BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Mayor of the City of Lubbock is hereby authorized
and directed to execute a Partial Release of certain abutting properties
from any lien or cloud of title which could have been created by the filing
of Resolution 2131 of the City of Lubbock in the Deed of Trust Records of
Lubbock County, Texas by reason of the fact that such abutting property
will not be assessed for street improvements on 82nd Street because there
has been a prepaid deposit for street improvements.
SECTION 2. THAT a copy of said Release is annexed hereto.
Passed by the City Council this 9th day of January , 1986.

COUNTY OF LUBBOCK §
WHEREAS, Resolution No. 2131 of the City of Lubbock ordered
proposed street improvements on 82nd Street from University
Avenue to Avenue U, which Resolution was passed on September 12,
1985 and was recorded in Volume 954, Pages 628-630 (inclusive) of
the Deed of Trust Records of Lubbock County, Texas; and
WHEREAS, the City of Lubbock does not desire to assess a
portion of the abutting property lying parallel to such improve-
ments by reason of the fact that there has been a prepaid deposit
made with respect to such abutting property; and
WHEREAS, the City of Lubbock now desires to release such
portions of abutting property from any lien or cloud of title
which may or could have been created by the filing of record of
said Resolution No. 2131 in the Deed of Trust Records of Lubbock
County, Texas, as aforesaid; NOW THEREFORE:
KNOW ALL MEN BY THESE PRESENTS:
THAT for and in consideration of the premises as set forth
in the preamble hereof, the City of Lubbock hereby releases the
following described abutting properties from any lien or cloud of
title which may or could have been created by the passage and
recordation of said Resolution No. 2131 in Volume 954, Pages
628-630 (inclusive) of the Deed Records of Lubbock County, Texas,
by reason of the fact that there has been a prepaid deposit made
for such street improvements as regards portions of such abutting
property, as set forth below, to -wit:
(1) Lots 200, 201, 210, 211, 220, 42, 41, 221, 230 and 231,
Oak Park Addition to the City of Lubbock, Lubbock
County, Texas.
(2) Tract "J", College Avenue Co-op Addition to the City of
Lubbock, Lubbock County, Texas.
(3) Lots 258, 7, 8, 21, 22 and 35, Bent Tree Addition to
the City of Lubbock, Lubbock County, Texas.
(4) Lot 195, Bicentennial Estates Addition to the City of
Lubbock, Lubbock County, Texas.
(5) Tract "A", Redbud South Baptist Addition to the City of
Lubbock, Lubbock County, Texas.
(6) Property described by metes and bounds as follows:
BEGINNING at a point which is East a distance of
2084.50 feet and South 00002'09" East a distance of
55.00 feet from the Northwest corner of Section 9,
Block E, Lubbock County, Texas;
THENCE West a distance of 7.23 feet to a point, said
point being the beginning of a curve whose radius point
bears South a distance of 15.00 feet, having a central
angle of 900 and a tangent length of 15.00 feet;
THENCE around said curve to the left in a Southwesterly
direction an arc length distance of 23.56 feet to a
point, said point being the beginning of a curve whose
radius point bears East a distance of 121.09 feet,
having a central angle of 35°19' and a tangent length
of 38.55 feet;
THENCE around said curve to the left in a Southeasterly
direction an arc length distance of 74.64 feet to a
point;
THENCE North 00°02'09" West a distance of 85.00 feet to
the POINT OF BEGINNING.
Any liens or interests of the City of Lubbock which are not
specifically hereinabove released by the City of Lubbock with
respect to the passage and recordation of said Resolution No.
2131 are hereby expressly retained by the City of Lubbock.
