BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock, a standard
utility agreement with the State of Texas Department of Highways and Public
Transportation related to the Interstate Highway No. 27 construction project
attached herewith, which shall be spread upon the minutes of the Council and
as spread upon the minutes of this Council shall constitute and be a part of
this Resolution as if fully copied herein in detail.

This Agreement by and between the State of Texas, acting by and through the State Highway and Public Transpor-
tation Commission, hereinafter called the State, and City of Lubbock
hereinafter called the Owner, acting by and through its duly authorized
representative, shall be effective on the date of approval and execution by and on behalf of the State.
WHEREAS, the State has deemed it necessary to make certain highway improvements on the Interstate System as
designated by the State and approved by the Federal Highway Administration generally described as follows:
County Lubbock Highway IH -27 located from North Loop 289
to U.S. 62 (19th Street)
and
WHEREAS, the State will participate in the costs of relocating and adjusting certain facilities to the extent as may
be eligible for State participation under Art. 6674w-4, V.A.C.S., and which costs are eligible for Federal
participation; and
WHEREAS, the State will request Federal participation in payment of the costs incurred in the adjusting of
Owner's facilities under the provisions of Federal -Aid Highway Program Manual 6-6-3-1, issued by the U.S.
Department of Transportation Federal Highway Administration on September 6, 1985, and amendments
thereto; and
WHEREAS, execution by the State will constitute approval for the Federal Highway Administration under
authority of Paragraph 11 of FHPM 6-6-3-1; and
WHEREAS, this proposed highway improvement will necessitate the relocation or adjustment of certain facilities
of Owner as indicated in the following statement of work:
Water and Sanitary Sewer Utility Adjustments for the City of Lubbock
from 19th Street to 13th Street/
and such work is shown in more detail in Owner's preliminary plans, specifications and cost estimates which are
attached hereto and made a part hereof, and which are prepared in the form and manner required by FHPM
6-6-3-1, and amendments thereto; and
WHEREAS, the State desires to implement the relocation or adjustment of Owner's facilities by entering into an
agreement with said Owner as soon as possible;
NOW, THEREFORE, BE IT AGREED:
The State will pay to the Owner the costs incurred in relocating and adjusting Owner's facilities up to the amount
said costs may be eligible for State participation and which costs are eligible for Federal cost participation.
The Owner has determined that the method to be used in developing the relocation or adjustment costs shall be as
specified for the method checked and described hereafter:
❑ (l) Actual direct and related indirect costs accumulated in accordance with a work order accounting
procedure prescribed by the applicable Federal or State regulatory body.
® (2) Actual direct and related indirect costs accumulated in accordance with an established accounting
procedure developed by the Owner and approved by the State.
❑ (3) An agreed lump sum of $ , as supported by the analysis of estimated costs
attached hereto.

