WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located
in Lubbock County, Texas, has determined and does hereby determine that the
public needs, safety and welfare demand and create a public necessity for
the acquisition of additional land for municipal public uses and purposes,
to -wit: for the widening of North Quaker Avenue, and this City Council of
said City finds it in the public interest and for public purposes and
municipal purposes to proceed with the acquisition of lands as needed for
such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described
tracts of land located in Lubbock County, Texas, be acquired for public
purposes and municipal purposes as set forth in the preamble hereof,
to -wit:
TRACT ONE
A parcel of land located in Section 5, Block J -S, Lubbock County,
Texas, being further described as follows:
BEGINNING at a set 60 penny nail which bears S. 00°06152" E. a
distance of 500.00 feet from the Northeast corner of Section 5, Block
J -S, Lubbock County, Texas, said point being the Northeast corner of
said tract, and the Northeast corner of said right-of-way tract;
THENCE S. 00°06152" E. along the East line of Section 5 and along the
East line of said tract, a distance of 100.00 feet to a 60 penny nail
set in the East line of said Section 5, for the Southeast corner of
said tract and for the Southeast corner of said right-of-way tract and
for the Northeast corner of a tract conveyed to Warren G. Langley in
Volume 1769, Page 243 of the Deed Records of Lubbock County, Texas;
THENCE West, along the South line of said tract, a distance of 40.00
feet to a 1/2" iron rod set for the Southwest corner of said right-of-
way tract;
THENCE N. 00006152" W. a distance of 100.00 feet to a 1/2" iron rod
set in the North line of said tract, for the Northwest corner of said
right-of-way tract;
THENCE East, along the North line of said tract, a distance of 40.00
feet to the POINT OF BEGINNING.
TRACT TWO
A portion of a tract conveyed to Warren G. Langley in Volume 1769,
Page 243, and a portion of a tract conveyed to W. G. Langley and his
wife, Jean Langley, in Volume 1209, Page 429 of the Deed Records of
Lubbock County, Texas, located in Section 5, Block J -S, Lubbock
County, Texas, being further described as follows:
BEGINNING at a point which bears S. 00006152" E. a distance of 600.00
feet from the Northeast corner of Section 5, Block J -S, Lubbock
County, Texas, said point being the Northeast corner of said Langley
tract for the Northeast corner of this tract;
THENCE S. 00006152" E., along the East line of Section 5, and along
the East line of said Langley tract, at 50.0 feet pass a 60 penny nail
set in the East line of said Section 5 and the Southeast corner of
said Langley tract for the Northeast corner of said Langley and wife
tract, continuing along the East line of said Section 5 and along the
East line of said Langley and wife tract for a total distance of
150.00 feet to a 60 penny nail set for the Southeast corner of said
Langley and wife tract and for the Southeast corner of this tract;
THENCE West, along the South line of said Langley and wife tract, a
distance of 40.00 feet to a 1/2" iron rod set for the Southwest corner
of this tract;
THENCE N. 00006152" W., at 100.0 feet pass a 1/2" iron set in the
North line of said Langley and wife tract and in the South line of
said Langley tract, continuing for a total distance of 150.00 feet to
a 1/2" iron rod set in the North line of said Langley tract, for the
Northwest corner of this tract;
THENCE East, along the North line of said Langley tract, a distance of
40.00 feet to the POINT OF BEGINNING.
TRACT THREE
A portion of a tract conveyed to Warren G. Langley in Volume 1478,
Page 673 of the Deed Records of Lubbock County, Texas, located in
Section 5, Block J -S, Lubbock County, Texas, being further described
as follows:
BEGINNING at a set 60 penny nail which bears S. 00006152" E. a
distance of 1336.00 feet from the Northeast corner of Section 5, Block
J -S, Lubbock County, Texas, said point being the Northeast corner of
said Langley tract;

THENCE S. 00006152" E. along the East line of Section 5 and along the
East line of said Langley tract, a distance of 94.00 feet to a 60
penny nail set in the East line of said Section 5 for the Southeast
corner of said Langley tract and for the Southeast corner of this
tract;
THENCE West, along the South line of said Langley tract, a distance of
40.00 feet to a 1/2" iron rod set for the Southwest corner of this
tract;
THENCE N. 00006152" W. a distance of 94.00 feet to a 1/2" iron rod set
in the North line of said Langley tract, for the Northwest corner of
this tract;
THENCE East, along the North line of said Langley tract, a distance of
40.00 feet to the POINT OF BEGINNING.
TRACT FOUR
A portion of a tract conveyed to Warren G. Langley in Volume 1769,
Page 243 of the Deed Records of Lubbock County, Texas, located in
Section 5, Block J -S, Lubbock County, Texas, being further described
as follows:
BEGINNING at a set 60 penny nail which bears S. 00006152" E. a
distance of 2197.00 feet from the Northeast corner of Section 5, Block.
J -S, Lubbock County, Texas, said point being the Northeast corner of
said Langley tract for the Northeast corner of this tract;
THENCE S. 00006152" E., along the East line of Section 5 and along the
East line of said Langley tract, a distance of 212.00 feet to a 60
penny nail set in the East line of said Section 5 and for the South-
east corner of said Langley tract and for the Southeast corner of this
tract;
THENCE West, along the South line of said Langley tract, a distance of
40.00 feet to a 1/2" iron rod set for the Southwest corner of this
tract;
THENCE N. 00006152" W. a distance of 212.00 feet to a 1/2" iron rod
set in the North line of said Langley tract, for the Northwest corner
of this tract;
THENCE East, along the North line of said Langley tract, a distance of
40.00 feet to the POINT OF BEGINNING.

SECTION 2. THAT the owners of said tracts, including Warren G.
Langley and his wife, Jean Langley, BE offered through the Right -Of -Way
Department of the City of Lubbock the amount of $9,060.00, which is the
amount appraised as the value and total damages for the fee simple title
and acquisition of said real estate hereinabove described, for the use and
benefit of the City of Lubbock, Texas, for the purposes herein stated, and
unless accepted forthwith, the City Attorney of said City of Lubbock is
hereby authorized and instructed to institute condemnation (eminent domain)
proceedings to acquire the fee simple title to said land as hereinabove
described for public purposes and municipal purposes.
