WHEREAS, Section 11-162 of the Code of Ordinances of the City of
Lubbock requires that all permits for the installation of liquefied
petroleum gas equipment, except for residential use, shall be authorized
by resolution of the City Council; and
WHEREAS, Rick Leaverton has made application for a permit to in-
stall a tank for the storage of liquefied petroleum gas at 701 North
Avenue N, which is Lot 2, Vance Industrial Addition, City of Lubbock,
Lubbock County, Texas on behalf of Eddins -Walcher Company; and
WHEREAS, the Fire Marshal and the Building Official have prelimi-
narily approved this installation; and
WHEREAS, the applicant requested the Building Board of Appeals to
vary the terms of the ordinance so that the equipment could be located 20
feet from the property line instead of 50 feet; and
WHEREAS, on January 5, 1987, the Building Board of Appeals approved
a temporary variance to locate the equipment within 20 feet of the prop-
erty line contingent upon a recorded notice of the variance being filed
with the County Clerk and contingent upon acceptance by the nearest
neighbor, Featherlight Building Products Corporation and their successors
in interest; and
WHEREAS, such notice and acceptance has been filed; and
WHEREAS, this installation would not be residential and would be
regularly licensed by the Railroad Commission in accordance with the pro-
visions of Section 113.081 et seq. of the Texas Natural Resources Code;
NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the office of the Building Official of the City is hereby au-
thorized to issue a permit for the installation of liquefied petroleum
gas equipment at 701 North Avenue N, which is Lot 2, Vance Industrial
Addition, City of Lubbock, Lubbock County, Texas to Rick Leaverton on be-
half of Eddins -Walcher Company, subject to the continued acceptance of
Featherlight Building Products Corporation and their successors in
interest on the property described as Lot 1, Sweatt Addition, City of
Lubbock, Lubbock County, Texas.
Passed by City Council this 12th day of February , 1987.
