HomeMy WebLinkAboutResolution - 2663 - Accept Paving Improvements-Heavy Highway Construction-Quirt Ave Overpass, E 34Th - 10/22/1987JWF:da RESOLUTION Resolution #2663 October 22, 1987 Agenda Item #18 WHEREAS, the City of Lubbock entered into a Contract with Heavy Highway Constructors, Inc. for the construction of the Quirt Avenue Overpass at East 34th Street (Project No. 9941); and WHEREAS, said overpass has been completed including certain remedial work as agreed to between the parties; and WHEREAS, HDR Infrastructure, Inc., as consulting engineers for the City of Lubbock, designed said overpass structure and observed the work in progress to completion including the remedial work agreed to by the parties, and the overpass is found to have been constructed in accordance with terms of said contract with the exception that remedial work had to be done as agreed to by the parties, which remedial work has been completed as agreed; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. The following letters are attached to this resolution and made a part hereof as follows: EXHIBIT A: Letter from Heavy Highway Constructors, Inc. to City Engineer Larry Hoffman dated July 21, 1987. EXHIBIT B: Letter from HDR Infrastructure, Inc. to City Manager Larry Cunningham dated July 31, 1987. EXHIBIT C: Letter from City Manager Larry Cunningham to Heavy Highway Constructors, Inc. dated August 17, 1987. EXHIBIT D: Letter from Heavy Highway Constructors, Inc. to City Manager Larry Cunningham dated August 24, 1987. EXHIBIT E: Letter from City Engineer Larry Hoffman to Heavy Highway Constructors, Inc. dated August 28, 1987. Such letters constitute the contractual letter agreements between the City of Lubbock and Heavy Highway Constructors, Inc. fot' the remedial work on the overpass, final payment arrangements with respect to payment for allowance for maintenance costs of $40,000.00 for the asphaltic concrete overlay, and guarantee of the asphaltic overlay on the overpass by Heavy Highway Constructors, Inc. to the City of Lubbock for an additional two years beyond the one year of guarantee contained in the original contract, in effect constituting a three year guarantee commencing on the date of formal acceptance by the City Council. SECTION 2. The City of Lubbock accepts the overpass improvements and said remedial work as complete subject to the following agreements made by the Contractor Heavy Highway Constructors, Inc.: (A) Three year guarantee of the asphaltic overlay on the overpass as hereinabove set forth and in said letters of agreement attached hereto. (B) Payment of $40,000.00 to the City of Lubbock by deduction from retainage moneys due the Contractor Heavy Highway Constructors Company, Inc. from the City of Lubbock to cover estimated additional maintenance costs for twenty years. SECTION 3. The City Engineer is hereby authorized to direct the payment of $84,447.37 to Heavy Highway Constructors, Inc. as final payment for said overpass improvements. The amount of $84,447.37 is arrived at by taking the amount now held by the City of Lubbock in retainage under the original contract of $124,447.37 and subtracting the $40,000.00 for maintenance of the asphaltic concrete overlay on the overpass as hereinabove described which leaves the amount of $84,447.37 as the sum due the Contractor Heavy Highway Constructors, Inc. from the City of Lubbock, payment for which is hereinabove authorized. In response to HDR's request for another remedy, we propose this remedial action: We propose to overlay the entire bridge deck with two courses of surface treatment and IV of asphaltic concrete with latex asphalt. Prior to the overlaying operation, we also propose to have all the construction joints sawed and sealed with joint sealing compound and raise existing sealed expansion joints by 2". We will also guarantee the overlay over the bridge deck for an additional two years. We believe this will be the best way to protect the bridge deck from moisture. For a better appearance, we also propose to overlay the concrete pavement area as well. Attached is a listing of proposed quantities and materials. Cunningham ffCity Manager ww,�,,LL ` 779457 Dear Mr. Cunningham: We have reviewed the remedial action proposed by Heavy Highway Constructors, Inc..