RESOLUTION
RESOLUTION 1680 - 5/10/84
WHEREAS, the City of Lubbock, Texas,a Home Rule Municipality located
in Lubbock County, Texas, has determined and does hereby determine that the
public needs, safety and welfare demand and create a public necessity for
the acquisition of additional land for municipal public uses and purposes,
to -wit: as a site for the construction of a switch station for Lubbock
Power & Light Company, and this City Council of said City finds it in the
public interest and for public purposes and municipal purposes to proceed
with the acquisition of lands as needed for such purposes as aforesaid; NOW
THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described land
located in Lubbock County, Texas, be acquired for public purposes and
municipal purposes as set forth in the preamble hereof, to -wit:
BEGINNING at a point which is S. 0002110" E. 2636.12 feet from the
northwest corner of Section 9, Block JS, said point also being the
southwest corner of the northwest 1/4 of Section 9, Block JS;
THENCE N. 89059120" E. along the 1/2 section line a distance of 428
feet to a point;
THENCE N. 0002110" W. 458 feet to a point;
THENCE S. 89°59120" W. 428 feet to a point on the west line of Section
9, Block JS;
THENCE S. 0002110" E. along the west line of Section 9, Block JS a
distance of 458 feet to the POINT OF BEGINNING.
SECTION 2. THAT the owners of said tract, including Dr. Ernesto
Ching, Sadallah Moses, Dr. Mfawwaz Shoukfeh and Dr. Victor S. Igal, BE
offered through the Right -of -Way Department of the City of Lubbock the
amount of $36,840, which is the amount appraised as the value and total
damages for the fee simple title and acquisition of said real estate
hereinabove described, for the use and benefit of the City of Lubbock,
Texas, for the purposes herein stated, and unless accepted forthwith, the
City Attorney of said City of Lubbock is hereby authorized and instructed
to institute condemnation (eminent domain) proceedings to acquire the fee
simple title to said land, as hereinabove described, for public purposes
and municipal purposes.
