ORDINANCE NO. 2015-00036
AN ORDINANCE ABANDONING AND CLOSING A 5 FOOT
UNDERGROUND UTILITY EASEMENT AND A SWITCHING ENCLOSURE
EASEMENT LOCATED IN TRACTS A, B, AND C, BHAKTA ADDITION,
LUBBOCK COUNTY, TEXAS, WHICH IS MORE PARTICULARLY DESCRIBED
IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO
MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID
ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND N A
PROVIDING FOR PUBLICATION. ti
WHEREAS, the City Council finds that the easements hereinafter described in the
y of this Ordinance are no longer needed for easement purposes and for public use; m
it would be in the public interest to close, vacate and abandon the same for easement
loses and for public use, NOW THEREFORE:
IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the easements as hereinafter described shall BE and the
are hereby closed, vacated and abandoned for easement purposes and for public
such easements being more particularly described in Exhibit "A" and `B".
SECTION 2. THAT the City Engineer is hereby authorized and directed to mark
official maps of the City of Lubbock to reflect said abandonment and closing,
ving the number of this Ordinance and the date of its final passage.
SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or
of this Ordinance be declared unconstitutional or invalid for any reason, the
lder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary of the City of Lubbock is hereby
horized and directed to cause publication of the descriptive caption of this Ordinance as
alternative method provided by law.

Metes & Bounds description for the abandonment of a 5' Underground Utility
Easement dedicated to Southwestern Public Service according to that map,
plat, and/or dedication deed thereof Tracts A, B, & C, Bhakta Addition to
the City of Lubbock, as recorded in Volume 6919, Page 17, Official Public
Records of Lubbock County, Texas, said easement being more particularly
described by metes and bounds as follows:
BEGINNING at an "X" found cut in concrete, in the South line of 58`h Street,
as recorded in Volume 353, Pg. 266, Deed Records of Lubbock County, Texas,
at the Northeast corner of said Tract A, same being the Northwest corner of
said Tract B for the Northwest corner of this easement.
THENCE S. 880 11' 18" E., contiguous with the South line of said 58`h Street
and the North line of said Tract B, a distance of 5.00 feet to the
Northeast corner of this easement.
THENCE S. 010 49' 21" W. a distance of 239.56 feet to a point in the South
plat limits of said Bhakta Addition for the Southeast corner of this
easement
THENCE N. 880 12' 08" W., contiguous with the South plat limits of said
Bhakta Addition, a distance of 5.00 feet to the Southeast corner of said
Tract A same being the Southwest corner of said Tract C for the Southwest
corner of this easement.
THENCE N. 010 49' 21" E., contiguous with the East line of Tract A and the
West line of Tracts B & C, at 107.24 feet (record - 107.31 feet) pass an
"X" found cut in concrete at the Northwest corner of said Tract C in all a
distance of 239.56 feet (record - 239.62 feet) feet to the place of
BEGINNING and containing 1,197.79 square feet of land more or less.
Bearings based on U.S. State Plane of 1983 - Texas North Central Zone -
4202. Distances are surface distances

Addition to the City of Lubbock, as recorded in Volume 6919, Page 17,
Official Public Records of Lubbock County, Texas, said easement being more
particularly described by metes and bounds as follows:
BEGINNING at an "X" found cut in concrete at the Northwest corner of said
Tract C for the Northwest corner of this easement.
THENCE S. 880 10' 39" E. a distance of 8.00 feet to the Northeast corner of
this easement.
THENCE S. 010 49' 21" W., 8.00 feet from and parallel to the West line of
said Tract C, a distance of 8.00 feet to the Southeast corner of this
easement
THENCE N. 880 10' 39" W. a distance of 8.00 feet to a point in the West
line of said Tract C for the Southwest corner of this easement.
THENCE N. 010 49' 21" E., contiguous with the West line of said Tract C, a
distance of 8.00 feet to the place of BEGINNING and containing 64.00 square
feet of land more or less.