(contractor) as described in their letter of July 21, 1987 to the City of Lubbock. The proposed remedy -of overlaying the entire bridge deck with a two -course surface treatment, and 1 1/2 inches of asphaltic concrete is a deck sealing practice not uncommon to the Texas State Department -Of Highways and Public Transportation (SDHPT) for new bridge decks constructed in the northern areas of the State. Further, the ✓ contractor has offered to extend the warranty of the deck overlay ✓✓✓ an additional two years beyond the one year warranty as stipulated ��✓ in.the construction contract, thus resulting in a total.warranty period of three years after acceptance of the bridge by the City of Lubbock. Unlike the asphaltic concrete overlay system normally used by the SDHPT, the contractor has proposed using latex modified asphalt surface treatments in conjunction with a latex modified asphaltic concrete overlay. The elastomeric properties of latex -modified asphalt gives the overlay system additional toughness and ductility. These properties give the overlay system additional resistance to reflective cracking. We are of the opinion that the contractor's proposed remedial action of installing a latex modified asphaltic concrete overlay system will protect the concrete deck from moisture. This will reduce the potential for moisture, which may carry deicing salt, to penetrate to the deck reinforcing steel, resulting in corrosion of the steel and eventual spalling of the concrete. The potential for water saturation of the bridge deck is also generally due to poor deck drainage conditions. We feel this potential is also minimized on the Quirt Avenue structure because of the crest curve coupled with steep approach grades. This conclusion assumes, however, that maintenance personnel keep the deck drains clean, as well as accumulated debris removed, thus permitting moisture to drain away freely and quickly. EXHIBIT B�� M Mr. Larry Cunningham July 31, 1987 Page 2 The method the contractor has proposed for sealing the bridge deck also provides an additional 1 1/2 inches of asphaltic concrete wearing surface. This additional wearing surface effectively becomes an additive to the concrete wearing surface which was - originally required to be provided by the contractor. In addition to the sealing effect gained by the additional 1 1/2 inches of wearing surface, the integral wearing surface of the concrete deck will also be preserved. As we discussed in our meeting with you and.your staff on j une. 18, 1987, both concrete and asphaltic concrete :� pavemen#s <requi re maintenance. The asphaltic -concrete overlay, however, may require more maintenance than the concrete pavement due to the different characteristics of asphalt. The potential for increased maintenance costs could be dealt with by extended warranties, similar to those proposed by the contractor, or actual - contractor maintenance responsibilities. Based upon these conclusions and the above discussion, we recommend that the City accept the contractor's proposal with the following possible alternative modifications. Because of the potential for increased maintenance costs associated with the asphaltic concrete overlay, the City could pursue three (3) options to mitigate the maintenance costs. (1) Increase the warranty period proposed by the contractor from an additional two (2) years to an additional ten (10) years; (2) Require the contractor to furnish and install the initial maintenance seal coat approximately five (5) to eight (8) years hence; or (3) Accept a cash payment from the contractor to compensate the City for the differential in maintenance costs. It should be noted that the latter two options are assumed to be considered in addition to the additional two (2) year deck overlay warranty as proposed by the contractor. Specific details of the repair procedures and warranty obligations would necessarily need to be defined further and agreed upon by all parties prior to final acceptance of the proposal. 13a Mr. Larry Cunningham July 31, 1987 Page 3 We sincerely hope the above information satisfactorily addresses the advisability of the City accepting the contractor's proposed course of.action. Box 1488 Amarillo, Texas 79105 Re: Quirt Avenue Overpass Dear Mr. Chow: Your letter of July 21, 1987, regarding the proposed remedial action to seal the deck on the Quirt Avenue Overpass was referred to HDR Infrastructure, Inc., for their recommenda- tion regarding the advisability of this approach. HDR condi- tionally recommended that the City accept your proposal, and because of the increased maintenance costs associated with the asphaltic concrete overlay, suggested that the City pur- sue an option to mitigate the maintenance costs. The proposal contained in your letter of July 21, 1987, a copy of which is attached, was presented to the City Council during their meeting on August 13, 1987. Council accepted your proposal with two additional qualifications: 1. Heavy Highway Constructors, Inc., must pay the City of Lubbock a lump sum amount of $40,000 to cover the costs of maintaining the asphaltic concrete overlay for the next twenty years. This amount is the estimated differential'in costs between maintaining a portland cement concrete surface and an asphaltic concrete surface during the expected life of the concrete bridge deck. 2. Box 1488 Amarillo, TX 79105 Re: Quirt Avenue Overpass Dear Mr. Chow: August 28, 1987 Please find attached copies of your letter dated July 21, 1987, containing your proposed remedy for the cracked bridge deck; Mr. Cunningham's letter of August 17, 1987, setting forth the City -Council's counter