PARTIES TO THE CONTRACT This contract and agreement is made and entered into by and between the Texas Department of Community Affairs, an agency of the State of Texas, hereinafter referred to as Department, and City of Lubbock, Community Services Department hereinafter referred to as Contractor. The parties hereto have severally and collectively agreed and by the execution hereof are bound to the mutual obligations and to the performance and accomplishment of the tasks described herein. SECTION 2. CONTRACT PERIOD This contract and agreement shall commence on December 1, 1986 and shall terminate on November 30, 1987. SECTION 3. CONTRACTOR PERFORMANCE Contractor shall operate, an energy crisis intervention program under the Low -Income Home Energy Assistance Act of 1981, as amended (42 U.S.C. Sec. 8621 et seq.), hereinafter referred to as the Act. Energy Crisis Program (ECP) contractors shall operate such program in a satisfactory manner as determined by Department, in accordance with the terms of the Performance Statement, hereinafter referred to as Attachment A, with the terms of the Budget, hereinafter referred to as Attachment B, and with the terms of the Allowable Activities Document, hereinafter referred to as Attachment C, which are attached hereto and hereby made a part of this contract, and with all other terms, provisions and requirements set forth in this contract. SECTION 4. DEPARTMENT OBLIGATIONS A. Measure of Liability In consideration of full and satisfactory performance of the activities referred to in Section 3 of this contract, Department shall be liable to Contractor for actual allowable costs incurred by Contractor during the contract period for performances rendered under this contract by Contractor, subject to limitations set forth in this Section 4. (1) It is understood and agreed by the parties hereto that Department's obligations under this Section 4 are expressly made contingent upon the actual receipt of adequate state and/or federal funds to meet Department's liabilities under this contract. Excess Payments Contractor shall refund to Department any sum of money which has been paid to Contractor by Department which Department determines 1) has resulted in overpayment to Contractor or 2) has not been spent strictly in accordance with terms of this contract within fifteen (15) days after the refund is requested by Department. C. Limit of Liability Notwithstanding any other provision of this contract, the total of all payments and other obligations for costs incurred by Contractor under this contract shall not exceed: Twenty Six Thousand feline Hundred Thirty Five and no/100 Dollars ($26,935.00). SECTION 5. METHOD OF PAYMENT A. Witnin a reasonable time after the effective date of execution of this contract, Department shall make an initial advance payment to Contractor, against Department's liabilities accrued or to be accrued hereunder, of an amount not to exceed thirty (30) days need but not more than 12.5% of Department's maximum monetary obligations as specified in Section 4(C) of this contract, provided that Department shall not make disbursement of such initial advance payment until Department has received from Contractor a properly completed Request for Advance Form 270 and State of Texas Purchase Voucher, and Department has reviewed and approved such Request for Advance. B. For each subsequent month of the period of performance of this contract, Contractor may request an advance payment by submitting to Department, no later than the twentieth (20th) day of the month prior to the month for which advance payment is sought, a properly completed Request for Advance Form 270 and State of Texas Purchase Voucher for an amount not to exceed Contractor's actual cash needs for the month for which such advance is sought, provided Department shall not make disbursement of any such advance payment until it has reviewed and approved such Request for Advance. C. No later than the twentieth (20tn) day of the month following the end of each quarter of the contract period specified in Section 2 of this contract, Contractor shall submit to Department an ECP Quarterly Expenditure/Performance Report. Department may in its discretion make adjustments to payments requested under Section 5(B) of this contract based upon information contained in each such ECP Quarterly Expenditure/Performance Report. D. Notwithstanding the provisions of Sections 5(A) and 5(B) of this contract, it is expressly understood and agreed by the parties hereto that payments under this contract are contingent upon Contractor's full and satisfactory performance of the terms under this contract. RETENTION AND ACCESSIBILITY OF RECORDS A. Contractor shall maintain fiscal records and supporting documentation for all expenditures of funds made under this contract in a manner which conforms to OMB Circular A-87, the Management Standards, and this contract. Contractor shall comply with the retention and custodial requirements for records as set forth in Attachment C of OMB Circular A-102, as supplemented by Section 5.154 of the Management Standards. B. Contractor shall give the United States Department of Health & Human Services, the United States Department of Energy, the Comptroller General of the United States, the Auditor of the State of Texas, and Department, or any of their duly authorised representatives, access to and the right to examine, copy, or mechanically reproduce, on or off the premises of Contractor, all reports, books, papers, documents, and other records pertaining to this contract. Such rights to access shall continue as long as the records are retained by Contractor. Contractor agrees to maintain such records in an accessible location. Contractor shall permit and cooperate with any examination conducted pursuant to this Subsection B. C. Contractor shall include the substance of this Section 9 in all subcontracts. SECTION 10. TECHNICAL ASSISTANCE AND MONITORING Department reserves the right for Department or its designee to conduct monitoring and evaluation of the performances rendered under this contract. Department will notify Contractor in writing of any deficiencies noted during such review; and may withhold costs as appropriate based upon such deficiencies. Department may provide technical assistance to Contractor in correcting