HomeMy WebLinkAboutResolution - 1768A - Set Public Hearing - Energas - Proposed Increase In Rates - 07/26/19843� �obt JCR:cl ORDER SETTING HEARING AND SUSPENDING RATES AN ORDER OF THE CITY COUNCIL OF THE CITY OF LUBBOCK, SITTING AS A REGULATORY AUTHORITY UNDER VERNON'S ANN.CIV.STAT., ART. 1446e, SETTING A DATE FOR HEARING ON A PROPOSED INCREASE IN RATES BY ENERGAS COMPANY AND SUSPENDING SAID PROPOSED RATES FOR A PERIOD OF NINETY DAYS. WHEREAS, Energas Company did file with the City of Lubbock on July 6, 1984, its statement of intent to make changes in its rates, and WHEREAS, Energas Company did designate in its statement of intent that the proposed change in its rates would constitute a major change as defined in Section 5.08(b) of Art. 1446e, V.A.C.S., and WHEREAS, a major change in rates presently charged by Energas Company requires a public hearing be held to determine whether or not such rate increases should be granted, and WHEREAS, Energas Company seeks to implement the increase set forth in its statement of intent throughout its West Texas City Plant System, and WHEREAS, there are some sixty-three (63) cities in the West Texas City Plant System which will be involved in the Energas Company's system wide rate request, and WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to suspend the proposed change in rates requested by Energas Company in order for it to thoroughly review the basis for the proposed change in rates requested by Energas Company: NOW THEREFORE: BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK, SITTING AS A REGULATORY AUTHORITY UNDER ART. 1446e, V.A.C.S.: 1. THAT a public hearing be held on August 23, 1984 at 11:30 o'clock a m. at which hearing the regulatory authority shall consider evidence to determine whether or not the proposed changes in rates are just and reasonable and should or should not be granted. 2. THAT the effective date of the proposed change in rates be suspended until 5:00 p.m., November 9, 1984, a period of not more than 90 days from August 11, 1984. 3. THAT Energas Company shall furnish to the City staff of the City of Lubbock or any experts employed by the City of Lubbock, to review this rate request and any and all data requested necessary to make a reasonable determination of the rate base, expenses, investments and rate of return received by Energas Company within the municipal boundaries of the City of Lubbock. 4. THAT notice of this Order be given to Energas Company by having the City Secretary place a certified copy of this Order in the U.S. Mail, certified mail, return receipt requested, addressed to Energas Company, P.O.
