AN ORDER OF THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS, SITTING AS
A REGULATORY AUTHORITY UNDER VERNON'S ANN.CIV.ST., ART. 1446c, ESTABLISHING
A PROCEDURE FOR INVESTIGATION OF COMPLAINTS AGAINST REGULATED UTILITIES
WITHIN THE CITY OF LUBBOCK, TEXAS.
WHEREAS, the City Council of the City of Lubbock has not surrendered
its regulatory authority under terms of Vernon's Ann.Civ.St., Art. 1446c;
and
WHEREAS, the City Council from time to time receives complaints
against public utilities operating within the City of Lubbock, Texas; and

WHEREAS, the City Council deems it to be in the best interest of the
citizens of the City of Lubbock and the regulated utilities within the City
of Lubbock to establish a procedure for the handling of complaints against
said utilities; NOW THEREFORE:
BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the following procedure is hereby established for
the handling of customer complaints about public utilities operating within
the City of Lubbock.
(1) Upon complaint to the utility by a customer either at its
office, by letter, or by telephone, the utility shall promptly make a
suitable investigation and advise the complainant of the results
thereof.
(2) In the event the complainant is dissatisfied with the
utility's report, the utility must advise the complainant of the•City
of Lubbock complaint process.

(3) Upon receipt of a written complaint by a customer to the
City Council of the City of Lubbock, the City of Lubbock shall notify
the utility of complaint and the utility shall make a suitable
investigation and advise the City Council of the results thereof in
writing. Initial response to the City Council must be made within 30
days.
(4) Upon receipt of the written response of the utility, the
City Manager may designate a representative to investigate the
complaint. The City Manager or his designated representative shall
have 30 days in which to review the matter and to make a determination
as to whether action by the City Council sitting as a regulatory
authority is required.
(5) In the event that the matter is considered by the City
Council, sitting as a regulatory authority, an order may be entered
for adjustment or disposition of the matter.
(6) Utilities shall keep a record of all complaints which shall
show the name and address of the complainant, the date and nature of
the complaint and the adjustment or disposition thereof for a period
of two years subsequent to the final settlement of the complaint.
Complaints with reference to rates or charges which require no further
action by the utility need not be recorded.
SECTION 2. THAT a copy of this Order be served upon the local
offices of all public utilities operating within the City of Lubbock,
Texas, by the City Manager or his designated representative.

set out in Section 23.41(b) of the PUC Substantive Rules. This procedure is
consistent with PUC requirements, and we hope will be beneficial to both you
and the City Council, when they sit as a regulatory authority, in handling
complaints.
