April 23, 2015 City of Lubbock May 14, 2015 Item No. 5.8 Item No. 5.10 ORDINANCE NO. 2015-00036 AN ORDINANCE ABANDONING AND CLOSING A 5 FOOT UNDERGROUND UTILITY EASEMENT AND A SWITCHING ENCLOSURE EASEMENT LOCATED IN TRACTS A, B, AND C, BHAKTA ADDITION, LUBBOCK COUNTY, TEXAS, WHICH IS MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND N A PROVIDING FOR PUBLICATION. ti WHEREAS, the City Council finds that the easements hereinafter described in the y of this Ordinance are no longer needed for easement purposes and for public use; m it would be in the public interest to close, vacate and abandon the same for easement loses and for public use, NOW THEREFORE: IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the easements as hereinafter described shall BE and the are hereby closed, vacated and abandoned for easement purposes and for public such easements being more particularly described in Exhibit "A" and `B". SECTION 2. THAT the City Engineer is hereby authorized and directed to mark official maps of the City of Lubbock to reflect said abandonment and closing, ving the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or of this Ordinance be declared unconstitutional or invalid for any reason, the lder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby horized and directed to cause publication of the descriptive caption of this Ordinance as alternative method provided by law. THENCE S. 880 11' 18" E., contiguous with the South line of said 58`h Street and the North line of said Tract B, a distance of 5.00 feet to the Northeast corner of this easement.
