HomeMy WebLinkAboutResolution - 1967 - Right Of Way Offer-Powell Adams Et Al-E 19Th Widening, 1.282 Acres Sec 2 Block B - 03/14/1985EB:ck RESOLUTION Resolution #1967 Agenda Item #18 March 14, 1985 WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal public uses and purposes, to -wit: for the widening of East 19th Street, and this City'Council of said purposes to proceed with the acquisition of lands as needed for such purposes as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title to the following described tract of land located in Lubbock 0buntyp Texas, be acquired for public purposes and municipal purposes as set forth in the preamble hereof, to -wit: METES AND BOUNDS DESCRIPTION of a portion of that tract conveyed to W.T. Adams in Volume 916, Page 459, Deed Records of Lubbock County, Texas, located in Section 2, Block B, Lubbock County, Texas, being further described as follows: BEGINNING at a 5/8" iron rod with cap set in the North line of Section 2, for the. Northwest corner of this tract which bears N. 89041110" E. a distance of 1320.06 feet from the Northwest corner of Section 2, Block B, Lubbock County, Texas; THENCE N. 89041110" E., along the North line of Section 2, a distance of 1320.05 feet to a 5/8" iron rod with cap set for the Northeast corner of this tract, same being the Northeast corner of the Northwest Quarter of Section 2; THENCE S. 00003104" E. a distance of 45.00 feet to a 5/8" iron rod with cap set for the Southeast corner of this tract; THENCE S. 89041'10" W. a distance of 919105 feet to a 5/8" iron rod with cap set for a corner of this tract; THENCE N. 87046'23" W. a distance of 400.35 feet to a 5/8" iron rod with cap set for a corner of this tract; THENCE S. 89°34' W. a distance of 0.98 feet to a 5/8" iron rod set for the Southwest corner of this tract; THENCE N. 00°01' W. a distance of 27.25 feet to the POINT OF BEGINNING. SECTION 2. THAT the owners of said tract, including C. Powell Adams and Thomas D. Adams, Trustees of the W.T. Adams Trust under the will of W.T. Adams, deceased; C. Powell Adams and Wife, Carol Adams; and Life Estate of Truey L. Adams, A Widow, BE offered through the Right -Of -Way Department of the City of Lubbock the amount of $3,943, which is the amount appraised as the value and total damages for the fee simple title and ac- quisition of said real estate hereinabove described, for the use and benefit •1, .r . of the City of Lubbock, Texas, for the purposes herein stated,, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) pro- ceedings to acquire the fee simple title to said land as hereinabove described for public purposes and municipal purposes.
