Of Land - 01/08/1987JPB:js RESOLUTION Resolution #2497 January 8, 1987 A Resolution by the City Council of the City of Lubbock, Texas, relat- ing to certain property which has been a part of the electric light and power system of the City of Lubbock, Texas; providing such property shall no longer be a part of such system; authorizing the sale, lease or other dispo- sition of such property. WHEREAS, certain property (described in Exhibit A, attached hereto) has: (1) heretofore been acquired through the issuance of obligations of the City (which 'obligations have been retired) and been used and utilized as a part of the City's electric light and power system (the "System"); (2) approximately six (6) years ago, the City abandoned the use of such property as a part of such System because such property has become obsolete and it is not economically feasible to continue to operate the same as a part of the System and such property is now unsuited to the efficient operation of the System and the, City has obtained other property and property rights with re- spect to such System which have been substituted therefor, and such property and property rights are of a greater value and have been and are a part of the System. WHEREAS, it is now appropriate for such property to be declared "surplus" as a part of the System; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT all of the recitals contained in the preamble hereof are hereby found to be true and are adopted as a part of the judgment and findings of this City Council. SECTION 2. THAT the property described in Exhibit A is hereby aban- doned and declared to no longer be a part of the System. SECTION 3. THAT the appropriate officials of the City are hereby au- thorized to sell, lease, or otherwise dispose of such property. Any net proceeds or net receipts, from the sale or disposition of such property, as received shall be deposited in the general fund of the City since more than the value of such property has been expended for replacement of such facili- ties from money which belonged to the System. SECTION 4. THAT this Resolution shall be effective upon its adoption. Passed by the City Council this 8th day of January , 1987. Unit No. 5 Turbine Generators, including auxiliaries, switchgear, both low and high voltage, auxiliary transformer, piping, wiring, control and alarm systems and auxiliary start-up transformer associated directly with Unit No. 5. Cooling Tower No. 6, including switchgear and No. 6 pumps and motors to be used in operation of No. 4 and No. 5 Units. The section of the building housing the offices, breakroom, control room, and the area associated with Unit No. 4 and No. 5, also the area associated with Unit No. 6 cooling tower pumps and motors. The land directly south and east and north-east to the center of No. 6 and No. 7 cooling tower should also be transferred to the Sanitation Department.
