RESOLUTION

WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located
in Lubbock County, Texas, has determined and does hereby determine that the
public needs, safety and welfare demand and create a public necessity for
the acquisition of additional land for municipal public uses and purposes,
to -wit: for the widening of North Quaker Avenue, and the City Council of
said City finds it in the public interest and for public purposes and
municipal purposes to proceed with the acquisition of lands as needed for
such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described
tracts of land located in Lubbock County, Texas, be acquired for public
purposes and municipal purposes as set forth in the preamble hereof,
to -wit:
TRACT ONE
A portion of a tract located in Section 14, Block A, Lubbock County,
Texas, being further described as follows:
BEGINNING at a set 60 penny nail which bears N. 00003'10" W. a
distance of 699.30 feet from the Southeast corner of Section 14, Block
A, said point being the Northeast corner of said tract and the corner
of a tract conveyed to Robert Richard Gressett and his wife, Nancye J.
Gressett, in Volume 1600, Page 255 of the Deed Records of Lubbock
County, Texas, and at the Northeast corner of said right-of-way tract;
THENCE S. 00003110" E., along the East line of Section 14 and along
the East line of said tract, a distance of 59.3 feet to a 60 penny
nail set in the East line of said Section 14 for the Southeast corner
of said tract and for the Southeast corner of said right-of-way tract
and for the Northeast corner of a tract conveyed to Virgil Truman
Bramlett in Volume 1761, Page 534 of the Deed Records of Lubbock
County, Texas;
THENCE West, along the South line of said tract, a distance of 50.50
feet to a 1/2" iron rod set for the Southwest corner of said right-of-
way tract;
THENCE N. 00003110" W. a distance of 59.30 feet to a 1/2" iron rod set
in the North line of said tract for the Northwest corner of said
right-of-way tract;
THENCE East, along the North line of said tract, a distance of 50.50
feet to the POINT OF BEGINNING.
TRACT TWO
A portion of a tract conveyed to M. L. Pirtle in Volume 1290, Page 13
of the Deed Records of Lubbock County, Texas, located in Section 14,
Block A, Lubbock County, Texas, being further described as follows:
BEGINNING at a set 60 penny nail which bears N. 00003110" W., a
distance of 349.6 feet from the Southeast corner of Section 14, Block
A, Lubbock County, Texas, said point being the Northeast corner of
said Pirtle tract for the Northeast corner of this tract;
THENCE S. 00°03110" E., along the East line of Section 14 and along
the East line of said Pirtle tract, a distance of 145.2 feet to a 60
penny nail set in the East line of said Section 14 for the Southeast
corner of said Pirtle tract and for the Southeast corner of this
tract;
THENCE West, along the South line of said Pirtle tract, a distance of
55.41 feet to a 1/2" iron rod set for the Southwest corner of this
tract;
THENCE N. 01041142" W. a distance of 78.64 feet to a 1/2" iron rod
set;
THENCE N. 02043158" E. a distance of 66.68 feet to a 1/2" iron rod set
in the North line of said Pirtle tract, for the Northwest corner of
this tract;
THENCE East, along the North line of said Pirtle tract, a distance of
54.43 feet to the POINT OF BEGINNING.
SECTION 2. THAT the owners of said tract, including M. L. Pirtle, BE
offered through the Right -Of -Way Department of the City of Lubbock the
amount of $12,204.00, which is the amount appraised as the value and total
damages for the fee simple title and acquisition of said real estate
hereinabove described, for the use and benefit of the City of Lubbock,
Texas, for the purposes herein stated, and unless accepted forthwith, the
City Attorney of said City of Lubbock is hereby authorized and instructed

to institute condemnation (eminent domain) proceedings to acquire the fee
simple title to said land as hereinabove described for public purposes and
municipal purposes.
