HomeMy WebLinkAboutResolution - 2372 - Agreement-Lake Ranson Canyon-Apportion Overlapping Extraterritorial Jurisdiction - 07/10/1986LJM:js RFSn1 1 IT T nN Resolution #2372 July 10, 1986 Agenda Item #17 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Agreement by and between the City of Lubbock and the City of Lake Ransom Canyon to Apportion an Area of Overlapping Extraterritorial Jurisdiction, attached herewith, which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as fully copied herein in detail. Mon o , Assistant City Attorney Resolution #2372 AGREEMENT THE STATE OF TEXAS § COUNTY OF LUBBOCK § Between the City of Lubbock, Texas, and the City of Lake Ransom Canyon, Texas, to Apportion an Area of Overlapping Extraterritorial Jurisdiction. WHEREAS, the City of Lubbock, Texas, and the City of Lake Ransom Canyon, Texas, have extraterritorial jurisdiction of an overlapping area, they hereby mutually agree pursuant to V.A.C.S. Article 970a, Section 3(B) of the Municipal Annexation Act, to apportion said area as herein described and indicated on the attached map marked Exhibit A, said Exhibit being expressly incorporated into and for all purposes made a part of this Agreement. The area to be apportioned to the City of Lake Ransom Canyon is more particularly described as follows: BEGINNING at the Southwest corner of Section 7, Block I, Lubbock County, Texas; THENCE North, along the East line of Section 7, Block I approximately 5,280 feet to the Northeast corner of Section 7, Block I; THENCE East, along the North line of Section 8, Block I approximately 1,300 feet to a point 1,300 feet East of the Northwest corner of Section 8, Block I; THENCE Southeasterly, along a curve approximately 10,700 feet, said curve established as five mile radius of a circle the center point being the Northeast corner of Section 12, Block S to a point approximately 2,400 feet East of the Southwest corner of Section 4, Block I; THENCE West, along the South lines of Section 4, Block I and Section 6, Block I approximately 2,034 feet to a point 1,634 feet West of the Southeast corner of Section 6, Block I; THENCE North, along a line parallel to 1,634 feet West of the East section line of Section 6, Block I approximately 5,280 feet to a point 1,634 feet West of the Southeast corner of Section 7, Block I; THENCE East, along the South line of Section 7, Block I to the POINT OF BEGINNING. According to V.A.C.S. Article 970a, Section 3(B), this Agreement shall be approved by resolution adopted by the govern- ing bodies of both Cities. In the event that either the City of Lubbock or the City of Lake Ransom Canyon annexes additional territory, the extraterri- torial jurisdiction of the nonannexing City may be reduced by obtaining the written consent of the governing body of such City in accordance with the provisions of V.A.C.S. Article 970a, Section 3(C). The parties further agree that should any plat be submitted under the provisions of V.A.C.S. Article 974a and be located on or immediately adjacent to the shared boundary herein agreed to or as it may be later amended, such plat shall be in every instance submitted to the other City for that City's review and comment, prior to the City who received the original submission taking any final action to approve or deny said plat. This review and comment is intended to be advisory in nature and in no way binding, nor should it in any way interfere with the time limits set out in V.A.C.S. Article 974a. M. 6 JNTRY kLs--lw*y.w POSEY BLOCK BLOCK "I" SE 7 SECTION 8 SAN AUGUSTINE SCHOOL LAND _tANWAL CANYON BLOCK "I" 1BL I SECTION 6 I SECT RESOLUTION N0, 5 3 Extraterritorial Jurisdiction with the City of Lubbock ADOPTED: ` --T WHEREAS, in order to comply with the requirements of Article 970 (a) of the Revised Civil Statutes of the State of Texas, the City of Lubbock and the City of Slaton have agreed to the apportion- ment by mutual agreement of certain territory lying within the extraterritorial jurisdiction of each City, and WHEREAS, such agreement has been reduced to writing by the attached contract by the terms of which the Town of Ransom Canyon extraterritorial jurisdiction is delineated; Now Therefore BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF RANSOM CANYON, TEXAS: THAT the attached contract providing for the apportionment of extraterritorial jurisdiction between the Town of, Ransom Canyon and the City of Lubbock is hereby approved and that the Mayor is directed to execute such in behalf of the Town of Ransom Canyon. BE IT FURTHER RESOLVED: THAT the Town Secretary is hereby authorized and directed to place and keep a copy of this Resolution, which is unanimously adopted, in the permanent files of the Town Secretary's Office.
