WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located
in Lubbock County, Texas, has determined and does hereby determine that the
public needs, safety and welfare demand and create a public necessity for
the acquisition of additional land for municipal public uses and purposes,
to -wit: for the Quirt Avenue and East 34th Street overpass project, and
this City Council of said City finds it in the public interest and for
public purposes and municipal purposes to proceed with the acquisition of
lands as needed for such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described
tract of land located in Lubbock County, Texas, be acquired for public
purposes and municipal purposes as set forth in the preamble hereof,
to -wit:
A tract of land out of that certain tract situated in the City of
Lubbock, Lubbock County, Texas, being out of the West 300 feet of the
South 1/2 of Lot 1, Block 6, Nelson -Brown Addition, said property also
being the same property described in a Deed from Southwest Canvas
Manufacturing Co., to George E. Bullard, dated March 22, 1977,
recorded in Volume 1515, Page 300 of the Deed Records of Lubbock
County, Texas, being more particularly described by metes and bounds
as follows:
BEGINNING at a point in the existing west right-of-way line of Quirt
Avenue, said point being the northeast corner of the West 300 feet of
the South 1/2 of Lot 1 and South 87°35'59" East, a distance of 300.00
feet from the northwest corner of the West 300 feet of the South 1/2
of Lot 1;
THENCE, South 2024102" West along the existing west right-of-way line
of Quirt Avenue, a distance of 105.00 feet to a point in the proposed
west right-of-way line of Quirt Avenue;
THENCE, North 8054134" West along the proposed west right-of-way line
of Quirt Avenue, a distance of 107.08 feet to a point in the north
line of the West 300 feet of the South 1/2 of Lot 1;
THENCE, South 87035159" along the north line of the West 300 feet of
the South 1/2 of Lot 1, a distance of 21.00 feet to the POINT OF
BEGINNING.
SECTION 2. THAT the owners of said tract, including George E.
Bullard, BE offered through the Right -of -Way Department of the City of
Lubbock the amount of $713.00, which is the amount appraised as the value
and total damages for the fee simple title and acquisition of said real
estate hereinabove described, for the use and benefit of the City of
Lubbock, Texas, for the purposes herein stated, and unless accepted
forthwith, the City Attorney of said City of Lubbock is hereby authorized
and instructed to institute condemnation (eminent domain) proceedings to
acquire the fee simple title to said land as hereinabove described for
public purposes and municipal purposes.
