HomeMy WebLinkAboutResolution - 2398 - Letter Agreement - Booth & Newsom - Water Discharge Permit Amendment - 08/14/1986HW: js RESOLUTION Resolution #2398 August 14, 1986 Agenda Item #39 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby autho- rized and directed to approve on behalf of said City a Letter Agreement dated July 25, 1986, with Booth & Newsom, a profes- sional corporation, for legal services to be performed by said professional corporation related to Water Discharge Amendment and Related Matters, attached herewith, which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Passed by the City Council this 14th day of 1986. Gentlemen: This will confirm our agreement that the firm of Booth & Newsom, P.C. will represent The City of Lubbock with respect to the referenced matter, under the direction of the City Manager, the City Attorney and the Director of Utilities. At the present time, our firm has adopted a fee structure ranging from $80 to $180 per chargeable hour for attorneys' services, depending on the individual involved and his or her level of experience and expertise. Additionally, we utilize briefing clerks to perform those task not requiring the time of an attorney. Briefing clerk time is billed at the rate of $30 per hour. We will submit all out-of-pocket expenses incurred for reimbursement, with a 15% overhead charge added. Usually we ask the client to pay statutory fees directly due to the size and to avoid our overhead charge. We endeavor to have a statement of services rendered and expenses incurred in the mail by the 15th of each month and anticipate being paid within 30 days of its receipt. I will be the account representative and the attorney in charge. Keith Pardue will be associated with me in this matter and you may contact him for information or status reports should that become necessary. My time will be billed at the rate of V100 80 per hour and Keith's time will be billed at the rate of per hour. From time to time, other attorneys may be City of Lubbock July 25, 1986 Page 2 assigned to some aspect of the case with the view that we will use the lowest hourly rate qualified and available attorney for any particular matter. The monthly statement will list the attorneys who worked on the project, the hourly billing rate of each, and a description of the services performed accompanied by the billing for such work. It is the policy of our firm to adjust fees periodically to reflect current economic conditions. We will notify you in writing if the fee structure is modified and advise you that our present rates will not be modified during 1986. Booth Booth & Newsom Attorneys at Law 300 San Jacinto Bldg. 9th and San Jacinto Austin, Texas 78701-2554 August 18, 1986 Re: Water Discharge Permit Amendment and Related Matters Dear Mr. Booth: At its meeting on Thursday, August 14, 1986, the City Council of the City of Lubbock approved your proposal to represent the City concerning its water discharge permit amendments as set forth in your letter of July 25, 1986. At its meeting the City Council raised the question as to its right to terminate this contract upon notice to you of such fact. Your letter of July 25, 1986, does not reference the rightinthe City to Council to terminate this agreement, however, I assume your representation would be the same as any other attorney hired to represent a client and the relationship could be severed upon notice to the attorney with all fees paid to date of termination.
