Lubbock, Texas, calling a bond election to be
held within said City, making provision for the
conduct of the election and other provisions
incident and related to the purpose of this
resolution.
WHEREAS, the City Council of the City of Lubbock, Texas,
has determined that an election should be held to ascertain
whether said governing body shall be authorized to issue bonds
of said City in the amount and for the purpose hereinafter
mentioned; therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK,
TEXAS:
SECTION 1: An election shall be held on the 18th day of
January, 1986, which date is not less than fifteen (15) nor
more than ninety (90) days from the date of the adoption
hereof, at which election the following proposition shall be
submitted:
"SHALL the City Council of the City of Lubbock,
Texas, be authorized to issue revenue bonds of said
City, in the amount of $2,500,000 maturing serially or
otherwise in such installments as may be fixed by the
City Council, the maximum maturity being not more than
FORTY (40) years from their date, to be issued and
sold at any price or prices and to bear interest at
any rate or rates as shall be determined within the
discretion of the City Council at the time of
issuance, for the purpose of making permanent public
improvements, to wit: construction of improvements to
a park (landscaping, fencing, activity center,
amphitheater and other recreational facilities in
Mackenzie State Park), to be issued in accordance with
and in the manner provided in Article 1111 et seq
V.A.T.C.S., and secured by a pledge of the net
revenues of the City's park system, each bond to be
conditioned that the holder thereof shall never have
the right to demand payment of said obligation out of
funds raised or to be raised by taxation?
SECTION 2: The City shall be divided into fifty-three (53)
election precincts for this election and the polling places
designated for each election precinct and the persons hereby
appointed to serve as Presiding Judge and Alternate Presiding
Judge for each polling place are shown in Exhibit "A", which is
attached hereto and incorporated herein by reference as a part
hereof for all purposes.
Each Presiding Judge shall appoint not less than two (2)
nor more than three (3) qualified clerks to serve and assist in
holding said election; provided that if the respective
Presiding Judge herein appointed actually serves, the Alternate
Presiding Judge of his polling place shall be one of the clerks.
On election day the polls shall be open from 7:00 A.M. to
7:00 P.M.
Absentee voting shall be conducted at the City Secretary's
office in the City Hall, in accordance with the provisions of
V.A.T.S. Election Code, Chapter 5.
The Central Counting Station for the tabulation and
counting of ballots for said election shall be located at
the and the following persons

The Manager and Presiding Judge of the Central Counting
Station shall appoint clerks to serve at such station, as
provided by Chapter 7 of the Election Code.
SECTION 3: That an electronic voting system shall be used
at each polling place on the date of the election and paper
ballots shall be used for absentee voting by personal
appearance and by mail.
Ballots for the electronic voting system and the paper
ballots for absentee voting shall be printed and arranged in
accordance with applicable provisions of the Election Code to
enable voters to vote either "FOR" or "AGAINST" the aforesaid
proposition, which shall be set forth on the respective ballots
in substantially the following form:
"THE ISSUANCE OF $2,500,000 PARK REVENUE BONDS FOR
PARK IMPROVEMENTS (LANDSCAPING, FENCING, ACTIVITY
CENTER, AMPHITHEATER AND OTHER RECREATIONAL
FACILITIES) IN MACKENZIE STATE PARK"

SECTION 4: All resident qualified electors of the City
shall be permitted to vote at said election and on the day of
the election, such electors shall vote at the polling place
designated for the Election Precinct in which they reside.
This election shall be held and conducted in accordance with
the Texas Election Code, except as modified by Chapter 1 of
Title 22, V.A.T.C.S., and as may be required by law, all
election materials and proceedings shall be printed in both
English and Spanish.
SECTION 5: A substantial copy of this resolution shall
serve as proper notice of said election. Said notice,
including a Spanish translation thereof, shall be posted at
three (3) public places within the City, and at the City Hall
not less than fourteen (14) full days prior to the date on
which said election is to be held, and be published on the same
day in each of two successive weeks in a newspaper of general
circulation in said City, the first of said publications to be
made not less than fourteen (14) full days prior to the date
set for said election.

