HomeMy WebLinkAboutResolution - 1757 - Right Of Way Offer - Charles F Young - N Wuaker Ave Widening, Sec 5 Block J-S - 07/26/19840.b HW: da RESOLUTION Resolution #175, Agenda Item #26 0726-84 WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal public uses and purposes, to -wit: for the widening of North Quaker Avenue, and this City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of lands as needed for such purposes as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title to the following described tract of land located in Lubbock County, Texas, be acquired for public purposes and municipal purposes as set forth in the preamble hereof, to -wit: A portion of that tract of land located in Section 5, Block J -S, Lubbock County, Texas, and conveyed to Charles F. Young in Volume 679, Page 83 and in Volume 1220, Page 540 of the Deed Records of Lubbock County, Texas, and being further described as follows: BEGINNING at a point 70.00 feet West of the Northeast corner of Section 5, Block J -S, Lubbock County, Texas; THENCE S. 00006152" E., parallel with the East line of Section 5, a distance of 55.00 feet to a 1/2" iron rod set for the Southeast corner of this tract; THENCE West a distance of 155.00 feet to a 1/2" iron rod set for the Southwest corner of this tract; THENCE North, along the West line of said Young tract, a distance of 55.00 feet to a 5/8" iron rod found in the North line of Section 5, and at the Northwest corner of this tract; THENCE East, along the North line of Section 5, a distance of 155.00 feet to the POINT OF BEGINNING. SECTION 2. THAT the owners of said tract, including Charles F. Young, BE offered through the Right -of -Way Department of the City of Lubbock the amount of $9577.009 which is the amount appraised as the value and total damages for the fee simple title and acquisition of said real estate hereinabove described, for the use and benefit of the City of Lubbock, Texas, for the purposes herein stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the fee simple title to said land as hereinabove described for public purposes and municipal purposes.
