HomeMy WebLinkAboutOrdinance - 2015-O0085 - Closing An Alley - Dupree Addition - 09/10/2015First Reading August 27, 2015 Second Reading September 10, 2015 Item No. 6.14 Item No. 6.15 ORDINANCE NO.2015-00085 AN ORDINANCE ABANDONING AND CLOSING AN ALLEY RIGHT-OF- WAY, LOCATED IN BLOCK 2, DUPREE ADDITION, AN ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the alley right-of-way hereinafter described in the body of this Ordinance is no longer needed for right-of-way purposes and for public use; and it would be in the public interest to close, vacate and abandon the same for right-of-way purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION I. THAT the alley right-of-way as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for right-of-way purposes and for public use, such right-of-way being more particularly described as Exhibit A. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. THENCE S. 88° 14' 55" E., a distance of 121.60 feet to a point in the West right-of-way line of Texas Avenue as recorded in Volume 444, Page 194 and Volume 447, Page 42, DRLCT, for the Northeast corner of this tract. THENCE S. 01° 45' 05" W., along said West right-of-way line a distance of 15.00 feet to the Northeast corner of Lot -2, Block 2, said Dupree Addition for the most Easterly Southeast corner of this tract. THENCE N. 88° 14' 55" W., along the North line of said Lot 2 and the South line of said alley easement recorded in Volume 320, Page 7, DRLCT, a distance of 90.60 feet to a point for a clip corner of this tract. Thence S. 46° 45' 05" W., along the South line of said alley easement, a distance of 21.21 feet to a point for a clip corner of this tract. Thence S. 01° 45' 05" W., along the West line of Lot 2 and Lot 3, said Dupree Addtion, a distance of 59.16 feet to the point of BEGINNING. Bearings relative to Grid North, HAD 83, Texas Coordinate System, North Central Zone 4202, City of Lubbock Geodetic Network and Aerial Control. Distances are Surface, U.S. Survey Feet. No abstract of title or title commitment was provided to this surveyor for this proposed tract.
