BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock a Memorandum
Agreement between the Texas Parks and Wildlife Department and the City of
Lubbock dealing with the allocation of funds from oil, gas and mineral
leases on property assisted by Project Numbers 48-00022 and 48-00755,
attached herewith, which shall be spread upon the minutes of the Council
and as spread upon the minutes of this Council shall constitute and be a
part of this Resolution as if fully copied herein in detail, and any
subsequent Memorandum between the same parties and covering the same
subject as above-mentioned.

MEMORANDUM OF AGREEMENT
BETWEEN
THE TEXAS PARKS AND WILDLIFE DEPARTMENT
AND
THE CITY OF LUBBOCK
The purpose of this agreement is to legally and properly allocate funds
derived from oil, gas and minerals rentals and leases and royalty incomes from
property which belongs to the City of Lubbock and which property was assisted
by the Land and Water Conservation Fund under Project Number 48-00022, and
Project Number 48-00755.
It is hereby agreed that the income derived from this property shall
be utilized in accordance with this agreement in the following manner.
It is further understood that the income will be divided into two categories,
these categories being income dreived from rentals and leases, and the other
being income from royalty payments. Income derived from rentals and leases shall
be placed in a separate account and shall be used for outdoor recreation capital
outlay improvements and/or acquisition of additional parkland for the Lubbock
Parks and Recreation System. Disposition of income from royalty payments
(production of oil and gas minerals from the site) will also be placed in' the
separate account and may be used for capital outlay improvement projects and/or
the acquisition of additional parkland for the City of Lubbock Parks and
Recreation System.
It is further understood that within one year of the date this Memorandum
is executed the City of Lubbock shall provide to Texas Parks and Wildlife
Department and the National Park Service a plan for outdoor recreational
development of land acquired through Project Number 48-00022. Income derived
as a result of this Memorandum may be used for this development.
It will be the responsibility of the City of Lubbock to provide the Texas
Parks and Wildlife Department with a yearly financial report on the funds covered
by this agreement. This agreement is subject to the approval of the National Park
Service or the appropriate agency of the Department of the Interior. This
agreement may be amended or changed at any time with the concurrence of both
parties and the approval of the National Park Service or the appropriate
agency of the Department of the Interior. This agreement supercedes any
previous agreement involving the referenced projects.
