HomeMy WebLinkAboutResolution - 1782 - Right Of Way Offer-Charles & Scott Bolton-Quirt Ave Overpass Project - 08/09/1984HW:js RESOLUTION Resolution #1782 Agenda Item #37 8/9/84 WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal public uses and purposes, to -wit: for the Quirt Avenue and East 34th Street overpass project, and this City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of lands as needed for such purposes as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title to the following described tract of land located in Lubbock County, Texas, be acquired for public purposes and municipal purposes as set forth in the preamble hereof, to -wit: A tract of land out of that certain tract situated in the City of Lubbock, Lubbock County, Texas, being out of the East 179 feet of the West 310 feet of Lot 1, SAVE and EXCEPT the East 10 feet, Block 5, Nelson -Brown Addition, said property also being the same property described in a Deed from A. B. Ohlenbusch to Durwood Bolton, dated March 10, 1964, recorded in Volume 980, Pages 225-226 of the Deed Records of Lubbock County, Texas, being more particularly described by metes and bounds as follows: BEGINNING at a point in the existing west right-of-way line of Quirt Avenue, said point being the southeast corner of said parcel and South 87°35158" East, a distance of 169.00 feet from the southwest corner of said parcel; THENCE, North 87035158" West along the south line of said parcel, a distance of 12.50 feet to a point in the proposed west right-of-way line of Quirt Avenue; THENCE, North 3005149" East along the proposed west right-of-way line of Quirt Avenue, a distance of 104.32 feet to a point on a curve of the proposed west right-of-way line of Quirt Avenue; THENCE, Northwesterly along said curve to the left, having a radius of 40.00 feet and a radial bearing of North 86°54111" West, a distance of 30.43 feet along said curve to a point on a curve of the north line of said parcel; 40 . THENCE, Southeasterly along said curve to the right, having a radius of 1850.08 feet and a radial bearing of South 26054'56" West, a distance of 14.63 feet along said curve to a point on a curve of the existing west right-of-way line of Quirt Avenue; THENCE, Southeasterly along said curve to the right, having a radius of 15.00 feet and radial bearing of South 27029108" West, a distance of 16.99 feet along said curve to a point in the existing west right-of-way line of Quirt Avenue; THENCE, South 2024101" West along the existing west right-of-way line of Quirt Avenue, a distance of 112.32 feet to the POINT OF BEGINNING. SECTION 2. THAT the owners of said tract, including Charles Bolton and Scott Bolton, BE offered through the Right -of -Way Department of the City of Lubbock the amount of $1,655.00, which is the amount appraised as the value and total damages for the fee simple title and acquisition of said real estate hereinabove described, for the use and benefit of the City of Lubbock, Texas, for the purposes herein stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the fee simple title to said land as hereinabove described for public purposes and municipal purposes.