If costs are developed under procedure (1) or (2) as before specified, the State will, upon satisfactory completion of
the relocation or adjustment and upon receipt of final billing prepared in form and manner as prescribed by FHPM
6-6-3-1, and amendments thereto, make payment in the amount of 90% of the eligible costs as shown in the final
billing prior to the required audit and after such audit shall make final payment in an amount so that the total
payments will equal the amount found eligible for State reimbursement by the final audit. When requested, the
State will make intermediate payments at not less than monthly intervals to Owner when properly billed and such
payments will not exceed 80% of the eligible cost as shown in each such billing. Intermediate payments shall not be
construed as final payment for any items included in the intermediate payment.
If costs are developed under procedure (3) as before specified, the State will, upon satisfactory completion of the
relocations and adjustments and upon receipt of a billing prepared in acceptable form, make payment to Owner in
the agreed amount.
Upon execution of this agreement by both parties hereto, the State will, by written notice, authorize the Owner to
proceed with the necessary relocation or adjustment, and the Owner agrees to prosecute such work diligently to
completion in such manner as will not result in avoidable interference or delay in either the State's highway
construction or in the said work. Such authorization to proceed shall constitute a commitment on the part of the
State that the utility relocation has been included in an approved program as an item of right of way acquisition or
construction, that a project agreement which includes the work will be executed, and that the utility relocation will
be required by the final approved project agreement and plans.
Form D-15-48 enclosed with Owner's preliminary estimates attached to this agreement, is approved as complying
with Paragraph 9 of FHPM 6-6-3-1, and Owner is authorized, but not required, to contract such work. The
preliminary estimate will indicate the extent to which work is to be performed under each contract. Other work shall
be contracted by Owner only with approval of the State in accordance with FHPM 6-6-3-1.
The Owner will carry out said relocation and adjustment, accurately record the costs, and retain such records in ac-
cordance with applicable rules, regulations and procedures and all other provisions of FHPM 6-6-3-1, and the costs
paid by the State pursuant to this agreement shall be full compensation to Owner for all costs incurred by Owner in
making such relocation and adjustment.
Bills for work hereunder should, be submitted to State not later than 90 days after completion of the work.
In the event it is determined that a substantial change from the statement of work contained in this agreement is
required, reimbursement therefor shall be limited to costs covered by a modification of this agreement or a written
change or extra work order approved by the State.
It is expressly understood that this agreement is subject to cancellation by the State at any time up to the date that
work under this agreement has been authorized and that such cancellation will not create any liability on the part of
the State.
The Owner by execution of this agreement does not waive any of the rights which Owner may legally have within
the limits of the law.

and contract is to be awarded to the lowest qualified bidder who sub-
mits a proposal in conformity with the requirements and specifications
for the work to be performed.
D. Solicitation for bids is to be accomplished by circularizing to a list
of prequalified contractors or bno, qualified contractors and such
contract is to be awarded to the lowest qualified bidder who submits
a proposal in conformity with the requirements and specifications for

Asbestos cement ( 12 -inch and smaller ).
Pretensioned Steel Cylinder Reinforced Concrete Pressure Pipe.
Polyvinyl chloride (PVC). PVC pipe may used for pipe smaller than
4 -inch.

JUSTIFICATIONS FOR IH -27
CITY OF LUBBOCK UTILITY
ADJUSTMENTS
REVISED March 19, 1987
The City of Lubbock contracted with the consulting engineering
firm of Parkhill Smith & Cooper., Inc. to provide engineering
services related to the adjustment, removal or relocation of
various utility lines. These adjustments are necessary due to
the construction of Interstate Highway 27 through City of
Lubbock. This project is related to utility adjustments
necessary between US 62 ( 19th Street) to 13th Street, within
the IH -27 corridor. Following is a description for each
relocated utility line
1) Line 1-W is a new 10 " water line beginning at 18th Street
along Avenue E to l9th Street, then extending along 19th Street
to Avenue E. At this point the new line ties to the existing
10" cast iron water line. Line 1-W will replace the existing
10" cast iron water line located west of Avenue E from 18th
Street to 19th Street. See plan sheet 2.
2) Line 2-W is a new 14" ductile iron pipe in 27" concrete
casing or a 14" steel cylinder pipe in 30" concrete casing,
whichever is the most cost effective. This line is located in
18th Street. Due to the elevated mainlanes the concrete casing
is required to protect the water line. Line 2-W will replace
the existing 6" cast iron water line in 18th Street and the
existing 12" cast iron water line located in 19th street.
Combining the 12" and the 6" water lines will eliminate one
water line crossing at 19th Street and produce the new 14"
water line at 18th Street. The size 14" water line is based on
the flow characteristic for the existing 6" and 12" water
lines. The existing 12" 'water line at 19th Street will be
abandoned in the 19th Street to 48th Street IH -27 City of
Lubbock Utility Adjustments project. See plan sheet 2.
3)Line 3-W is a new 12" water line along the west side of
Avenue C. This new water line will complete the necessary tie
between the 14" water line at 18th Street to the existing 12"
water line at 19th Street. See plan sheet 2.
Line 4-W is a new 6" water line along the west right-of-way
line north of 18th Street to Avenue E. This line will replace
the existing 6" water line at Avenue E. See plan sheet 2.

