HomeMy WebLinkAboutResolution - 2062 - Contract - AIC - Archaeological Monitoring, NW Sanitary Relief Main - 06/14/1985JWF:cl RESOLUTION Resolution #2062 June 14, 1985 Agenda Item #45 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of said City, an Agreement to be entered into by and between said City and Anthropological Investigative Consultants (herein called "A.I.C.") for archaeological monitoring and processing thereof by A.I.C. in connection with a sanitary sewer main from Sixth Street and Oak Avenue to First Street and Avenue K, in the City of Lubbock, Lubbock County, Texas, attached herewith, which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Watson, Chief Engineer Water Utilities APPROVED AS TO FORM: Kms" 9A J. rth Fullingim, Assistant C' Attorney June wnnr STATE OF TEXAS § COUNTY OF LUBBOCK § r%n KITOAPT Resolution #2062 This agreement made and entered into effective the 20th day of May, 1985, by and between the City of Lubbock, acting by and through Alan Henry, Mayor, thereunto authorized to do so, hereinafter referred to as City and Anthropological Investigative Consultants of Lubbock, Texas, and hereinafter referred to as A.I.C., do hereby agree as follows: (1) A.I.C. agrees to conduct archaeological monitoring for the Sanitary Sewer Main which extends from Sixth Street and Oak Avenue to First Street and Avenue K as described in the cultural resource survey for Texas Antiquities Permit No. 380, in ac- cordance with the budget proposal submitted by A.I.C. which is attached hereto and made a part hereof as Exhibit A. A.I.C. agrees that all work will be done in accordance with the guide- lines for the National Environmental Policy Act of 1969, the Texas Antiquities Law, and all other applicable federal and state laws and regulations. A.I.C. agrees to furnish labor necessary to complete the survey. A.I.C. agrees to notify the City of Lubbock and Texas Parks and Wildlife immediately of any signi- ficant findings or findings of public interest. (2) The City of Lubbock agrees to pay A.I.C. in accordance with the rates on the attached fee schedule made a part hereof as Exhibit A. Resolution #2062 (3) It is estimated that the work to be done by A.I.C. under this Agreement shall be completed on or about November 23, 1985, or as soon thereafter as practicable under the circum- stances as required by appropriate monitoring and processing thereof by A.I.C. under this agreement. This agreement being effective as of the 20th day of May, 1985 as hereinabove stated is executed the 14th day of June , 1985, in the City of Lubbock, Lubbock County, Texas, and performable in said City, County and State. Resolution #2062 EXHIBIT A BUDGET PROPOSAL AND FEE SCHEDULE ANTHROPOLOGICAL INVESTIGATIVE CONSULTANTS 1904 Fifth Street Lubbock, Texas 79401 Projected archaeological monitoring expenditures for the Northwest Sanitary Relief Main. Anticipated project dates - May 20, 1985 through November 23, 1985 - 27 weeks or 134 work days. Field work to be conducted in a 5 day work week. Hours 7:30 a.m. till 6:00 p.m. for a 10 hour day. If evidence is recovered and it is deemed necessary that a full report be submitted, 20 copies of the final report will be billed as follows: Final Report Preparation 0$15.00 X 54 hours Word Processing Cartographer Photographic Reproduction Report Duplication and Binding Postage/Federal Express 810.00 325.00 200.00 140.00 385.50 60.60 19921.00 $29,619.40 Total Additional Consultants will only be added if deemed necessary by Texas Parks and Wildlife and discussed with the City of Lubbock before hiring (soils analyst, geologist, geomorphologist, etc.) Billing Procedure: Bill will be totaled the last day of each month, beginning May 319 1985, and presented to the City of Lubbock by the fifth day of the following month. Remittance to A.I.C. will be due on the fifteenth. Should archaeological evidence be located, A.I.C. will request that construction activity be relocated to a different section of the sewer line. The City of Lubbock and Texas Parks and Wildlife will be notified and the Texas Antiquities Committee will be notified. Avoidance will be opted for in all instances. If the line cannot be diverted, mitigation procedures will be initiated and a new budget for mitigation will be submitted. -2-
