HomeMy WebLinkAboutResolution - 1704 - Decline Request - Carlisle - Municipal Utility District - 06/14/1984DGV:cl RESOLUTION RESOLUTION 1704 6/14/84 WHEREAS, Vernon's Ann.Civ.St., Art. 970(a), Section 8131 provides that no political subdivision having as one of its purposes the supply of domestic fresh water or sanitary sewer services may be created within the area of the extraterritorial jurisdiction of any city without the written consent of the governing body of such city; and WHEREAS, on April 25, 1984, A.R. Howard, acting attorney for Carlisle, submitted a written request for the approval of the governing body of the City of Lubbock of a special district or political subdivision to provide domestic fresh water and sanitary sewer services in such area; and WHEREAS, the proposed political subdivision would lie entirely within the extraterritorial jurisdiction of the City of Lubbock; and WHEREAS, after due consideration of such request, the City Council finds that the granting of such request would not be in the best interest of the citizens of the City of Lubbock; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City Council of the City of Lubbock hereby declines the said request for written permission to create a political subdivision for the furnishing of domestic fresh water and sanitary sewer services in the Carlisle area.
