RESOLUTION

WHEREAS, it is necessary to make certain findings as hereinafter set
forth to proceed with the Community Development Work Program of the City of
Lubbock; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the City of Lubbock hereby finds and determines that it is neces-
sary and in the public interest to proceed with Community Development Work
Order 31117305, and that additional right-of-way will be needed for paving
programs in connection therewith. The acquisition of such necessary right-
of-way as is needed to implement Community Development Work Order Number
31117305 is hereby authorized, and such acquisitions shall be at the fair
market value as established for such right-of-way in each instance.

CITY OF LUBBOCK
COMMUNITY DEVELOPMENT PROJECT AGREEMENT
FOR
C.D. PROJECT NO. 31117305
In accordance with the terms of the AGREEMENT dated June 1 ,
1987, by and between the COMMUNITY DEVELOPMENT DEPARTMENT, City of
Lubbock and the Engineering Department (hereinafter known as
DEPARTMENT), the latter hereby agrees to perform the tasks and
services for C.D. Project No. 31117305 entitled Paving/Baylor &
Colgate as set forth in the "Scope of Services" attached hereto
and marked Attachment A. The COMMUNITY DEVELOPMENT DEPARTMENT, City
of Lubbock agrees to compensate said DEPARTMENT in the total sum of
$76,900.00 for the performance of said services.
NOW THEREFORE, the parties hereto mutually agree as follows:
1. Changes in Agreement. The COMMUNITY DEVELOPMENT DEPARTMENT
or the DEPARTMENT may, from time to time during the term of Agreement,
request changes to be provided; such changes shall, after agreement
between the parties hereto, be incorporated in written amendment to
this Agreement. If the requested change is for an increase or
decrease in the amount of the DEPARTMENT'S compensation, the COMMUNITY
DEVELOPMENT DEPARTMENT shall be notified as soon as possible, and in
no case later than 15 days before the change is required. ,
2. Compliance with Rules and Regulations. The department shall
comply with all Local, State, and Federal orders, rules, regulations
and laws (including the implementing rules and regulations adopted by
the COMMUNITY DEVELOPMENT DEPARTMENT pursuant thereto) which are not
in existence or which may be imposed in the future. It is further
agreed that the DEPARTMENT, in the execution of the activities
authorized in "Scope of Services", shall comply with all requirements
as set forth in the Community Development Act of 1974, as amended.

of the date the agreement is executed and is subject to the HUD
COMMUNITY DEVELOPMENT.BLOCK GRANT Regulations at 24 CFR Part 570.
3. Construction Project Regulations. If this project agreement
exceeds $2,000 total, then any construction work for this project
contracted out must conform to the Sample Contract -form from the
COMMUNITY DEVELOPMENT office (especially compliance with Bacon -Davis
Act and compliance with City Bid Procedures).
4. Payment Authorizations & Purchase Orders. All requests for
payments toward this project, and all purchase order requests shall be
submitted to the COMMUNITY DEVELOPMENT office for theif�approval prior
to being submitted to Purchasing. No payment authorization or
purchase order will be approved by purchasing or accounting without
prior approval of the COMMUNITY DEVELOPMENT office.
5. Reports and Information. The DEPARTMENT shall furnish any
information or explanations pertaining to this project which may be
requested by the COMMUNITY DEVELOPMENT DEPARTMENT.
