BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock an Agreement
by and between the City of Lubbock and the City of Wolfforth to Apportion
an Area of Overlapping Extraterritorial Jurisdiction, attached herewith,
which shall be spread upon the minutes of the Council and as spread upon
the minutes of this Council shall constitute and be a part of this Res-
olution as if fully copied herein in detail.

AGREEMENT
§
Resolution #1988
Between the City of Lubbock, Texas, and the City of
Wolfforth, Texas, to Apportion an Area of Overlapping Extra-
territorial Jurisdiction.
Whereas, the City of Lubbock, Texas, and the City of
Wolfforth, Texas, have extraterritorial Jurisdiction of an
overlapping area, they hereby mutually agree pursuant to V.A.C.S.
Article 970x, Section 3(B) of the Municipal Annexation Act, to
apportion said area as herein described and indicated on the
attached map marked Exhibit A, said Exhibit being expressly
incorporated into and for all purposes made a part of this
Agreement.
The area to be apportioned to the City of Wolfforth is more
particularly described as follows:
Beginning at a point 2640 feet South of the Northwest
section corner of Section 22, Block D-6, Lubbock County,
Texas;
Thence East 15,840 feet along the half section lines of
Section 22, Block D-6, Lubbock County, Texas; Section 21,
Block D-6, Lubbock County, Texas; and Section 32, Block AK,
Lubbock County, Texas; to a point 2640 feet South of the
Northeast section corner of Section 32, Block AK, Lubbock
County, Texas;
Thence South 18,480 feet along the East section lines of
Section 32, Block AK, Lubbock County, Texas; Section 25,,
Block AK, Lubbock County, Texas; Section 24, Block AK,
Lubbock County, Texas; and Section 17, Block AK, Lubbock
County, Texas; to a point which is the Southeast corner of
Section 17, Block AK, Lubbock County, Texas;
Thence West approximately 10,560 feet along the South
section lines of Section 17, Block AK, Lubbock County,
Texas; and Section 29, Block CB, Lubbock County, Texas, to a
point which Is the Southwest corner of Section 29, Block CB,
Lubbock County, Texas;

Lubbock County, Texas; and Section 17, Block AK, Lubbock
County, Texas; to a point which is the Southeast corner of
Section 17, Block AK, Lubbock County, Texas;
Thence West approximately 10,560 feet along the South
section lines of Section 17, Block AK, Lubbock County,
Texas; and Section 29, Block CB, Lubbock County, Texas, to a
point which Is the Southwest corner of Section 29, Block CB,
Lubbock County, Texas;
Thence Northwesterly along a curve approximately 19,800
feet, said curve established as the five mile radius of a
circle, the center being the Northeast corner of
Section 27, Block AK, Lubbock County, Texas, to the point of
beginning.
According to V.A.C.S. Article 970a, Section 3(B), this
agreement shall be approved by resolution adopted by the govern-
ing bodies of both cities.
In the event that either the City of Lubbock or the City of
Wolfforth annexes additional territory, the extraterritorial
Jurisdiction of the nonannexing city may be reduced by obtaining
the written consent of the governing body of such city in
accordance with the provisions of V.A.C.S. Article 970a, Section
3(C).
The parties further agree that should any plat be submitted
under the provisions of V.A.C.S. Article 974a and be located on
or immediately adjacent to the shared boundary herein agreed to
or as it may be later amended, such plat shall be in every
Instance submitted to the other city for that city's review and
comment, prior to the city who received the original submission
taking any final action to approve or deny said plat. This
review and comment is Intended to be advisory in nature and in no
way binding, nor should It in any way Interfere with the time
limits set out In V.A.C.S. Article 974a.

Dear Gentlemen:
The "agreement" apportioning an area of overlapping ETJ has been
approved by a resolution of the governing body of the City of
Wolfforth.
Please note that the agreement does not contain much of the
negotiations that occurred by and between the governing bodies
and other representatives of the subject cities.
Understandably, your governing body cannot bind future councils
but it has been the steadfast position of the City of Wolfforth
that it has been assured that the City of Lubbock does not desire
to surround it but that the open area to the west, being an
extension along the north and south boundary lines would be
favorably endorsed by the governing body, and your planning
department.