5) Line 5-W is a new 4" water line along 17th Street, from
Avenue C to Avenue B. This line will replace the existing 4"
water line at Avenue C to the existing 10" water line at Avenue
B and abandon the reminder of the existing 4" water line along
Avenue C, from 17th Street to 14th Street. Line S -W will
provide the necessary pressure ties between the existing 10" at
Avenue B and the existing 4" at Avenue C. For that portion of
line 5-W which is crossing with a future storm pipe, ductile
iron pipe material will be used. See plan sheet 3B.
6) Line 2-S is a new 6" ductile iron sewer line along the east
right-of-way line. This line will provide sewer services for
the alley between Avenue D and Avenue C, from 19th Street to
18th Street and sewer services for the allies between Avenue C
and Avenue B, from 19th Street to the south of 16th Street.
This new 6" sanitary sewer line will replace the existing 6"
vitrified clay sewer pipe in the alley between Avenue D and
Avenue C, from 18th Street to 16th Street. Ductile iron pipe
material is selected, since there are two future storm sewer
lines crossing line 2-S. See plan sheet 3B.
7) Line 3-S is a new 10" ductile iron pipe along 16th Street,
from Avenue E to the west of Avenue B. Due to the elevated
mainlanes, ductile iron pipe material has been selected. This
line will replace the existing 10" vitrified clay sewer pipe.
See plan sheets 3A & 3B.
8) Line 4-S is a new 24" ductile iron pipe along 16th Street,
from Avenue E to the west of Avenue B. Due to the elevated
mainlanes ductile iron pipe material has been selected. This
line will replace the existing 24" vitrified clay sewer pipe.
See plan sheets 3A & 3B.
9) Line 7-W is a new 6" and 8" water line located along Avenue
E, from 17th Street to 13th Street. From 17th Street to 14th
Street this line is a 6" water line, which is rep -acing the
existing 6" cast iron water line along Avenue E. From 14th
Street to 13th Street the size for this line changes from 6"to
8", and replacing the existing 6" water line along Avenue E . and
the existing 8" C.I. water line located at 13th Street. See
plan sheets 3A & 4.
10) Line 6-W is a new 16" ductile iron pipe in 30" concrete
casing or a 16" steel cylinder pipe in 33" concrete casing,
whichever is the most cost effective. Due to the elevated
mainlanes the concrete casing is required to protect the water
line. Line 6-W will replace the existing 6", 12" and 14" cast
iron water lines, located at 14th Street. This line is also
replacing the existing 6" cast iron water "Line at 16th Street.
The size 16" water line is based on flow characteristic for the
existing 6",8" and 14" water lines. Combining these two water
lines at 14th Street, will eliminate one water line crossing at
16th Street. See plan sheets 3A & 3B.

11) Line 5-S is a new 18" ductile iron sewer pipe along 14th
Street, from Avenue E to the west of Avenue B. Due to the
elevated mainlanes ductile iron pipe material has been
selected. This line will replace the existing 18" vitrified
clay sewer pipe. See plan sheets 3A & 3B.
12) Line 8-W is a new 8" water line. This line located west of
the curb and gutter for Avenue E, from Broadway to 13th Street
and replacing the existing 8" cast iron water line along Avenue
E. This line is required because of the construction for the
west frontage road. See plan sheet 4.
13) Line 6-S is a new 16" ductile iron sewer pipe north of the
alley between 13th Street and Broadway Avenue. Since the
standard for ductile iron pipe carries only even pipe sizes,
therefor size 16" ductile iron sewer has been selected to
replace the existing 15" sewer pipe. This line is replacing the
existing 15" vitrified clay sewer pipe which has been
constructed in a 5 -feet tunnel. For safety reasons, the new
line is located 25 -feet north of this tunnel. Due to the
elevated mainlanes, ductile iron pipe material has been
selected. See plan sheet 4.