TAKE NOTICE that an election will be held in the CITY OF
LUBBOCK on the 18th day of January, 1986, in accordance with a
resolution duly entered by the City Council which is a part of
this notice for all purposes and reads as follows: -

A LOS RESIDENTES CON DERECHO DE VOTAR
DE LA CIUDAD DE LUBBOCK, TEXAS:
AVISO de que/ una eleccion tendra lugar en la ciudad de
Lubbock,exas, el dia 18 de enero de 1986, de acuerdo con una
resoluci n aprobada por el Concejo Municipal la cual es parte
de este Aviso para todo objeto practico y se lee tomo sigue:
UNA RESOLUCION por el Concejo Municipal de la Ciudad
de Lubbock, Texas, declarando una eleccion de
bonos a tener lugar dentro de dicha Ciudad,
estableciendo medidas para dirigir is eleccion y
para otras estipulaciones que acompanen odue
sean pertinentes al proposito de esta resolucidn.
VISTO QUE, el Concejo Municipal de la Ciudad de
Lubbock, Texas, ha determinado que se debe llevar a cabo una.
eleccion para determinar si dicho cuerpo gubernativo debera"ser
autorizado a emitir bonos de dicha Ciudad por un total y con el
fin mks adelante mencionado; por consiguiente ahora,
SE RESUELVE POR EL CONCEJO MUNICIPAL DE LA CIUDAD DE
LUBBOCK, TEXAS:
SECCION 1: Que una eleccion tenga lugar el dia18 de
enero de 1986 fecha que Po s antes

ni mas que noventa (90) di.as despues de la fecha de aprobacion
de esto;/ en cuya eleccion se presentara" la siguiente
proposicion:
lDEBERe el Concejo Municipal de la Ciudad de
Lubbock, Texas, ser autorizado a emitir $2,500,000 en
bonos de ingreso de dicha Ciudad a vencer en serie o
de otra forma escalonada en cuotas a ser fijadas por
el Concejo Municipal, con un vencimiento maximo no
mayor/que CUERENTA (40) ants a partir de su fecha de
emision, que sean emitidos y vendidos al precio o
precios y que devenguen inter4 al porcentaje o
porcentajes a ser determinado a voluntad del Concejo
Municipal al ser emitidos, para hater mejoras pufblicas
permanentes, a. saber: la construction de mejoras a
parques (paisaje, cercado, centro de actividad,
anfiteatro y otras facilidades de recreo en Mackenzie
State Park), a ser emitidos de acuerdo con y en la
manera contemplada en el Articulo 1111 y
subsig uientes, V.A.T.C.S., y respaldados con la.
garantia de los ingresos liquidos al sistema de parque
de la Ciudad, Cada bono redactado en forma tal que
negara al poseedor el derecho de exigir el pago de
dicha obligation con fondos obtenidos o a ser
obtenidos por medio de impuestos?"

ACTIVIDAD, ANFITEATRO Y OTRAS FACILIDADES DE RECREO) EN
MACKENZIE STATE PARK"

servira�como aviso adecuado de dicha eleccion. Se fijara/dicho
aviso, incluyendo una traduccion al espanol de esto en tres (3)

I still have the copy of Notice of Testing of Automatic Tabulating Equipment,
five copies of the Affidavit of Publication relating to the Notice of Testing,
the Notice of Public School of Instruction, and five copies of the Affidavit of
Publication of the Notice of Public School of Instruction. I will send these to
you at the appropriate time.
You will find that the attachment to the Notice of Bond Election has been
changed in both the English and Spanish versions. We were able to get a number
of the changes of election officials taken care of and were advised by Don
Vandiver of the City Attorney's office that since this was an attachment, it
would be okay to make this change. As you can see, at the time of the
publication we still did not have all of the judges and as of today still lack a
couple. It is my plan to have all of the appointments completed by Friday,
January 3, and I will notify you when this is done that we may make any
corrections which might be needed at that time.
