HomeMy WebLinkAboutResolution - 2416 - Suspends SPEC Proposed Rates, & Sets Public Hearing - 08/28/1986DGV:da ORDER AND RESOLUTION Resolution #2416 August 28, 1986 Agenda Item #33 WHEREAS, a notice of Petition for Authority to Change Rates within the City of Lubbock was filed August 15, 1986, with the City Secretary of the City of Lubbock by South Plains Electric Cooperative, Inc.; and WHEREAS, the City Council of the City of Lubbock, sitting as a regulatory authority under provisions of law, is required by law to hold a public hearing to inquire into the reasonableness of such proposed electric rate change; and WHEREAS, the City Council has authority under provisions of law to suspend implementation of such changed rate for up to ninety (90) days pending hearing and decision on such proposed rate change; NOW THEREFORE: BE IT ORDERED AND RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: 1. THAT the City Council of the City of Lubbock, sitting as a regulatory authority under provisions of Vernon's Ann.Civ.St., Art. 1446c, hereby suspends the effective date of the proposed rate change indicated in the Petition to Change Rates filed with the City Secretary by South Plains Electric Cooperative, Inc., for period not to exceed ninety (90) days from the date when such rate change would otherwise have been effective; and 2. THAT the City Council of the City of Lubbock, in accordance with mandatory requirements of Section 43 of the Public Utility Regulatory Act hereby orders and directs that a public hearing upon said proposed rate change by South Plains Electric Cooperative, Inc., be held in the City Council Chamber of the Lubbock Municipal Building, 1625 13th Street, at Nine O'Clock A .M. on the 13th day of November 1986, to determine the reasonableness of such proposed rate change. The City Secretary of the City of Lubbock is hereby authorized and directed to give South Plains Electric Cooperative, Inc., immediate written notice of such hearing by serving a copy of this Order and Resolution upon them at their business office located in the City of Lubbock.