the deficiencies noted. Department shall conduct follow-up visits to review the previous deficiencies and to assess the efforts made to correct them. If such deficiencies persist, Department may terminate this contract or invoke other sanctions as Department determines to be appropriate. SECTION 11. REPORTING REQUIREMENTS A. Contractor shall submit, for receipt by Department no later than the twentieth (20th) day of the month after the end of each quarter of the contract period specified in Section 2 of this contract, an ECP Quarterly Expenditures/Performance Report, of all expenditure of funds under this contract during the previous quarter. B. Contractor shall submit to Department no later tnan thirty (30) days after the date of termination of this contract an inventory of equipment purchased in whole or in part with funds received under the Energy Crisis Intervention Program, which were on hand as of the date of termination of this contract. C. Contractor shall submit to Department no later than sixty (60) days after the termination of this contract, a final ECP Quarterly Expenditure/Performance Report reflecting Part II (Financial Expenditures) only of all expenditure of funds under this contract. TERMINATION A. Department shall have the right to terminate this contract, in whole or in part, at any time before the date of completion specified in Section of this contract whenever Department determines that cause exists for such termination, including but not limited to Contractor's failure to comply with any term of this contract or with any applicable rule of Department. Department shall notify Contractor in writing of such determination prior to the thirtieth (30th) day preceding the date of such termination; the reason for such termination; the effective date of such termination; and in the case of partial termination, the portion of the contract to be terminated. Nothing in this Section 20 shall be construed so as to limit Department's authority to immediately suspend performances under this contract when Department identifies possible instances of fraud, abuse, fiscal mismanagement, or other serious deficiencies in performance. B. Either of the parties to this contract shall have the rignt to terminate this contract, in whole or in part, when both parties agree that the continuation of the activities funded under this contract would not produce beneficial results commensurate with the further expenditure of funds; provided that both parties agree, in writing, upon the termination conditions, including the effective date of such termination; and in the case of partial termination, the portion of the contract to be terminated. C. Upon termination or receipt of notice to terminate, whichever occurs first, Contractor shall cancel, withdraw, or otherwise terminate any outstanding orders or subcontracts related to the performance of this contract or the part of this contract to be terminated, and shall cease to incur costs thereunder. Department shall not be liable to Contractor or to Contractor's creditors for costs incurred after termination of this contract. D. Notwithstanding any exercise by Department of its right of early termination pursuant to this Section 20, Contractor shall not be relieved of any liability to Department for damages due to Department by virtue of any breach of this contract by Contractor. Department may withhold any payment to Contractor until such time as the exact amount of damages due to Department from Contractor is agreed upon or is otherwise determined. SECTION 21. COMPLIANCE WITH LAW AND ORDER OF PRECEDENCE in rendering performances hereunder, Contractor shall comply with the requirements of applicable federal laws and regulations. In the event of conflict between such laws and regulations and the terms and conditions of this contract, precedence shall be given to the laws and regulations. SECTION 22. CHANGES AND AMENDMENTS A. ELIGIBILITY The Energy Crisis Program (ECP) is designed to assist people in an energy crisis. As described in the Human Services Reauthorization Act of 1984 (PL 98-558), energy crisis is defined as weather-related and supply shortage emergencies and other household energy-related emergencies. The term home energy means a source of heating or cooling in residential dwellings. Some emergencies may include: 1) bona fide inability to pay energy bills resulting in a supply shortage, potential termination, or a supply shut-off that has already occurred: 2) inoperable energy appliances in conjunction with severe weather extremes that result in health hazards to members of the eligible applicant household: 3) other circumstances that will require weather-related and energy supply assistance to alleviate the crisis, i.e., emergency payments to keep fuel in the house and, if necessary, also provide emergency lodging, but not rent or mortgage payments, for the household who is without shelter because of an energy-related situation. A bona fide emergency energy crisis exists when extraordinary events or situations have depleted or will deplete housenold financial resources and/or have created problems in meeting basic household expenses, particularly bills for energy so as to constitute a threat to the health or well-being of the household, particularly the elderly, the handicapped, or very young children in the household. NOTE: A utility termination notice ALONE does not constitute an energy crisis nor is it a prerequisite to receive program services. Under this program, a household is not entitled to a certain preset amount of assistance. For this program, the term household means any individual or group of individuals who are living together as one economic unit, contributing financially to common household expense, and for whom residential energy is customarily purchased in common or who make undesignated payments for energy in the form of rent. DETERMINATION OF INCOME Funds available for recipients under the Energy Crisis Program shall be for households having an energy crisis as described above and that have an income less than 110% of the current Poverty Income Guidelines as issued by the Secretary of Planning and Evaluation, Department of Health and Human Services. As the Poverty Income Guidelines are updated, this program will follow the most current published