RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located
in Lubbock County, Texas, has determined and does hereby determine that the
public needs, safety and welfare demand and create a public necessity for
the acquisition of additional land for municipal public uses and purposes,
to -wit: for the widening of North Quaker Avenue, and this City Council of
said City finds it in the public interest and for public purposes and
municipal purposes to proceed with the acquisition of lands as needed for
such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described land
located in Lubbock County, Texas, be acquired for public purposes and
municipal purposes as set forth in the preamble hereof, to -wit:
A portion of a tract of land located in Section 14, Block A, Lubbock
County, Texas, and conveyed to Guy H. Beal and Barbara F. Beal in
Volume 1618, Page 280 of the Deed Records of Lubbock County, Texas,
being further described as follows:
BEGINNING at a 60 penny nail (set) which bears N. 00°03110" W., 65.00
feet from the Southeast corner of Section 14, Block A;
THENCE West, along the North right-of-way line of Ursuline Street,
dedicated in Volume 1213, Page 348 of the Deed Records of Lubbock
County, Texas, and parallel to the South line of Section 14, Block A,
a distance of 60 feet;
THENCE Southwesterly, continuing along said right-of-way line and
around a curve to the right, said curve having a radius of 15.00 feet,
a central angle of 90°, tangent lengths of 15.00 feet, and a chord
distance of 21.21 feet;
THENCE West, continuing along said right-of-way line, a distance of
225.03 feet to a 1/2" iron rod (set);
THENCE N. 00005142" W. a distance of 5.00 feet to a 1/2" iron rod
(set);
THENCE East, parallel to the South line of Section 14, Block A, a
distance of 217.70 feet to a 1/2" iron rod (set) at a point of
curvature;
THENCE Northeasterly around a curve to the left, said curve having a
radius of 30.00 feet, a central angle of 91°41142", tangent lengths of
30.90 feet, and a chord distance of 43.05
feet to a 1/2" iron rod (set);
THENCE N. 01041142" W. a distance of 107.86 feet to a 1/2" iron rod
(set);
THENCE East a distance of 55.41 feet to a 60 penny nail (set) in the
East line of Section 14, Block A;
THENCE S. 00003110" along the East line of Section 14, Block A, a
distance of 128.70 feet to the POINT OF BEGINNING.
SECTION 2. THAT the owners of said tract, including Guy H. Beal et
ux, Barbara F. Beal, BE offered through the Right -of -Way Department of the
City of Lubbock the amount of $4,500, which is the amount appraised as the
value and total damages for the fee simple title and acquisition of said
real estate hereinabove described, for the use and benefit of the City of
Lubbock, Texas, for the purposes herein stated, and unless accepted
forthwith, the City Attorney of said City of Lubbock is hereby authorized
and instructed to institute condemnation (eminent domain) proceedings to
acquire the fee simple title to said land as hereinabove described for
public purposes and municipal purposes.