proposal; and, your letter of August 24, 1987, accepting the City Council's counter proposal. It is the City's understanding that your offer to guarantee the overlay for an additional two years is.above and beyond the one year warranty contained in the original contract and therefore, will result in a three year warranty commencing on the date of formal acceptance of the project by the City Council. HDR/PSC will serve as the City's project representative during the repair work. Please notify Mr. Will Hagood of your proposed schedule and methodology for completing the work. .The work must be completed by October 1, 1987, and traffic must be maintained over the bridge during the construction of the repairs. When the repairs are completed, HDR/PSC will recommend to the City that the entire project including the repairs be accepted by the City. The City staff will then place an item on the next available City Council Agenda for acceptance of the project by the Council. Assuming that the City Council accepts the project, the City will release to you the retainage minus $40,000.00 to be used by the City for future maintenance of the asphalt overlay. The City certainly appreciates your willingness to work with us to remedy the problem of the cracked deck on the bridge. A timely completion of the repairs will certainly benefit all involved parties. PSC's on-site observatiogs are outlined as follows: Mr. Larry J. Cunningham October 8, 1987 Page 2 (1) All bridge deck construction joints (nine locations) were sawed and sealed with a nitrile rubber base permanent highway joint sealing compound. (2) The existing bridge deck expansion joints were modified to receive the overlay. All joints were extended above the concrete wearing surface approximately two (2) inches by welding 2" x 2" x 1/4" steel angle to the in-place metal armor joint extrusions. (3) One-half of the deck width and concrete approach road- way width was broom cleaned, followed by an application of latex modified AC -5 asphalt, applied at at rate of 0.25 gallons per square yard of deck area. (4) The first surface course, consisting of Grade 4 aggre- gate suppled by R.E. Janes Gravel Co., was then applied at a rate of approximately one (1) cubic yard per 100 square yards of deck area and rolled with a pneumatic roller. (5) A second application of latex modified AC -5 asphalt was then applied to the first surface.course at a rate of 0.30 gallons per square yard of deck area. (6) A second surface course of aggregate, Grade 4 supplied by R.E. Janes Gravel Co., was applied at a rate of one (1) cubic yard per 100 square yards of deck arga and rolled with a pneumatic roller. (7) Steps 3 through 6 were repeated for the remaining half of the bridge deck and approach roadways. (8) A tack coat of RC -250 asphalt was applied to the armor joint extensions and the side curbs of the roadway. (9) .A one and one-half inch (1-1/211) compacted thickness hot mix asphaltic concrete (HMAC) overlay was then applied over the second surface course. Note: HMAC comprised of course and intermediate aggregates, supplied from.,the Brownwood-Whites Mines. Five (5) percent AC -10 asphalt with latex additive used as binder. Mr. Larry J. Cunningham October 8, 1987 Page 3 (10) After placement of the 1-1/2 inch HMAC wearing surface, a coat of emulsified asphalt was applied to the completed surfacing. Based upon on-site observations made by representatives of PSC, all work performed by Heavy Highway Constructors, Inc. and Kerr Construction Company, as related to the overlay installation, conformed with generally accepted construction practices for application of double surface treatments and hot mix asphaltic concrete overlays. In accordance with your letter of August 17, 1987 to Mr. F.C. Chow, all overlay operations were completed prior to the City's deadline of October 1, 1987. Based upon PSC's observations during installation of the overlay system and our final review of'the completed work, we recommend that the City of Lubbock accept the total Quirt Avenue Overpass project, incluing the asphaltic overlay system now in place. This acceptance is contingent upon Heavy Highway Constructors, Inc. extending the warranty of the HMAC overlay system an addi- tional two (2) years beyond the one year total project warranty stipulated in the construction agreement between the City of Lubbock and Heavy Highway Constructors, Inc. A three (3) year warranty of the overlay system and a one (1) year warranty of all other construction associated with this project would commence on the date of final acceptance of the project by the City of Lubbock. In accordance with your agreement with the Contractor, we have prepared Pay Estimate No. 19 (Final), as attached, noting the net amount of $2,976,504.80 earned to date by the Contractor, less $40,000 to cover the future costs of maintaining the asphaltic concrete overlay system. The final amount due Heavy Highway Constructors, Inc. is $84,447.37.
