RESOLUTION 1602 - 3/8/84
RESOLUTION
WHEREAS, the City Council of the City of Lubbock finds that land
hereinafter described is needed for public purposes, to -wit: a fire
station; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Right -of -Way Department of the City of Lubbock,
subject to the approval of the Zoning Board of Adjustment of the City of
Lubbock, is hereby authorized and directed to make an offer on behalf of
the City in the amount of $27,000.00 to Leroy Elmore, trustee, (as owner)
for the purchase by the City of a tract of land to be used as set forth in
the preamble hereof, and being further described as follows:
Lots 1029 103 and 1049 Bicentennial Estates Addition to the City of
Lubbock, Lubbock County, Texas.
SECTION 2. Said purchase is to be accomplished by the Right -of -Way
Department.
Passed by the City Council this 8th day of March 19 84.

CONTRACT FOR SALE OF LAND

RESOLUTION 1602 - 3/8/84
This c_n�tpr�act of bargai and sale is made and n ered into
this the LV day of � � - U q Y �-/ , 19 , by and
between LEROY ELMORE, TRUSTEE, of Lubbock County, Texas,herein-
after called Vendor, and the CITY OF LUBBOCK, TEXAS, hereinafter
called Vendee.
WITNESSETH: That the said Vendor has this day bargained and
sold and by these presents does hereby bargain, sell and obligate
himself to convey or cause to be conveyed in the manner herein-
after stated unto the said Vendee all and singular the following
described property, to -wit:
Lots 102, 103 and 104, Bicentennial Estates Addition to the
City of Lubbock, Lubbock County, Texas.
The consideration paid and to be paid to the Vendor herein
by the Vendee for the property above described is the agreed sum
of TWENTY-SEVEN THOUSAND AND NO/100 DOLLARS.
This contract is contingent upon the City of Lubbock Zoning
Board of Adjustment's approval of the above described property as
a site for the construction of a fire station.
This contract is conditioned upon the Vendor procuring and
delivering to the Vendee, at the earliest practicable date, a
full, complete, certified abstract of title to the above des-
cribed property, and permitting the Vendee to have the same
examined by its attorneys. If the title as shown by the abstract
is good and valid, then the Vendor will make, execute and tender
a good and sufficient deed, conveying the aforesaid property to
the Vendee with full covenants of general warranty to complete
this contract in accordance with its terms and stipulations. If
the title to the above described property, as disclosed by the
abstract, is not shown to be good and valid, then the Vendee
shall procure and submit to the Vendor a statemenn writing of
the objections made to the said abstract within days from
date hereof. If the said objections are of such character that
they can be cured or removed within a period of time not to
exceed-',')() days from date hereof, then the Vendor shall be
obligated, and is hereby obligated, to so cure or remove said
objections at his own expense, and it is hereby agreed and
understood that the Vendor shall have rQ n days from and after
the date when the written statement of objections is delivered to
him within which to cure or remove same. If the title to the
above described property, as shown by the abstract, is not good,
and the objections thereto are not cured or removed by the Vendor
in the manner and within the time hereinbefore stated, then the
Vendee shall have the right to declare this contract at an end
and no longer__binding_on him,_and same shall thereupon become
null and void, and the Vendee shall be entitled to the return of
all money by him paid by reason of this agreement.
This contract is executed in duplicate and one copy deli-
vered to each of said parties.
