Ruff, Court Reporter, attached herewith, which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Ruff, Court Reporter, hereinafter referred to as "Reporter". WITNESSETH: City and Reporter mutually agree as follows: 1. SCOPE OF SERVICES The Reporter hereby agrees and binds himself to furnish to City one Certified Court Reporter who will provide necessary court reporting services to the City's Municipal Court of Record established in accordance with Art. 1200gg, Vernon's Annotated Texas Statutes. In addition, Reporter agrees in those instances where more than one reporter is needed to adequately perform the services herein contemplated, that he will upon request provide an additional court reporter to City. 2. COMPENSATION City hereby agrees to compensate Reporter at the rate of $9,600.00 per year for a full-time reporter furnished to the City as hereinabove provided. It is further agreed that in the event that an additional court reporter is required, Reporter agrees to provide such services at no additional cost to the City. 3. PERIOD OF CONTRACT This contract shall take effect on its date of execution hereinafter set forth and shall remain in effect until termination by either party as hereinafter provided. 4. INDEPENDENT CONTRACTOR Nothing contained herein shall be construed as creating the relationship of employer and employee between City and Reporter, and the Reporter shall be deemed at all times to be an independent contractor. • S. INDIGENT DEFENDANT In the event that the court orders the Reporter to prepare a record on appeal without charge to the defendant, the City shall pay for the record at the same rate that is charged for the same service in the County Courts at Law of Lubbock County. 6. TERMINATION This contract may be terminated by either party upon the giving of 30 days written notice of said party's intention to terminate this contract. Notices shall be sufficiently given if they are addressed to: City of Lubbock, Texas, Legal Department, P.O. Box 2000, Lubbock, Texas, 79457, and to Reporter at: Curtis D. Ruff & Associates, Certified Shorthand Reporters, 1014 Broadway, Lubbock, Texas, 79401. EXECUTED as of the date hereinabove first written.
