HomeMy WebLinkAboutResolution - 2211 - Moratorium Permits - Billboards, Interstate Corridor - 12/13/1985JPB:js RESOLUTION Resolution #2211 December 13, 1985 Agenda Item #13 WHEREAS, the City Council of the City of Lubbock, Texas, has previous- ly passed on first reading Ordinance No. 8866 creating three new zoning classifications for use along the interstate highway corridor; and, WHEREAS, under the terms of said Ordinance No. 8866, its controls will not be fully effective to the protection of property located within the interstate highway corridor until such ordinance is passed on second reading and zone cases are heard and Ordinances passed changing zoning along the interstate corridor to the new zoning classifications; and, WHEREAS, the issuance of sign permits for billboards prior to the implementation of the full protection of Ordinance No. 8866 and any rezoning, would defeat the purposes of the Ordinance, would adversely effect property values and traffic safety within the interstate highway corridor, and would be detrimental to the best interests of the citizens of the City of Lubbock Texas; and, WHEREAS, the City Council finds that it is in the best interest of the public health, safety, and general welfare that this status quo be tempora- rily maintained in the area; and, WHEREAS, the City Council finds that the adoption of a moratorium upon the issuance of sign permits for billboards within the interstate highway corridor for a limited period not to exceed 9 months, or until the zone cases implementing such zoning classifications under the provisions of Ordinance No. 8866 can be completed, would preserve the benefits of Ordinance No. 8866 to the citizens with only minimal effects upon the development plans of the property owners within such corridor, and that such moratorium should be invoked; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the area which is the subject of the moratorium established is all of that shaded area (dot and stripe patterns) included on the map which is attached hereto and incorporated in full for all purposes as Exhibit A, to the extent that the area lies within the City of Lubbock, Texas. SECTION 2. THAT from and after the date of this Resolution as to any lot, block or tract within the area described in Section 1 hereof the building official of the City of Lubbock shall cease processing of all sign permit applications for billboards (as defined in Chapter 29 of the Lubbock Code) now pending or subsequently received, other than for routine repair and for maintenance necessary to the safety of a structure. SECTION 3. THAT this moratorium shall cease and terminate upon the effective date of the Ordinance which rezones property to the new inter- state highway zoning classification, but only for such properties as included with the rezoning Ordinance as passed. SECTION 4. THAT in no event, shall this moratorium remain in effect as to any property within the interstate highway corridor, as described in Section 1 hereof, after September 13, 1985 which is 9 months after the date of passage of this Resolution. SECTION 5. THAT upon adoption of the subsequent rezoning Ordinances as to those properties located within the area defined by each such subsequent Ordinance, or the expiration of 9 months following passage of this Resolution as to all other areas, whichever first occurs, the building official shall then proceed promptly to the processing of all such sign permit applications for billboards subject to this moratorium.