guidelines. Income refers to total annual cash receipts before taxes from all sources. Income is more fully described in the current Poverty Income Guidelines. Income data for a part of a year is to be annualized in order to determine eligibility. Each local contractor should determine the method of annualizing most appropriate to that locality and abide by that method only for all recipients equally. During a contract period a combination ot methods may not be utilized. Annual gross income may be determined by: A. estimating gross income for the period of thirty (30) days after the date of the household's application and annualizing by multiplying by twelve, or B. annualizing gross income from some consistent portion of a year immediately preceding the household application date (e.g., 30 days, 90 days). Proof of income will be required. Contractor shall receive and maintain proof of the income eligibility documentation of each applicant household. Such proof may consist of copies of checks, check stubs, award letters, employer statements, etc., showing the gross monthly income, if any. In the exceptional case when proof of income is unavailable, an applicant must sign a declaration of income eligibility statement. In such cases, local contractors shall document verification of income eligibility. Verifying income means confirming the correctness of the household's income reported on the application through some source other than the applicant's statement. Verification may not be from another member of the applicant's household. Verification efforts shall be completed by the end of the next working day from when the declaration of income eligibility statement was provided. 5. RESIDENCE REOUIREMENT In order to be eligible for this program, the household must have a resident who is a U.S. citizen or a legally admitted alien. 6. D. payment of water bills is an allowable cost only when it is an integral part of a total (utility) energy bill. Contractor shall negotiate with the utility provider to pay only the energy portion of the bill, whenever possible. However, if utility companies will not allow for separate payment, the total bill may be addressed. It is not allowable to pay for water costs which are billed separate and independent of the utility bill. Contractor must ensure in each case where payment is certified that: (1) reconnection of utilities and/or delivery of fuel is made promptly upon certification for payment: (2) for any remaining balance, Contractor has negotiated with the service provider for the customer to be allowed a deferred payment assignment or a level payment plan: (3) a reconnection fee will be paid only in line with the registered tariff filed with the Public Utility Commission and/or Texas Railroad Commission, and payment cannot exceed the stated tariff cost. Contractor does not have to deliver a check to the applicant or fuel vendor within these deadlines. The intent is to ensure that individuals who are in life threatening situations receive care and the crisis is averted. Noncash assistance will satisfy these standards as long as the assistance is received by the client within the deadlines specified in the statute. Examples of energy-related crisis intervention include space heaters, alternative shelter, payments, flexible arrangements with utility providers, and resolution of the crisis through means which result in the immediate provision of essential energy. Contractor will be considered in compliance with this provision as long as the crisis is averted by the deadline. In order to fulfill the requirements of C(1), at a minimum, Contractor must take ECP applications monthly in every county served on a pre -announced basis. In order to fulfill the requirements of C(2), Contractor may take the information on page 1 of the application form over the telephone, or make a home visit to the applicant. If an applicant appears to meet the income and residency requirements, then Contractor must either 1) make a home visit to the applicant to complete the application or 2) arrange for transporting the applicant to a site where the application can be completed. 9. SERVING RENTERS For those renters who have a separate meter or who pay their utility and/or fuel bills separately from the rent, the provisions set by this plan for nonrenters apply. For those renters who pay heating and utility bills as part of their rent, special efforts shall be made by Contractor to determine the portion of the rent that constitutes the fuel and/or utility payment. Care must be exercised when negotiating with the landlords that the cost of utilities quoted is in line with the consumption for similar residents of the community. If money is paid to the landlord, then he must furnish evidence that the bill has been paid. 10. State, as clearly as possible, the goals and objectives of the proposed project. The purpose of the Energy Crisis Intervention Program is to provide assistance to low income elderly and handicapped with the payment of utility bills during the winter season. Priority is given to households with elderly or handicapped individuals. Payments are made directly to the utility companies in order to prevent utilities from being disconnected for non-payment. A. Each winter the social service agencies in Lubbock receive more requests for assistance with utility bills than funds available. Agencies have attempted to pool their resources to meet the needs, but grant funds are needed. This grant is now being supplemented by private donations submitted to "Project Help." 2. State indicators by which the staff and City Council might be able to evaluate the program in order to determine that it has reached the stated goals and objectives noted in No. 1. The Community Services Department is required to submit regular performance and activity reports to the Texas Department of Community Affairs. These reports will reflect the individuals served, thus indicating that a need has been met. 3. Will this project benefit the community as a whole? The TDCA selects agencies based on their ability to administer the grant according to the provision of the program. Limited assistance is being provided by Catholic Family Services and Neighborhood House, and the amount is usually not enough to prevent utilities from being disconnected. 5.
