to the change shown herein and in the re- vised plans, The Contractor agrees to proceed with construction and to ad- here to applicable specifications, under the direction of the Engineer. Furthermore, the parties agree that the original contract between the Owner and the Contractor shall be modified to the extent herein indicated, including one (1) attachment. List of streets to be added to the list of improvements in Contract "A": 1. 50th Street Avenue H to Avenue N (Two -Course & Black Base) 2. Quirt Avenue 36th Street to 50th Street. 1 CHANGE ORDERS - AUTHORITY TO APPROVE OBJECTIVE: To provide a mechanism for administrative handling of minor Change. Orders. RESPONSIBLE AGENCY: Deputy City Manager, all individuals charged with the responsibility of administering Public.Works contracts. SERVICE/POLICY: State law provides a mechanism whereby administrative individuals • may approve Change Orders which involve decreases or increases of $5,000 or less. The City Attorney's Office has incorporated language into standard Public Works: contracts which designates a member of the staff as the individual having that responsibility. The City Manager has designated the Deputy City Manager as the individual who will be responsible for final approval of all Change Orders of this nature.
