BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and
directed to execute for and on behalf of said City its acceptance of a
proposal and letter of agreement dated June 25, 1985 from Freese and
Nichols, Inc., Consulting Engineers, to do and perform for said City the
professional engineering services for a Section 404 Application for Permit
for Justiceburg Reservoir to the Corps of Engineers and/or the United
States Department of Interior of the United States Government, attached
herewith, which shall be spread upon the minutes of the Council and as
spread upon the minutes of this Council shall constitute and be a part of
this Resolution as if fully copied herein in detail.
Passed by the City Council this 23rd day of January a 1986.

I have received a carbon copy of the letter written to you on June 11,
1985, by Mr. L. M. Hawkins, Jr., Chief of Operations • Branch at the Corps of
Engineers Fort Worth District office, outlining the anticipated requirement for
a Section 404 Permit at the Justiceburg Reservoir site. That letter confirms the
information that we had been given previously, to the effect that new
regulations have now extended the 404 Permit area upstream to include the
Justiceburg site.
Enclosed is a copy of a memorandum prepared on June 5, 1985, by Dave
Gattis, who is in charge of environmental studies at Freese and Nichols; it
summarizes the Section 404 permitting process and the steps necessary to meet
the new Corps requirements. As the memo indicates, preparation of the
application would involve a cost of around $3,500. The necessary additional
work associated with the habitat evaluation procedure for a fish and wildlife
mitigation plan would involve further costs of approximately $4,500.
It will also be necessary for various staff members at Freese and Nichols
to handle details of the Section 404 permitting process in response to specific
inquiries from the Corps. Such items are obviously hard to predict and
somewhat indefinite. It would be realistic to expect as much as $750 per month
in miscellaneous costs attributable to such details. Over a one-year period, that
would represent $9,000, in addition to the other two items, for an over-all total
of $17,000 during the first twelve months of the process. As the memo
indicates, the permit might be issued before that point, or it could take longer,
depending on whether an environmental impact statement is required. If that
happens, there could be added costs beyond the $17,000 estimated here. Our
billings would be based on the attached schedule of charges, dated April 1985.

Justiceburg project at this time. If this meets with your approval, please
indicate in the space provided below that we are authorized to begin and return
one copy for our record.

Schedule of Charges
Consulting Services
Per Diem Rate for Principals of the Firm: $100.00 per hour
Staff Members Salary Cost Times Multiplier of 2.3
Salary: Cost is defined as the' cost of salaries of engineers, draftsmen,
stenographers, surveymen, clerks, laborers, etc., for time directly chargeable to
the project, plus social security contributions, unemployment compensation
insurance, retirement benefits, medical and insurance benefits, bonuses, sick
leave, vacation and holiday pay applicable thereto. (Salary Cost is currently
equal to 1.3984 times salary payments. This factor is adjusted annually.)
Other Direct Expense Actual Cost Times Multiplier of 1.10
Other direct expenses shall include printing and reproduction expense, computer
expense, communication expense, travel, transportation and subsistence away
from Fort Worth and other miscellaneous expense directly related to the work,
including costs of laboratory analysis, tests, and other work required to be done
by independent persons or agents other than staff members.
