BE IT REMEMBERED THAT on the 9th day of April, 1986, the City Council of the City of Lubbock met at 9:00 o'clock A.M., at the regular meeting place of the City Council in the City of Lubbock Municipal Build- ing, with the following members present, to -wit: ALAN HENRY MAGGIE TREJO T. J. PATTERSON GEORGE CARPENTER BOB NASH E. JACK BROWN JOAN BAKER On Motion of Councilman Pattersorj seconded by Councilwoman Baker , it is unanimously carried that the returns of the Special City Election held April 5, 1986, for the purpose of submitting proposed amendments to the Charter of the City of Lubbock to the voters for approval or rejection be opened and canvassed, and the results of the election declared there- from; and said returns having been duly canvassed, it is found that the vote upon the various propositions was as follows: PROPOSITION No. 1. SHALL the City Charter of the City of Lubbock be amended to replace words of the masculine gender with words of both the masculine and feminine gender? No. 2. SHALL THE City Charter of the City of Lubbock be amended to provide that plats shall be filed with the City of Lubbock rather than with the Mayor personally? VOTE FOR: 5,365 AGAINST: 9,553 FOR: 6,950 AGAINST: 7,680 No. 3. SHALL the requirement of notice of a claim against the City of Lubbock be- ing filed within thirty (30) days of the time such cause of action arose be extended to six (6) months? FOR: 5,321 AGAINST: 9,333 No. 4. SHALL the City Charter of the City of Lubbock be amended to provide that the interest rate on assessments be such rate as is authorized by State law? FOR: 5,842 AGAINST: 8,623 No. 5. SHALL the requirement for utilities seeking street use franchises to pub- lish the entire proposed franchise ordinance once a week for three (3) consecutive weeks be reduced to once a week for two (2) consecutive weeks? FOR: 4,913 AGAINST: 9.5-19 9 _ No. 6. SHALL the City Charter of the City of Lubbock be amended to provide that the interest rate on special assessments be such rate as is authorized by State law? FOR: 5,783 AGAINST: 8,556 No. 7. SHALL the City Charter of the City of Lubbock be amended to reflect current State law with regard to Municipal Court of Record penalties? FOR: 6,549 AGAINST: 7,834 No. 8. SHALL the Charter of the City of Lubbock be amended to conform with the provisions of V.T.C.A., Government Code, Chapter 30, Subchapter A, which esta- blished a Municipal Court of Record for the City of Lubbock? SHALL the Charter of the City of Lubbock be amended to reflect current State law with regard to requirements for petitions submitted under initia- tive and referendum procedures? SHALL the Charter of the City of Lubbock be amended to provide that peti- tions for recall of an elected officer be signed by at least thirty percent (300) of the qualified voters residing within said elective officer's District of election? SHALL the Charter of the City of Lubbock be amended to reflect that State law referendum provisions super - cede Charter provisions with regard to initiative and referendum matters? SHALL the Charter of the City of Lubbock be amended to require occu- pation tax licenses to be issued by the City Manager or his designee rather than by the Tax Assessor - Collector? SHALL the Charter of the City of Lubbock be amended to provide a means for calling a special election to fill vacant City Council positions in the event that the Mayor or a quorum of the City Council is unavailable to call such election due to mutual catastrophe or other reason? SHALL the Charter of the City of Lubbock be amended to provide for a One Hundred Dollar ($100.00) filing fee or a 25 signature Petition for Can- didacy for all City elected positions? SHALL the Charter of the City of Lubbock be amended to reflect the current Texas Election Code provision with regard to the timing of run-off elections and canvassing_ the returns of run-off elections? SHALL the Charter of the City of Lubbock be amended to remove the duty of the City Council to appoint a City Marshall and a City Tax Assessor - Collector and to allow up to four (4) year terms for City board members? SHALL the Charter of the City of Lubbock be amended to allow the Mayor to appoint the City Manager or Deputy City Manager as his agent to sign some types of routine City documents on his behalf? SHALL the Charter of the City of Lubbock be amended to reduce the re- quired number of publications for penal ordinances from once a week for two (2) consecutive weeks to once within ten (10) days of final passage? FOR: 4,878 AGAINST: 9,206 No. 25. SHALL the Charter of the City of Lubbock be amended to conform to the State law pertaining to minimum con- tract amounts requiring competitive bids? SHALL the Charter of the City of Lubbock be amended to delete Section 29 of Chapter 1, Article IX, with re- gard to "Hours of Labor upon public works" and to renumber the remaining sections of Chapter 1, Article IX? SHALL the Charter of the City of Lubbock be amended to remove certain typographical errors? No. 33. SHALL the Charter of the City of Lubbock be amended to change all references to "corporation court" to "municipal court of record?" FOR: 6,910 AGAINST:, 7,352 FOR: 6,486 AGAINST: 7,700 FOR: 6,869_ AGAINST: 7,186 FOR: 7,081 AGAINST: 7,085 FOR: 6,531 AGAINST: 7,451 TOTAL VOTES CAST: 16,201 And it further appearing that said election was duly held as provided by law; NOW THEREFORE: IT IS HEREBY FOUND, DECLARED AND CERTIFIED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: - 7 - THAT a majority of the qualified voters of the City of Lubbock voting in said election are in favor of Propositions No. and therefore it is declared that Propositions No. are approved by the qualified voters; and THAT a majority of the qualified voters of the City of Lubbock voting in said election are opposed to Propositions No. 1 2 3 4 5 6 7 8 9 1_0 1; 1.2,_1.3,_14, 15 16 17 18 19 20 21 22 23 24 25,26,27,28,29,30,31;32, & 33, and therefore it is declared that Propositions No. 1,2,3,4,_5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 & 33 are not approved by the qualified voters.
