HomeMy WebLinkAboutOrdinance - 2015-O0113 - Use Of Golf Carts During Holidays - 11/05/2015First Reading October 22, 2015 Item No. 7.7 ORDINANCE NO. 2015-00113 Second Reading November 5, 2015 Item No. 6.6 I ORDINANCE AMENDING CHAPTER 20, "TRAFFIC", OF THE CODE OF WINANCES OF THE CITY OF LUBBOCK, TEXAS, BY ADDING ARTICLE 05.011, "USE OF GOLF CARTS FOR HOLIDAY PARCEL DELIVERY"; TABLISHING RULES FOR THE USE OF GOLF CARTS FOR PARCEL ;LIVERY IN THE PUBLIC RIGHT-OF-WAY OPEN TO RESIDENTIAL ;AFFIC DURING THE HOLIDAY SEASON; ESTABLISHING SAFETY ANDARDS FOR THE GOLF CART AND ITS OPERATOR; PROVIDING A NALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR BLICATION. IEREAS, the City Council of the City of Lubbock, Texas deems it in the best interest the health, safety, and welfare of the citizens of Lubbock to amend the Code of linances to establish rules for the use of golf carts in the public right-of-way open to .dential traffic as set forth herein; and WHEREAS, the City Council finds that the use of golf carts in the public right-of-way open to residential traffic during the winter holidays will promote the timely delivery of packages, a reduction in air pollution, and the creation of jobs; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the Code of Ordinances of the City of Lubbock, Texas, is hereby amended by adding Article 20.05.011, which reads as follows: Section 20.05.011 Use of golf carts for holiday parcel delivery (a) For this Section, the following definitions shall apply: ;art. A golf cart is allowed to operate on any residential street only if: (1) said golf cart is being used: (i) for parcel delivery; (ii) during the holiday season; and (iii) within the hours of 8:00 a.m. and 6:00 p.m.; and (2) said golf cart is equipped with functioning safety features, including: (i) headlamps; (ii) tail lamps; (iii) reflectors; (iv) mirrors; (v) a parking brake; (vi) a decal displaying the operator's business name; and (vii) a slow-moving vehicle emblem as required in Texas Transportation Code Section 547.001(8) and 547.104. No golf cart will be allowed to operate on any road with a posted speed limit of than 35 mph. However, a golf cart may cross a road with a posted speed limit of more 35 mph at any intersection that utilizes a traffic -control signal. No golf cart shall emit any sound, odor, light, or visible matter which serves as a n to persons within the public right-of-way or which unreasonably disturbs or with the sleep, peace, comfort, or repose of any person with ordinary An operator of a golf cart used for the purposes of this Section, must: (1) have a valid driver's license which authorizes the operator to operate a motor vehicle on public highways; (2) obtain, and carry proof of, at least the minimum amounts of liability insurance required by under state law; and, (3) wear a reflective safety vest while operating said golf cart. It shall be unlawful for any operator to transport members of the public as rs in any golf cart used for the purposes of this Section. A violation of any provision of this Section shall be deemed a misdemeanor le as provided by Section 1.01.004 of the Code of Ordinances of the City of Texas. SECTION 2. THAT should any paragraph, section, clause, phrase or word of this rdinance be declared unconstitutional or invalid for any reason, the remainder of the rdinance shall not be affected thereby. SECTION 3. THAT the City Secretary of the City of Lubbock, Texas, is hereby ithorized and directed to cause publication of the descriptive caption of this Ordinance as i alternative means of publication provided by law.
