HomeMy WebLinkAboutResolution - 1990 - Right Of Way Offer - LC Hill - N Quaker Ave Widening, Sec 5 Block J-S - 04/11/1985HW:js RFSnI I IT TnN Resolution #1990 April 11, 1985 Agenda Item #24 WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal public uses and purposes, to -wit: for the widening of North Quaker Avenue, and this City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of lands as needed for such purposes as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title to the following described tracts of land located in Lubbock County, Texas, be acquired for public purposes and municipal purposes as set forth in the preamble hereof, to -wit: TRACT ONE A portion of a tract conveyed to L. C. Hill in Volume 1207, Page 571, and in Volume 1804, Page 978 of the Deed Records of Lubbock County, Texas, located in Section 5, Block J -S, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears S. 00°06'52" E. a distance of 750.00 feet from the Northeast corner of Section 5, Block J -S, Lubbock County, Texas, said point being the Northeast corner of said Hill tract for the Northeast corner of this tract; THENCE S. 0006152" E., along the East line of Section 5, and along the East line of said Hill tract, a distance of 430.00 feet to a 60 penny nail set in the East line of said Section 5 for the Southeast corner of said Hill tract and for the Southeast corner of said Hill tract and for the Southeast corner of this tract; THENCE West, along the South line of said Hill tract, a distance of 40.00 feet to a 1/2" iron rod set for the Southwest corner of this tract; THENCE N. 00°06152" W., a distance of 430.00 feet to a 1/2" iron rod set in the North line of said Hill tract, for the Northwest corner of this tract; THENCE East, along the North line of said Hill tract, a distance of 40.00 feet to the POINT OF BEGINNING. TRACT TWO A portion of that tract conveyed to L. C. Hill in Volume 1804, Page 978 s'" of the Deed Records of Lubbock County, Texas, located in Section 5, Block J -S, Lubbock County, Texas, being further described as follows: BEGINNING at a set 60 penny nail which bears S. 00006152" E. a distance of 1886.00 feet to the Northeast corner of Section 5, Block J -S, Lubbock County, Texas, said point being the Northeast corner of said Hill tract, for the Northeast corner of this tract; THENCE S. 00006152" E., along the East line of Section 5 and along the East line of said Hill tract, a distance of 311.00 feet to a 60 penny nail set in the East line of said Section 5 and for the Southeast corner of said Hill tract and for the Southeast corner of this tract; THENCE West, along the South line of said Hill tract, a distance of 40.00 feet to a 1/2" iron rod set for the Southwest corner of this tract; THENCE N. 00006152" W. a distance of 311.00 feet to a 1/2" iron rod set in the North line of said Hill tract, for the Northwest corner of this tract; THENCE East, along the North line of said Hill tract, a distance of 40.00 feet to the POINT OF BEGINNING. SECTION 2. THAT the owner of said tracts, including L. C. Hill, BE offered through the Right -Of -Way Department of the City of Lubbock the amount of $9,677.00, which is the amount appraised as the value and total damages for the fee simple title and acquisition of said real estate hereinabove described, for the use and benefit of the City of Lubbock, Texas, for the purposes herein stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire the fee simple title to said land as hereinabove described for public purposes and municipal purposes.
