RESOLUTION

WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located
in Lubbock County, Texas, has determined and does hereby determine that the
public needs, safety and welfare demand and create a public necessity for
the acquisition of additional land for municipal public uses and purposes,
to -wit: for the Quirt Avenue and East 34th Street overpass project, and
this City Council of said City finds it in the public interest and for
public purposes and municipal purposes to proceed with the acquisition of
lands as needed for such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described
tract of land located in Lubbock County, Texas, be acquired for public
purposes and municipal purposes as set forth in the preamble hereof,
to -wit:
A tract of land out of that certain tract situated in the City of
Lubbock, Lubbock County, Texas, being out of Lots 6 and 7, Nunley
Addition No. 1, and an unsubdivided tract out of Section 4, Block B.
said property also being the same property described in a Deed from J.
A. Nunley, Jr., Individually and as Independent Executor of the
Estates of J. A. Nunley, deceased, and Mary E. Nunley, deceased, and
Mary Frances Ricketts, Joe B. Nunley, Bessie Virginia Wells, Lloyd Lee
Nunley and Billie Mae Roenfeldt, to Dimitrios "Jimmy" Georgopoulos,
dated November 30, 1978, recorded in Volume 1618, Pages 238-240 of the
Deed Records of Lubbock County, Texas, being more particularly
described by metes and bounds in two tracts as follows:
TRACT ONE
BEGINNING at a point in the existing east right-of-way line of Quirt
Avenue, said point being the northwest corner of said unsubdivided
tract and South 2023156" West, a distance of 655.02 feet and South
87036104" East, a distance of 60.16 feet from the northwest corner of
Section 4, Block B;
THENCE, South 87036122" East along
tract, a distance of 23.50 feet to
right-of-way line of Quirt Avenue;
the north line of said unsubdivided
a point in the proposed east
THENCE, South 3°18'24" West along the proposed east right-of-way line
of Quirt Avenue, a distance of 181.34 feet to a point;
THENCE, South 90131431' West along the proposed east right-of-way line
of Quirt Avenue, a distance of 135.00 feet to a point in the south
line of said unsubdivided tract;
THENCE, North 87036122" West along the south line of said unsubdivided
tract, a distance of 4.50 feet to a point in the existing east
right-of-way line of Quirt Avenue;
THENCE, North 2°23108" East along the existing east right-of-way line
of Quirt Avenue, a distance of 315.36 feet to the POINT OF BEGINNING.
TRACT TWO
BEGINNING at a point in the existing east right-of-way line of Quirt
Avenue, said point being the southwest corner of Lot 7 and North
87037'53" West, a distance of 228.55 feet from the southernmost,
southeast corner of Lot 5, Nunley Addition No. 1;
THENCE, North 2023108" East along the existing east right-of-way line
of Quirt Avenue, a distance of 380.96 feet to a point being the
northernmost point of Lot 6;
THENCE, Southeasterly along a curve to the right, along the north line
of Lot 6, said curve having a radius of 1850.08 feet and a radial
bearing of South 30050108" West, a distance of 102.53 feet along said
curve to a point on a curve of the proposed east right-of-way line of
Quirt Avenue;
THENCE, Southwesterly along said curve to the left, having a radius of
40.00 feet and a radial bearing of South 28°52'45" West, a distance of
80.32 feet along said curve to a point in the proposed east right-of-
way line of Quirt Avenue;
THENCE, South 3°49133" West along the proposed east right-of-way line
of Quirt Avenue, a distance of 294.94 feet to a point in the south
line of Lot 7;
THENCE, North 87037'53" West along the south line of Lot 79 a distance
of 23.50 feet to the POINT OF BEGINNING.
SECTION 2. THAT the owners of said tract, including Dimitrios
"Jimmy" Georgopoulos, BE offered through the Right -of -Way Department of the
City of Lubbock the amount of $8,776.00, which is the amount appraised as
the value and total damages for the fee simple title and acquisition of
said real estate hereinabove described, for the use and benefit of the City
of Lubbock, Texas, for the purposes herein stated, and unless accepted

forthwith, the City Attorney of said City of Lubbock is hereby authorized
and instructed to institute condemnation (eminent domain) proceedings to
acquire the fee simple title to said land as hereinabove described for
public purposes and municipal purposes.
Passed by the City Council this 9th day of August , 1984.
